I feel sorry for him. They've given people a week to enter and get back out before. But it wasn't cancelled because of his conviction. It was because he lied and overstayed last time.

He must have lied on his Immi waiver application because it asks you about previous visits and how long you stayed. It also asks you about previous convictions. He would never have got the Immi waiver if he had answered honestly.

It was harsh and I can see his pain. Maybe the authorities would have considered allowing him entry with a bond that will be forfeited if he overstays or breaches conditions of stay.

@@wy5432he may have had a (small) chance if he had been honest about his previous overstay… but he consistently made out he had been an exemplary person since his incarceration. Overstaying immediately makes someone a criminal under Australian laws. Unfortunately many people (esp from UK) think that just because they have family members resident in Australia they have the right to free and unencumbered entry into Australia.

For the man trying to see his grandchild, it was the fact that he stayed too long and lie on his card last time that was the deciding factor. The officer should have said that.

One reason why is probably because his daughter is illegal, too, and she won’t dare try to fly, or even enter an airport! He said she came down and decided to stay. Ok, HOW??! He overstayed his by 3 YEARS, and she is most likely doing the same! Like father, like daughter! 🤣😂

Old mate got knocked back on his visa overstay, not on his distant criminal past. Anyone thinking of overstaying, just keep in mind, that although the law states that one may be excluded for future visit for three years, there's a strong likelihood you'll never set foot here in Straya again.

Yep. I've seen ones where they let the guy in in spite of a previous conviction. He declared it all and also had documentation to prove he has been an upstanding citizen since.

I don't think border control thought his 40-year-old crime to be as much of a problem as his lying about that conviction on his declaration the last time he entered Australia. On top of that, he overstayed the visitor's visa by years. He's readily admitted his UK crime but he doesn't seem to understand he's also broken Australian immigration laws.

@@John-G I suspect the two countries have a visa free agreement, where a visa is issued automatically upon arrival for this sort of visit and there's no need to get one ahead of time. Basically he should have contacted a consulate first to get clearance, especially since he had defied Australian immigration law previously.

It wasn't solely the criminal conviction that caused the visa cancellation, I think. The conviction 40 years ago and the more recent visa overstay and omission showed a pattern that he may be someone who disregard law and authority. In view of this, he was not given the chance to make more mistakes.

The new grandfather still believes he can use his emotions as a good excuse to breach laws. It seems like he has never learnt anything from his past experiences - probably he laughed at Australia because he was fine to stay 2.5 years more than allowed. If he still has same attitude like this, who can confidently guarantee that he would be remained respectful to Australan law ? He is a good example of necessity of strict immigration laws

Because he lied about his criminal past and overstayed his visa the last time he was in Oz , I think that's what sealed his fate. Otherwise I think that he might of had a slight chance. I kinda feel sorry for him. His daughter can always visit him in England with his Grand child at a later time. Obviously that's if she doesn't have any skeletons in the closet as well.

The gentleman/grandfather is not being sent back home for a 40yr old crime…he is being punished because he lied about it previously in order to enter the Country and illegally over stayed his 6mos Visa to the tune of 3yrs. I have ONE thing on my record from 1996, a misdemeanor in the US (a fight) and for yrs i traveled back and forth to Canada for family/pleasure. Then when things changed and they began checking passports at the border, that changed and i was not allowed in even though it had been 20yrs. I was there for a death in the family, had to pay $250 for a 3day clemency to go across for the funeral and that was it. I applied paying $100 fee later after that trip to have it removed/allow stay and visits in Canada in the future and they denied it. I tried again ,denied again. I will never try to go there if i can help it again.

I had a misdemeanour in around 1984 and I’ve gone back-and-forth to the states on holidays, I have always declared this. I went to Maui one year and decided to go back again with my kids and granddaughter and was denied. I have been going back-and-forth from Canada to the United States for holidays for the last 38 years. I won’t apply for clemency. Millions of people enter through your open borders from Mexico, what a joke. This started I believe since Canada and United States signed the last NAFTA.

He said his reason was because his daughter decided to not leave and so he stayed to make sure she got settled in. So, is he saying his daughter also overstayed her visa? If the first pipe was a flower vase then what are all the others for - an entire freaking garden? She should’ve never boldly claimed it was a flower vase to begin with - it’s an insult to the officer and everyone else with eyes. I actually own a glass tube flower vase but it’s long and wide with a place to put actual water, unlike hers.

It is not because of what he did 40 years ago, he already paid the price for that. It is because he lied about it and overstayed his visa by years.. apparently he doesnt want to admitt those mistakes and playing the victim card of his 40 years old imprisonment

No, that was the right decision. He lied the first time about his criminal conviction and then stayed in Australia for 3 years on a tourist visa. Had those not happen and he'd been honest from the get go AND stayed within his visa limit he wouldn't be considered a liability.

@@John-G Did you not understand the video? He went to Australia before and omitted that he had a criminal conviction. He went to help his daughter settle in and instead of staying the maximum of 6 months on his tourist visa, he stayed in Australia for 3 years. So second time around he wants to visit his daughter to see his grandchild. Well, tough luck, he could end up staying another 3, 4, 5 years on a tourist visa which would be a crime AGAIN.

Did we watch the same video? Because I think you missed the fact he lied yhe first time he went to Australia and said he didn't have a criminal record. THEN he stayed in Australia for 3 years on a tourist visa. All clear indications that he is a liability and has no regard for the law of the land. He's a risk

While there is absolutely no doubt that this guy cannot be allowed to enter Australia due to his past, I absolutely agree with them on this, they should have allowed him temporary entry for like one or two days, which is done in some cases, to see his daughter and granddaughter and than leave Australia. I would consider that option for sure.

Those people have a residential status in Australia and thus not considered a foreigner. They have to return to their homes in Australia and then are either fined or prosecuted by Australian law. The UK person has no status in Australia so he is subject to being denied entry.

The grandfather violated Australia's immigration law, and gets mad at the immigration officer for the cancelation. He lied about a past criminal conviction, he had a visa overstay (and he most likely worked during that overstay), and he doesn't accept responsibility that his actions brought about this result.

He'd have had a three year ban for the overstay which would have expired, so if he'd just carried on lying about his criminal conviction 40 years ago why would he have even been stopped? Edit: all this does is encourage people to lie and keep on lying. Mind-numbingly short-sighted. 2nd edit: alternatively he could have decked the smug immigration officer, been charged, and then he'd have been able to see and hold his grand-daughter.

This one made me sad. I remember seeing an episode awhile back where an American who previously overstayed his visa by a few years was let back into the country. Sadly, in this instance, I think it was three strikes for no, and only one for yes. It didn’t seem like the officer explained that to the passenger though, he seemed to think it was just his criminal history. Might put him off ever traveling again.

Last time I traveled I saw a beagle sniffer dog detect a banana someone was carrying in a bag of snacks. One banana. She might have done it without realizing it, who knows, but there have been serious fungus epidemics that wiped out an entire species of banana in South America - the Gros Michel, which in the 40s and 50s was the only banana we had in the US. Now what we get is the Cavendish, which is regarded as greatly inferior in taste. Meanwhile Thailand where I live has 24 varieties and if the fungus came there it would be devastating

Pension must mean something different in Australia. In the U.S. a pension is something you receuve in retirement after working and paying into it during your life. "Welfare" is what we call payments to low income families. I was so confused by the negative comments about their income 😂
