Taking part in Trinity Chambers' Newcastle 2023 Business & Property Conference, Gordon Menzies delivered a session entitled:
'Has Arbitration Come of Age?' - Current Issues in Arbitration
The Arbitration Act 1996 is over 25 years old, and through two consultation exercises the Law Commission has embarked on a review of the Act, highlighting a range of current issues in Arbitration. In his talk, Gordon discusses these issues and the likely evolution of Arbitration, including the rules as to the law applicable to Arbitration agreements. Gordon's session explores the following:
• Confidentiality
• Independence, impartiality & disclosure
• Commencing an Arbitration
• Proper law of Arbitration agreements
• Discrimination
• Summary Judgement
• Challenging the jurisdiction of the Tribunal
