I can't comprehend the gist for allowing the civil liability to subsists, when the accused failed to enter his plea upon his death. Inversely, i am puzzled as to why upon entering the plea the civil liability, arising from delict, will be extinguished. Is there a case, or does someone know the essence as to why such rule is applied?

Sir, what if nakalimutan po ng pulis na i-book ang tao na say for example ay nahuling nakikipag-inuman during an enhanced community quarantine. Halimbawa po, kinulong lang magdamag bago pinauwi. Then, after 1 month, ipinatawag sya uli ng pulis at saka lang nag booking. Considered na po ba itong warrantless arrest?
Warrantless arrests are enumerated under the rules of court. That situation mam is not one of those enumerated circumstances for a valid Warrantless arrest. So, no po mam.
@@wiserpinoytv Under the enumerated circumstances, to my mind, a valid warrantless arrest was effected based on the narration of "nahuling nakikipag-inuman" (Rule 113 Sec 5 Par (a)). However, correct procedures for such valid warrantless arrest are obviously wanting (nakalimutang i-book and most likely other apparent lapses like stating the reason for arrest, etc.) .
