@@davidborboa77 Doesn't matter. Property management is not allowed to enter any occupied rental without notice. I worked at a property where someone committed suicide. Gunshot was heard by neighbors and I had to follow the law, contact police with the tenant's employer who stated he did not show for work just to do a wellness check and enter the unit. If it were not for the police check, I would have had to post a 3-day notice to enter and wait.

The property manager said it correctly. Since he isn't the legal tenant of the apartment they can't work with him. They can discuss a resolution with the legal tenant but not some guy that's not a tenant of the complex.
This is beyond shady. Accusing him of having counterfeit money just to try and discredit him when it was clearly marked as play money is so low. I hope he wins his lawsuit BIG.

To those who think he has no case because he's not on the lease...wrong. That violates the regulated eviction process. Even without a lease, by cashing his checks consistently, they effectively moved him into a month by month lease. He became their tenant when they took his money. It's why some folks are getting out of hosting through AirBnB. Many states have 30 day laws. Once a tenant stays for 30 days and you take the payment for their stay, you would have to go through the formal eviction process to remove them. They no longer had to serve his ex. They had to serve him, and leave a 24 hour notice. They did neither. They f*cked this up royally.
By sending the checks on the behalf of the actual tenant doesn't really give him fill legal grounds since it could be her (ex) mom sending checks in her name legally the occupant is the one who is contracted with the building. Mama have no day so. I'm this case neither do he.

Making assumptions on where the rent money came from won’t excuse the fact that this man was still a tenant and has been since the day he’d been living in the apartment for 30 days hit and the rental company accepted a check with his name and bank account on it as rent payment. Every rent check also came directly from this man and has his name on them. He can easily provide proof that the rent money came out of his own bank account with his bank statements, fyi. So yes, he absolutely does have a case and somebody’s about to lose their job because their boss is about to have to pay up for their mistake lol.
@MsMookalate I worked in mortgage law in Texas. Again, this is why AirBnB is illegal in many cities. Any state that has a 30 day residency law can leave themselves open to squatters. If they pay for a month, then decide not to leave, you have to evict them, even without a lease. He gave them money. They were cashing his money orders and checks. Their acceptance of his money and the length of time he was in there would mean they were operating (in a legal sense) on a month to month shadow lease. The longer he stayed in that apartment without them ever questioning it makes it harder and harder for them to try to pull what they did. They messed up. They weren't paying attention to their property, and they didn't serve proper notice. Their attempt to justify throwing out his stuff by saying he wasn't on the lease means nothing. They didn't get him out like they were supposed to, and now they are legally exposed. This excuse of "he wasn't on the lease" isn't gonna fly with a judge. If they've stayed over 30 days, you have to go through the full eviction process, which includes a 24hr notice on the door before entering and removing his things. They're gonna have to come out of pocket on this one.
Corporations are people. They have names and addresses. Get the names of everyone you come in contact with in business. That way you know who the corporate thugs are beforehand. Then if they pull this kind of crime? You can find them and give them a little personal persuasion. They come after me it’s war. And I go after the soldiers. It began as an honest mistake of apartments and a sincere apology...and then the executives got involved and didn't want to take accountability once they found out they had a possible "out" from accountability. ...but they had no problem accepting this man's money for several months because he was a quiet, rule-abiding resident who paid his rent on time and didn't cause problems. Executive management is often ruthlessly greed-driven...or so narcissistic that they sweep every problem they create at work...and in their personal life...under the rug.

Not quite. They took "HER" money because they assumed she was still living there with him. She wasn't. It was rented to his ex-girlfriend, who in turn rented it out to him while still under her name. Yea....can't do that. I'm sure he knew and just figured they wouldn't find out. Well, now they did.

It also showed receipts from The Hamilton and said "Johnny paid the near $3000 rent each month...". I thought they were saying that he was literally the one paying the rent. Like, the check came from him.

Calling him a counterfeiter on that document after finding clearly labeled play money should be grounds for a libel case. This management company is just awful. I was late on rent many years ago so the apartment manager assumed my apartment was “abandoned” and did the exact same thing to me. Gave away my belongings and sold them in her garage sale. I sued & won. Apartment manger lost her position of 20 years. Best of luck to this man.

