On May 25, 2022, in McKee, KY, I was enjoying the evening with my children, minding our own business, when Officer J. Weaver badge # 304 from the McKee Police Department decided to approach us and illegally detain us for 29 minutes. He called for backup and Deputy Sheriff Bobby Edwards from the Jackson County Sheriff's Office arrived who seemed to know our constitutionally protected rights and educated Officer J. Weaver.

Yo, this officer is exactly what we need. He was very professional, and he did what he truly thought was the most right and ethical thing to do. He was very articulate about every one of his points, and they are all sensibly congruent. He intentionally kept his hands and distance in a way that makes people feel safe. He didn't harass you, he went out of his way to make you feel safe and respected. I hate, hate cops, but this one is exactly what we need.

I'm not obligated to help you investigate. That's all you need to say. Btw, it takes a whole lot more than him violating your rights to lose qualified immunity, in fact it's so difficult that it's pretty much an empty threat....people should probly stop saying that. The judges are on their team too, remember. All the cop has to say is that he thought he was right, and regardless if it's true qualified immunity stands.

He thought he could compel identification from that man, simply because he asked. He even had to confer with the deputy, who told him he didn't have enough suspicion to detain , nor identify the driver. That's why he let him go after speaking with the more knowledgeable deputy. Just because a cop is nice when trying to violate someone's rights, doesn't make it right.

US Officers have made it an Art to wipe their asses off with the Const'l Rights. Here, in the US, Police Officers don't understand how NOT Breaking the Law is not a CRIME. Rights do Not depend on the OPINIONS of other people (for example, Police opinions). That is why they are called RIGHTS. We don't exercise them only when someone else gives permission. And that being said, it is the reason Police Officers in the US are so DANGEROUS, cuz Cops think that their opinions represent the Law.

@@retcutter10 he was detained without a crime. His reason was absent an actual crime being articulated. Without that reasonable and articulable crime (this means he has to have evidence that lead him to believe a crime occurred). He can't just legitimize his reason absent the Crime.

Cop had a report of a child running around naked. So a child could be in danger. The man has children in the car. Seems to me he has reason to investigate. Having said that, the man has no obligation to identify nor answer any questions. I’m so tired of cops using the phrase “You’re refusing to ‘cooperate’ “. Inferring a violation of law. Exercising our rights is not being uncooperative.

SJVT sent me. I can't believe how you managed to remain so calm. You spoke so clearly and gave the officer every opportunity to think his way out of this but unfortunately his 2 brain cells were sulking and not talking to each other. Meanwhile, there was potentially a child in danger but he forgot all about that - clearly that wasn't as important as getting ID. Absolutely insane!

They are intentionally kept ignorant of the law. In this way they can plead ignorance and avoid consequences. They will fall back on excuses like, "I followed my training and procedure." But because Terry v Ohio was such a gift to police it is almost impossible to successfully claim to be a victim of an unlawful detention. This guy is very lucky the cop didn't just drag him from his car, fracture his skull or simply kill him in front of his kids. This is because all the cop needed to allege for a cop friendly judge to rule in his favor was "missing kid + suspicious man with kids" to meet the minimum threshold in Terry.

Have to give props to you for standing your ground and knowing your rights and to officer Weaver for recognizing he was wrong and apologizing for his mistake. If you are ever in that situation again and for all of you reading this, when an officer thinks that they can force you to answer questions, ask them what is the first line of Miranda? When they say "You have the right to remain silent." Then say "There you go, I'm doing that." If they try to tell you since you are not under arrest, Miranda doesn't apply, simply state that Miranda applies 24/7. Then shut up!!!!!!!

The cop was using his academy training in his investigation. It is all about use of words to trick you into thinking that you must comply in their so called investigation by voluntarily giving up your rights. It's just a game that they hate losing. At least this cop knew where to draw the line and kept his ego in check.

Someone here gets it. They always have a call yet tuck their tails when they meet their match. Had a cop ask me for my ID because he said a burglary alarm went off at a plaza with a Walmart. I just entered the property in a big work van and he hit the lights on me. Said he needs my ID because of a burglary alarm. I told him there are 500 other people in the parking lot and to pick on someone else. I actually have the video lol. Bad quality but you can catch everything on it. Never detained me yet wouldn’t want me to leave. Until he walks off without saying a word.

