Well Done Calvin, second hand motor-traders get poor press and most of the time it’s warranted. You have been more than fair and reasonable and it’s about keeping the punters happy and making money as a business.

I bought a car last year that I had around 3 months after buying and had done 2000 miles a piston went. The garage did take it to do an engine rebuild, had it 6 weeks and gave it back to me still miss firing, took it back again, had it another 4 weeks and gave it me back apparently repaired and running great. Turned it over and immediately engine management light came on, as it had a timing issue. The finance company sent a rep to the garage to get my money back and they closed and moved on! Some garages and dealers are awful, but you can get good ones like Calvin. Top man Calvin for offering some form of resolution

mate im a trader too. its a family business...my wife has been in car sales as a bmw sales exec too ect ect... What your saying is bang on. We will always try to take care of our customers and when things go wrong even after the standard 6 month warranty ends a good trader will still try to help out a customer. We arent all rogues we understand how people feel. Buying a car is one of the general publics biggest purchases in life and i get a great deal of satisfaction from giving a customer a great deal and seeing them drive away happy. But we do not have x-ray vision and we don not have crystal balls... so theres times that shit just happens its how you deal with the shit that determines a decent trader. Just discovered this video today. Been through this myself as a car trader 🙈🙈 absolute nightmare. The law doesn't protect the trader enough. Great insight and props for discussing this topic in the public.

Fair play to you with the offer. Most traders would tell you to jog on. Maybe tell the guy to take bmw to court as it's well known that the timing chains on 2ltr bmw fail

Had the same engine in my 5 series. BMW replaced my timing chain and tensioners for free as it was a recall

5 series 2.0 litre diesel 57 reg approx 124,000miles January 2nd 2018 TIMING CHAIN SNAPPED. CAR WORTH APPROX £3,000. Price of repair for just TIMING CHAIN £1,800 -£2,000. Got advised to get rid so I got rid. It might be the last BMW I buy. I don't how amazing the E60 looks handles. It may be the best motorway cruiser money can buy but when the timing CHAIN snaps it just puts people off

@121bham Avoid e60 altogether?? Its the n47 engine you need to avoid!! you telling people to avoid a whole model based on an engine thats in the e87, e90, e91, e92, e60, e61 etc.... Plain daft. Those models with the 3.0d are bullet proof along with the petrol engines. Swirl flaps are a separate issue and very easily fixed in under an hour by blanking. E60 is a superb car, the 2.0 litre diesel bmw n47 engine is basically one to avoid, not the car models themselves.

@121bham You the one making emotional based generalised sweeping statements, which hold no grounds. I've had 2 e60's over the years, well one e60 525d and an e61 530d. Never had any issues bar the norm, thermostats, swirl flaps on e61 out ( preventative ), alternator brushes replaced @ £30. Discs, pads, filters. You think they are ugly, your opinion, welcome to it, however, pretty much every car reviewer these days regard the e60 as a car that has aged beautifully well, bangle got it spot on. One thinks you are clearly living in the past, remembering and regurgitating opinions of motoring press when first launched, as it was way ahead of its time looks wise back then. I recommend the e60 whole heartedly. Guessing you got stung financially on one 🤔, sore memories hey?

Good for you, Im really pleased for you. I basically said I had owned two e60's in the past, to give grounds to my arguments as to why I would recommend one. If a fault arises when you have passed the 30 day period, then a refund will be a lot less likely. But the Consumer Rights Act 2015 still offers you some protections. The vendor still has a responsibility for the car to be satisfactory six months after it's purchased. The three legal descriptions still apply, and you can approach the dealer to put the faults right by either offering a refund to reflect the status of the fault, or by repairing the car at their own expense, not yours.

I first started watching this car diary wanting to dislike the guy ( he’s young wealthy ambitious and it seems successful) why shouldn’t we be bitter and jealous, but actually what a nice young man he is. He’s bang on point as a presenter his videos are honest and educational and full of passion ( the type of person we should have presenting top gear) I would absolutely buy a car from him,in fact Calvin I am currently looking for a Wv Passat DSG estate if you have anything. There’s always been a problem with the 1 series BMW’s and timing chains. The amount of people I’ve heard complain about there 1 series having timing chain issues.

I'm becoming a Calvin addict. You honesty shines through in all your videos, and that's why you're successful. I heard a story about Honda's VTEC engines, 1m made, 1 failure. I doubt BMW is quite that good, but it wouldn't be more that 10 in 1m surely. 😳

My 2010 n47 320d timing chain snapped at 130K, out of BMW warranty. Full BMW service history. Ironically at its last service I actually commented to the service agent that I thought the timing chain rattled a bit on initial start up. 'That is quite normal sir'... It was a company car fortunately for me, was sold un-repaired as the cost of a new/recon engine was the same as the value of the car. Avoid any n47 BMW's!!!

