This is why the police shouldn’t be able to say they prevent crime. They wait for it to happen, then clean up the blood.

I hate the police but in the context of what Justin had actually done, I don't know what action they could have taken to prevent this other than have him sectioned. If she had got the SPO he wouldn't have been locked up and would have breached it, if he had been arrested for stalking her he would have been given bail conditions, which is no different to what happened after the assault charge. He could have done this in either of those situations. As Adam said, you can't just lock everyone up, especially based on what they MIGHT do.
@JungianHeights
@JungianHeights Год назад
@@jenjones90 He didn’t just go from the hospital to doing this. It has been building up, but the point is PREVENTION, not a clean up. How are people supposed to feel safe if people are allowed to this? The police don’t understand what stalking actually is. They believe the stalker at their word (because they aren’t going to admit to it), but not the victim. There are laws in place that the police don’t actually follow, as claimed by victims of stalking.
@jenjones90
@jenjones90 Год назад
@@JungianHeights Could you tell me what the police could have actually done to prevent this incident? I understand your points but what actions could they have taken which could have stopped this? Even if the police had followed the laws (you're talking about section 2a and section 4 of the harassment act 1998) and got the relevant protection orders in place, they could not have prevented this based on what he had already done. What I think they should have done was section him under 136 of the MHA as that would have been the only way of keeping him in a secure unit without him having committed or threatened to commit a violent offence. Also, it isn't that they believe the suspect, but you can't get someone arrested let alone charged without evidence. People make stalking allegations every day to the police with no evidence, most of them are false or malicious. You can't just believe someone who makes an allegation. Not charging the person or not arresting them doesn't mean the police believe them or believe the victim, but the burden of proof is on the victim. If it is just one person's word against the other's they cannot just charge and criminalise someone based on the word of the victim. I had nude pics of me put online before, and it was quite clear to me that my ex either did it or distributed the photos for someone else to do so. I had men calling me cause my number was included with them. I had guys I didn't know turning up at my house. The most the police could do was interview my ex over that, cause I had no evidence to directly connect it to him in any way. FYI, Daisy DID have evidence to prove harassment under section 2 or stalking under section 2a. Those are both summary offences. At most he would have been charged, been given a restraining order at magistrates and a non-custodial if it was his first offence. Obviously the police were useless and failed to recognise her evidence (they could have proven harassment if not stalking), but what she needed was evidence under section 4 to stand any chance of him being held on remand and to receive a custodial. She had no evidence under section 4. He clearly didn't care about his criminal record etc so he would have had no incentive to adhere to any restraining orders so in that situation this would still have happened.

It's extremely frustrating that the police never took Daisy seriously with her reports about this psychotic monster. The guy was dating her biological mother, sending unwanted gifts at the pub, calling from a withheld number to her phone, creeping around on the street where she lives on Coronation Street for months, etc. He needed to be locked away or given a restraining order if he got close to her. I knew something of this magnitude would happen and this highlights why ppl don't trust the police when things like this happen.