It is just literally insane how we see these videos every freaking day of cops demanding ID to complete their investigation. How is that man's ID going to tell the cop whether there was or was not a child running around naked and or in danger. What the cop hopes the ID will do is let him bypass the investigation and arrest the individual for a warrant. I'm coming to believe the police actually solve more crimes arrest more people based on warrants because they continually run people's IDs, rather than any actual crime solving.

This cop is a perfect example of why there are so many cold cases. Unless it’s a caught in the act, the cops have a tough time following clues. If there is a naked kid running around, the cop sure isn’t interested in looking for him.

They harassed a man who just pulled into the parking lot and parked. I have it on video. These officers are brainwashed to intrude on rights. Supervisors and officers both get off on it.

@@kuyajeff6552 I have believed for years that most crimes are solved because of either pure luck on the part of the police, or nearly the entire case is handed to police on a silver platter. My bike was stolen, here's the video of the theft, there's my bike in my neighbor's backyard, and here's the yearbook picture of the juvenile in the video taking the bike. If that's not enough there's some DNA where the perpetrator snack is armed on the fence right here. Officers gather your evidence and documentation, and promptly making arrests 6 months later, and brag to the community about another crime solved.

One of the best interactions I have seen. With a couple of bumps, Weaver took the time (albeit a lot of time), to address each detail as it emerged throughout the interaction. Ultimately, he accepted “wisdom” which clearly indicates that he neither leads with ego, nor does he abide by his own ego alone - he is willing to leave his personal feeling out of the investigation. We need far more of these.

That cop had good intent the entire time and did the right thing by asking for guidance and then apologized and then did not ask for ID and then explained he only tried to follow what he was trained. That cop has got hope. He's just frustrated that he lost an argument but he admitted he was wrong and apologized. That is rare.

He didn't apologize for his unlawful detainment of this citizen, he apologized for the "inconvenience" but then stipulated that his duty to provide "security" necessitated a certain amount of inconvenience. He's a fucking moron.

When did he admit his mistake he called his authority under the law rights. He said multiple times I am not here to violate your rights while he committed at least 3 Felony Crimes of Violation of rights and depravation of rights and on 2 separate times threatened to charge him with a crime of interference of his investigation as intimidation to force him to surrender his rights tried to claim that the mere fact he was in a vechile he had a right to inspect his ID to verify he had the right to operate the vechile as a means to identify him never at any point did he ever try and conduct the investigation he was sent there to conduct (dereliction of duty) then spent forever Copspaining about how he wasn't going to continue pushing the issue and force the man to identify and how all the time he spent violating his rights wasn't a Violation of his rights. At what point in this over 20 minutes of unlawful Detainment for no crime committed by the citizen as the cop clearly committed multiple crimes did the cop acknowledge his crimes and apologize for them I heard a lot of Bull come out of his mouth but I never heard anything close to a apologie.

Wow!!! Here we seem to have a good-hearted, well-intentioned officer, trying to do the right thing, who, by his own admission hasn't been trained in a number of the issues the victim brought up. He didn't understand the 1st, 4th or 5th amendments, obstruction, RAS, harassment and a few others. If EVER there was a poster boy for the need for improved LEO training, it is Officer J. Weaver.

That officer was so obsessed with identifying you that he forgot to ask the rather obvious question "Was a child running around this area naked before I arrived?" Whatever the truth you would have answered "No!" or "I don't answer questions!" The officer could have tried to ask the children the same question. Since there was no naked child running around when he did arrive, no confession and no witness other than the complainant there was nothing to investigate. That officer really needs a job with less responsibility, he doesn't know the law and he appears unable to cope.

The first cop noted almost immediately that he did not suspect you of a crime and yet he detained you. 100% illegal to detain without reasonable suspicion of a crime based upon specific and articulable facts.

This police officer probably did exactly as he was trained. Law school would be a great prerequisite to work in law enforcement. I liked this video because at the end, both men remained respectful, and the police officer obviously learned that his investigation shouldn’t start with “Give me your papers!” This officer will be a better servant to the public after learning more about the law.

Most police academies have 2 to 3 times the amount of instruction in Criminal, Traffic, Procedural and Constitutional Law (that pertains to LE) than most law schools.

In other words if this illegal detainment went before a judge the cop would not be held accountable for his actions because he "believed" he was doing the right thing.