My Manger did that to my locker...emptied all my personal stuff out..changed my locker and gave it away..then her dumb arse self gonna ask who assigned you to that locker....I was livid...I think she a bit slow, now I've been thinking harder....ontop no one was on the list..to be able to authorize that but her, I had that locker 6 plus months in, so yeah she's slow asf.

In the mean time it's likely that with the destruction of property, especially with their confession that they did it, would mean whoever they had do it could face SERIOUS legal issues if not themselves as well. I'm talking criminal there. Destruction of property, tresspass, illegal entry, breaking and entering (since it was done without a 24 hour notice, mistake or not). There's a multitude of things that are likely going to force the Hamilton to pay up without even taking it to court day one. It's sad how the apartment complex wasn't complaining when he was paying all that money for rent on time every month, then when THEY make a mistake and throw him and his daughter's belongings out all of a sudden they try and throw all those "stipulations" on him and threaten him. I hope he gets lots of money when he sues.
The stipulations should be on them as they were the negligent party. They should be the ones that are 100 percent sure the name on the check is the person that actually is on the lease.

He was subletting without a lease. Most places dont allow you to sublet, its a violation of the lease. They are trying to cover their mistake by pointing at his mistake, which was a lack of a lease.
Well the man screwed himself by not informing them that his ex up and left. They would have evicted him anyway if they had found out without this having had happened. Is it morally wrong to not want to make things right with the man? I think so. Is it negligence on this man's part for not informing the office that the leaseholder left without notice? Absolutely.

That isn't really a matter that prosecutors would pick up. It would most likely only end up in civil court, where they can be sued, but not sent to jail.
I was a property manager at some large complexes and no one in my company ever evicted the wrong unit. Never. Even the maintenance staff were on top of this along with the Sheriffs who accompanied our evictions. The entire staff who did this should be fired. And there are laws about entering apartments without advanced notice. I hope he takes this company to the cleaners. Everyone in Dallas should boycott this place. Overpriced and breaking the law.
If it's the same as it used to be every building is owned by one of like 2 or 3 companies, and the other ones aren't any better to deal with. You do boycott. But you boycott whole neighborhoods when you do.
I worked maintenance in my early 20s for a couple different property management companies and I am not surprised at all that this happened and that you think all your people are on board. Maybe you didn’t have that many evictions so it was a big deal?

The lawyer is right. It doesn't matter if the lease owner is there or not. The only thing the complex got right is that he was supposed to have his name on the lease to be there full time. But it doesn't excuse the first infraction of throwing his stuff out. Since much of his stuff was either damaged or pretty much free for the taking, they don't need to "retrieve" his items back. They need to sign him a fat check to replace everything. I hope this lawyer tore the complex a new one.

I hope this man and his daughter are recovering their losses and are able to move to a better place. The last complex I lived in was nice but the owner and management staff were so shady about rental payments and added late fees that I didn't actually have because I'm dutiful about paying rent on time. I moved out as soon as I could. Then out of the blue they tried to sue me for apartment damage a year later after I had already moved out. The suit was dropped because I took pictures of the inside of the apartment I rented before I moved in and pics right before I turned in the keys as I moved out. I proved my point that the management was trying to harass and sue me for damage that wasn't there. My pics saved me from a lawsuit and also showed how greedy and petty the Apt management and owner truly were. **DEFINITELY Take pics of your rental before you move in and after you move out and keep your monthly rent receipts that proves you've paid on time every month**
Why we stop using this video rental years back is because they wanted to charge mom for never rewinding the movies she always checked behind us to make sure they were rewound this was when we were young and I didn't know how to touch any buttons till I was about 7 I didn't trust myself till then we always triple checked but everytime we took them back that evil movie rental place said we didn't and it was like a $20 charge for each movie not rewound and they said all of our movies weren't think like 3-5 movies that rental place went out of business a few years after we stopped going

When he sues, he should make sure that there is a large sum in punitive damages for the stress and mental anguish he and his daughter suffered, which I am sure is absolutly real. It really depends on the minutae of state housing/ contract law. Texas is not known for it's strong tenant protection laws. If this happened in California, home of the gay communist agenda, when a landlord knowingly accepts payment from a named tenant (like seeing your name on the cheque every month), that establishes certain basic rights for the tenant. Is obviously not the same as signing a rental agreement, but (as another comment here thoughtfully corrected me on) accepting the check in CA would generally be considered a type of contract, and the tenant would fall into a verbal agreement for month-to-month, until the landlord has a tenant sign a new rental agreement. The specifics of that month-to-month/no signed rental agreement are going to be different depending on county and city. This is based on a principle in contract law that if someone is getting a benefit, then they have obligations that go with it. Ie, if the landlord is getting the benefit of the rent money, courts would say that, even without a rental agreement, the landlord knew what they're doing, and thus they have certain obligations for how they treat this guy. But in Texas, this will be a hard fight in court. This guy needs to win in the court of public opinion, hopefully shame them into settling, because the property manager has a good case. Courts are not exactly tenant friendly. edited- had CA law wrong.