Going half way with a customer looks great when a case gets to court. My wife is self employed and has often taken that approach with people (even when she didn't necessarily NEED to), and has always left her in good stead, legally and with customers so fair enough mate, hope it pans out in your favour.

I’ve been watching your videos since subscribing after watching your c63 vid , then I come across this video of you visit to Port Talbot or should I say port toilet 😂😂 I was brought up there so I can say that lol. Fair play Calvin your a legend offering to meet the guy half way in the repair 6 months after the sale 👍 . Oh and there are some great driving roads especially in the Swansea valley and Brecon Beacons areas . Keep up the great videos 😁

Well bit of information for people that dont know this. Any car with a timing chain no matter what brand bmw honda Vauxhall seat etc will need to have it changed at some point in its life span same as a belt. Yes the chain itself could be used for the life of the car in theory hence why people and company's use these terms but if you know how this system works it's not actually the chain that fails all timing chains have tensioners these have hydraulic assistance from the oil pressure in the engine to keep tension on the chain and also have oil jets to keep the chain lubricated what happens is these tiny holes in the oil jets or tensioners become blocked or partially blocked reducing the lubrication and necessary pressure to keep the chain tight in turn this can cause the chain to run dry stretch and snap or the tensioner will let the chain run loose and rattle on start up and idling this causes the chain to stretch snap or even slip teeth hence why is so important to service the car regularly and use quality parts to prevent this from happening but theres no guarantee it will stop it and because these oil jets and tensioners are so inaccessible and deep in the engine it's now become standard practice to replace the whole lot at same time and now bmw have made things worse with the 2.0 n47 and 3.0 n57 by putting chain to the rear of the engine so now it's more cost effective for garages to remove the engine to access it

Great video. But I’m confused under The Sale of Goods Act that contains three clauses that apply to every car purchase made from a new or used dealers: The car must be “as described”, “fit for purpose” and “of satisfactory quality and This guide deals with problem cars bought from dealers, the Act applies for six years after a car has been purchased. However, if something does go wrong with a car that far down the line, you’ll be hard-pressed to prove it hasn't been caused by normal wear and tear, rather than a vehicle fault. If something goes wrong within the first six months of delivery, then you have more of a leg to stand on. In fact, if your car fails to meet one of these three clauses during that period, then the dealer is required to have relevant faults repaired, or the car replaced. Either that, or the Act states you’ll be due a partial or full refund... I have actually cut and pasted that bit of info.. but I’ve actually had to go back to a dealer after my car blew up ( sort of) after 5 months and they certainly didn’t say these things just happen. But they were not too impressed.. the car was fixed at their expense. Will be interested to see where this goes as I obviously don’t know the back ground.

Sarah Naden i think this is where the problem lies in general. The public are not very knowledgable on the subject. I could type so much but I’ll be doing vids about this stuff as time goes on and looking at the size of what you e typed, we’ll be sending each other paragraphs all night (I mean that politely by the way). @@CalvinsCarDiary if the problem was or could have been developing at point of sale then the dealer has to fix the issue or give a full/partial refund if after 30 days from purchase date. The buyer in your case should have got a independent vehicle inspection to verify the problem on the car and wether it's just wear and tear/age issue or actually a problem that should be covered. On the other side..i was attempted to be had over by a rogue dealer for headgasket failure after 3 months on ownership on a impreza.. got all repairs costs back luckily for me section 75 on credit card as they initially accepted repairs then didn't pay up.

Ah bmw n47 engine common problem for the timing chain to brake. The bbc watchdog even did a show about it and bmw even had a recall for the fault

Shaun Proctor they called it a ‘quality enhancement’ - never issued a recall so that they didn’t have to deal with the bad press and the cost of recalling all of those engines - absolute scum bags

I've got a 2010 320d,the night before I fetched it I researched common faults on these cars....Timing chains are a massive issue....I bought the car anyway,nearly 3 years later with yearly servicing no issues,to be honest I love the car.

I believe the law states the onus is on the trader to prove the fault didn't exist when the car was sold in the first 6 months. Let's be honest, most car traders buy a car, wash it and could have sold the car the next day, if there's an underlying issue that the original seller didn't disclose, the trader isn't going to know either, but as a trader the law is against you somewhat to protect Joe public.

