Madam, the cheque bearing the legend as "Not Negotiable" between two parallel transverse lines can be transferred end number of times as the words added do not restrict its negotiability. How did you quote that it's transferrability is restricted? As per Sec 130 of NI Act, 1881, a person taking a cheque bearing the words "NOT NEGOTIABLE" will not have and is neither capable of giving a better title than that which the person from whom he took it had. Means if the title is tainted or defective then the same title is transferred. The person who took it in good faith and for consideration, holds a good title as a Holder in Due Course. Please read Holder and Holder in due course. 2. Cheque is never cut but issued. Please don't misguide the viewers. You need to be abreast of the instructions first and deliver thereafter.