Watching your neighbors going thru your stuff and things already taken, that's a nightmare. And knowing his child's birth certificate, etc was probably taken by the neighbors, he needs justice.
Apartment neighbors are really obnoxious in this regard. I was moving into an apartment once and had a stack of objects on a landing inside the locked door. The parking lot was far from the door so i moved a full carload of stuff into the landing. I went and parked my car then came inside. I think i went up to my apartment for some reason like to unlock the door and put some stuff down. Maximum 1-2 minutes had gone by and i come back to find 2 women picking through my stuff. Obviously i was like "WTF are you doing?" They are startled like kids in the cookie jar. They just start smiling at me like "ohh we thought this was free to take because someone was throwing it out." In my case it was neatly stacked boxes. This guy just had his stuff dumped so i can imagine how much care people had to respect the stuff.
That is HORRIBLE. This man was paying his bills, being a father to his daughter, a great example of what a man should be, taking care of his own, they did this to him. This is heinous and offensive on so many levels. The violation, the disrespect, the trauma to a child. Then on top of that the attempt to frame him and criminalize him with false allegations to absolve themselves of the problem they created. They had no issue taking payments from his account, so they knew he was paying the bill, yet tried to weasel out of any responsibility immediately by trying to evict him in a short period, thereby not giving him any time to respond and trying to overwhelm him with other issues. If he has a decent lawyer he will win. It's just sad that there is zero morality in the way they are treating him regardless of his financial situation, most corporations and businesses, especially in that market, are awful to deal with.
Hope he gets enough money off of them to buy his own place. But the lesson to be learnt is always, always, always put your name on the rental if you are paying a portion of the rent.

They definitely can. When people are evicted from houses their stuff gets put out at the street for trash pickup. Once your residence is terminated, the property owner is not obligated to protect your possessions.

My property manager, who lived and managed here for over 25 years, was suddenly fired/evicted during the pandemic, for no good reason. A “management company” was hired, and things got real sketchy. Finally a tenant, who happened to have a real estate license, and wisdom, found the owners & got them to sit down with the tenants. I guess the owners snapped a whip, cuz now things get fixed, tho not at easily as when we had a live-in manager. “Management Companies” are a RACKET! - I pray this family gets recompense thru a common sense and common good minded judge.

This is kind of a fundamental human flaw and the removal of this flaw starts in childhood. Not every human has this flaw but the majority have it to some degree or another. It basically boils down to not wanting to deal with the mess we sometimes cause when we're wrong about stuff. We're not perfect and make mistakes. Sometimes those mistakes have serious consequences for others and in those cases we have to do our best to make them even or at least work towards it in cases where that isn't possible.

Most places have you write down that stuff on the check or have it on file of who lives in what apartment so you can't tell me they didn't know... they knew they were just so greedy they took his money and ONLY evicted him when he called them out for illegally dumping his stuff in a filthy dumpster and making him and his daughter effectively have to rebuy 10's of thousands of dollars of clothes, food, furniture, school stuff, etc...... no way they had 0 idea about the subletting my guy
He was using money orders, not personal checks, to pay the rent. Examples shown in the video are not checks those are money orders. Most people today don't even know what personal checks look like or how to fill them out. I hope the man and his daughter win a good amount of money for their time, possessions and the violation of their privacy and daily life.
There is no excuse for this. To throw out his stuff and then after they realized they screwed up then tried to get stuff back from the dumpster is disgusting. A full apartment should have been a clue that it may have been the wrong apartment. They better open their checkbooks because they need to buy them new furniture and everything else they lost.