It's sad that whatever happened continues to this day. People report one person and cops doesn't take it seriously as it should have been but if someone is badly hurt then they want to take action. It doesn't make any sense whatsoever
@grantmcroberts4089
@grantmcroberts4089 Год назад
It isn't they don't take it seriously the stalker has to commit violence or aggressive behaviour for it can be taken action. Sending someone gifts and constantly contacting them isn't enough evidence to stsrt charging the person. You think it is that easy to just listen to a complaint and arrest the person doesn't work like that. You need evidence to back up your argument and prove he is a threat.
@jenjones90
@jenjones90 Год назад
@@grantmcroberts4089 they don't have to according to the law. Section 2 and 2a of the Harassment Act do not require violence or threats of. The issue with most cases is that the victim has little evidence. For example, they get messages online from anonymous accounts whom they suspect are the person, but how do they prove that? The police won't use their resources to investigate that even though they're the only ones that can prove it. So the victim usually has to wait until something worse happens before there is actual evidence which can lead to arrest or interview. And, in defence of the police, a huge number of stalking and harassment allegations turn out to be false or exaggerated, so when real victims come along they aren't as vigilant as they ought to be. I know a number of 101 operators who have said that every 5th call they take is someone making a stalking or harassment allegation, most of which are either extremely petty or a misinterpretation of the law. I've also seen some of these petty cases go through to court, examples of these being a man who was charged under section 2 for sending x10 texts to his ex gf, none of which were threatening and she was even responding to some of them! I saw another case where a guy had been dating someone for a while, she ghosted him, didn't block, didn't tell her to leave him alone. He was sending messages to check she was ok for a couple of weeks when he got a call from the police. The man was charged under section 2, lost his job as a teacher, and took his own life before the preliminary. I also saw one case where a person was charged under section 4 for sending a candle to their ex, whom they were still friends with. The new partner saw the package and the police were called and told it was an arson threat. So to say the police don't do anything is also not true. They pick and choose. But thank you for pointing out that the alleged victim needs evidence, so many people don't seem to understand this, nor do they understand that allegations of harassment and stalking are commonly used maliciously and can ruin people's lives. There is an evidence threshold for a reason, and whilst the legislation itself is lenient, to some degree it is important that not every person who sends a few messages etc is given a criminal record. That legislation was written back when there weren't so many methods of communication...instant messaging has resulted in a lot of people receiving "unwanted contact". A lot of people are committing harassment offences without even realising. And, as most harassment offences happen as a result of break ups, this is again something which has changed a lot since the law was passed. People now have constant access to their exes lives online via social media, snd young people are not taught how to deal with break ups. Back in the day if you broke up and didn't have the same circle of friends, it was much easier to forget and move on, as there wasn't access to that person's life at their fingertips. Nearly everyone I know looks up their exes online for months etc, which could technically be classed as cyberstalking.

They actually take reports very seriously but you can't throw someone in prison for a non-violent offence or for something they haven't yet done. Even if she had got the SPO or if he had been arrested and charged with stalking her, this could and probably would still have happened. Stalking and harassment, at a low level, is very common. The police dish out harassment warnings or PINS every day, and restraining orders if they reach magistrates. Most suspects adhere to the conditions. But you only hear the bad stories about the people that don't. Justin was under bail conditions when this happened, so it was illegal for him to contact her (no different to the SPO she wasn't granted). The police can't predict when someone is going to turn violent, and they can't throw everyone accused of stalking or harassment in prison just in case they might be.

Unfortunately, this is the state of modern policing in the UK. You report wrongdoing but they do nothing until it is too late and something terrible happens. They are very good at doing nothing and let down the victims of crime again and again. There are probably plenty of police out there, but based on what I have seen in real life, they will all be at the cafe rather than fighting crime. My car has been targeted x2 times and despite both incidents being captured on CCTV cameras showing the crimes being committed, I have just been told each time by the Police, that they will not be pressing any charges against the perpetrators and no further action will be taken. Just been left to deal with the consequences of my car being damaged and having valuables stolen whilst the perpetrators get away with committing a crime against me with no consequences. For once, Coronation Street does something good in terms of holding a mirror up to modern day policing, where they are constantly letting the victims of crime down by doing nothing.

The police (at least in Corrie) are a bit like Surrey County Council (or probably a lot of other councils) and whoever is in charge of highways. Oh there's a road that's in a very poor state? Nah, it's fine. A biker loses their life because they hit the pothole and it threw them off the bike and they hit their head? Suddenly, it gets resurfaced. There's a crossing near a school that is dangerous? It's not important. A child gets hit and ends up in hospital? OK, NOW let's add traffic lights. But then, wasn't this basically the approach to the pandemic? Instead of, you know, preventing anything, it's more "OK, it's getting bad... let's see how bad it gets first..... OK, I think a few thousand deaths is enough. Let's lockdown". And "OMG, the number of deaths has dropped below 1,000! END THE LOCKDOWN!"