🤣😂🤣😂🤣 As soon as you said timing chain snapped I knew it would be either a bmw 2.0ltr diesel, loads of cases of them snapping and even more of stetched chains that would snap if left alone, bmw can deny it as much as they like but if there wasn't a problem with them then bmw wouldn't keep updating the timing chain items for that engine 🤦‍♂️🤦‍♂️

I purchased a 2006 BMW 330d from a trader and within two days it wouldn't start. I tried to contact the trader but he "lost his phone" and changed his phone number. After months and months in the garage, it turned out there was water damage to the ECU as well as fuel pump damage. It cost me £3,000 to get it fixed. I took the trader to court and the judge laughed it off and said it wasn't a trade sale, even though he sells cars for a living and used trade plates during the sale. I was awarded £500 as I was offered that in the first place by the trader. The UK courts are messed up but I've decided to move on with my life and just let it go. An absolute mess that I'm still financially fucked up by.

I remember when my brother bought mk6 golf dsg. On the way home he realised the gearbox starting jerking. He spoke to the trader he tried fobbing him off. Brother spoke to trading standards they said the trader either has to pay to get it fixed by a specialist or give a full refund on the car. After few emails he agreed to refund the car. Put my brother off dsg he went back to manual after that. My brother used to buy and sell cars himself as a traders ago so he knew about the 3 warranty by law

This is a good point. This is something that is unreasonable. If somebody bought a car from me and I agreed that it was ‘fit for purpose’ and sold under ‘the sales of goods act’ I wouldn’t even embarrass myself, I’d tell them to drop the car back and take a full refund.

Where you based love to buy a car from you one day I have trust issues with people that’s why I prefer buying from a trader because that way I have some rights

Within the first 6 months any problem the dealership has to fix or prove the fault was not there when the car was sold under the consumer rights act 2015.... if it’s a BMW and the timing chain is never supposed to snap then I geniunenly don’t think you will win the case especially if he has legal representation

Chap, I’m new to your channel. I am an old fart as over 50 but have owned lots are cars ( McLaren 570 is one of the current ones)... so dealt with quite a few car trader, your offer to split repair cost does you credit. Very reasonable 😀

The only thing that's not made from plastic on a BMW is the timing chain and even that breaks after a while.

a timing chain doesn't just snap, it will sound like a tractor for months if not a couple of years before it lets go. So the real question is did you sell a car that sounded like a tractor to this guy?

BMW n47 engine. Can't believe BMW are still claiming the timing chain didn't snap in them. Same diesel engine in the old shape mini countryman and mini paceman to name a few. The bleeding timing chain snaps in them too! BMW's themselves are at fault for this known issue with that engine.

You can find really good driving roads near Port Talbot. Find the route from taibach to Cymmer it runs up the valley with fantastic views and when you get to Cymmer you can then drive up the mountain road and come to the top of the Bwlch which is impressive to say the least. You can then drop down the road to Ogmore Vale and rejoin the M4 at Sarn Park. This is a really great ride and I hope that you will have a go in the future.

Get on the 448 to monmouth! , cracking road but littered with speed cameras and unmarked police cars/bikes!....good luck!, as for the bmw im sure it has had a recall regarding the timing belt.

Very generous of you to offer to go halves - Had to make the same drive myself many years ago to Port Talbot to receive speeding points (only 3 but it took me to 12 and a ban) - Very fair judge as only banned me for 2 weeks, looks like they have a new court mine was in the centre of town from what I remember. Nothing but M4 from London to there - no nice roads. What happened in the end?

It does not matter if the fault was obvious or not. The buyer has the legal right to goods of a "reasonable quality " and that they should perform the purpose for which they are sold for a REASONABLE time. six months until a cam chain is NOT reasonable. ergo you take the car back or provide a warranty that they can claim on. don't expect any sympathy as a car trader.

Hi I know this is late but I had a 120d coupe and the same happened. Needed a total engine rebuild c. 7k and luckily I had BMW extended warranty.

as a car trader if the car breaks down in 30 days then yea its your thing to fix if it is after then its the owners shit to deal with it

Everybody knows these are a volatile engine. They have usually eaten a turbo, or two (at £1500 a pop) before the timing chain craps its pants.

Depends what was up with the car and how many miles he'd done after he bought it from you. If he bought the car and had done 2 miles, clearly there was something wrong at the point of sale. As a trader and car dealership, it's a good gesture to offer some sort of warranty period (you probably do) I've not watched the full video yet. That's just my thoughts.

I’m guessing that although I’m not a Barrister or Solicitor in the UK I am an Atty from the US and it sounds like the common law rule of “notice” or service was not complied with at all. Therefore he got a default judgment. Or that’s what happens here at least. And in a civil court once default is entered and usually 42 days elapse, you’re screwed!

Can i ask why or how you didnt hear about court case/even bailiffs mate? and how on earth they assumed you didnt want to turn up when you didnt hear about it. just interested to know..the bmw engine snapping is common on n47 engine even appeared on bbc watchdog.

If the timing chain has snapped then it’s down to a poor maintenance schedule on the car. BMW engines should really have oil changes between 10-12k miles, not 19k like recommend.