Playing devil's advocate here, but even if he wasn't there legally, he was still residing there and they would have to go to court to get him legally evicted. So the fact that they illegally entered his apartment and through away his stuff means that they are responsible for making him whole again. They don't have a legal leg to stand on, and claiming that they can't or won't reimburse him isn't true. They can and will, even if a court has to force them to do so.
The private landlords are just as evil, all of them are just hoarding wealth and price gouging the entire market. Greed greed greed all the way down. And because they took up the landlord game for the sake of passive income, they really aren’t earning anything.
They ought to pay for everything they threw out, then pay 10x on top of that for anything that was irreplaceable or of sentimental value to HIM or HIS KID. THEN pay emotional damage, and probably therapy for both of them because who would feel safe in their own home after that?! It was rented to his ex-girlfriend, who in turn rented it out to this guy while still under her name. That's called subletting and it's a breech of contract. Regardless of the sublet situation, they cannot illegally confiscate and destroy or distribute this man’s property. What a horrible predicament. I hope he can recover and find a space to live comfortably with his child.

Exactly!! Their excuse that he was an unauthorized tenant is completely invalid. Even though that may be true, he is STILL entitled to a proper eviction process, not just having his belongings illegally removed with zero notice. The management company is completely in the wrong here and it's disgusting that they're trying to claim he has no right to reimbursement.
@@meowJACK The question is how did they get the keys to his apartment? Why would anyone give their home key to someone else? It means that others will be able to enter and steal things easily. Even if it is the landlord, if teh landlord falls into some financial trouble, it is possible that he may resort to stealing his tenants' goods
I hope he wins this lawsuit and they have to pay him 10X what they threw away. I would never rent a unit in ANY property owned/managed by this company! In addition to their financial losses, he and his daughter suffered emotional trauma from what happened. How they sleep at night after doing this to someone, is beyond me.

It was not a mistake that they threw the property into the trash. Has they acted with any decency, they should have packed away the property of the person being evicted. Property management is slimey and grimey.

Something similar happened to a business law professor I had. He had just got married and was living in an apartment with his wife and they rented a garage to keep stuff in. They went on vacation and when they came back the garage was empty. The complex had hired a guy to clean out a different garage but they made a mistake and got the wrong garage and threw away everything including medals and other service connected stuff from the Marines.
This is absolutely outrageous. This man paid every month and when they made a mistake all he got was an "Oops we're sorry". Then they wanted to call child's play money counterfeit. They need to own up and take responsibility for what they did and pay this man for his belongings they destroyed. The management team is heartless. I hope others people living there see this and move out causing them to lose money.
If they want to claim he illegally Sublette all that time, then they illegally took his rent payments with his name, establishing tenancy. I was told that if a person is late on the rent, for example, I have the option to evict, but not if I accept the payment late. By accepting it outside of the lease contract, I have established a new relationship with them as a tenant on a month by month basis. As long as I keep accepting payments, I keep agreeing to that relationship. They saw the checks were in his name, not hers and they should have brought up the issue the first time the payment source changed.
@@Metqa the "unauthorized Sublet" thing is Obviously thinly-veiled retaliation against the man for Pursuing recompense over what was a clearly Illegal eviction. The Judge ought to be able to provide a restraining order to the owner against proceeding with the new eviction until the original case is settled. Although it Does mean they may have a legal claim against the Ex-girlfriend for unauthorized subletting and be able to evict him eventually, They Should not be allowed to do so in a short timeframe as retaliation for a legal claim made against them - Or it just further exacerbates the damages from the first Illegal Eviction On top of all the property damages.

I know what is going on, The attorney said to do this knowing that the individual is going to litigation now the attorney can make money from the property manager company and end up making a settlement with Johnny.... If I was the property management I would work something out with Johnny without litigation.... The property management attorney knows how to make money its billable hours for the attorney and believe me the attorney is going to take this time.... I seen this so many times working for law firms.... Sometimes attorneys would joke about it....
I feel this young man's pain. Regardless of him living there, illegal or not, they have no right to go in their apartment and throw out their stuff. He deserves the lawsuit money that's coming to him. Good luck to this man and daughter.
It's funny how they didn't care that it was his name on the checks every month... Until there's a problem. All they've done is add his legal fees to whatever they owe for his property. Because regardless of his status as a tenent, he was not a squatter. And they had not served him an eviction notice at the time his property was illegally destroyed. I'm unsure about Texas law, but where I live, the apartment must give 24 hours notice for entry in non emergency situations. If Texas has a similar law, the apartment complex also broke that law in addition to destruction of property.
@@jdmichalto add: I don’t know about Texas law, but the landlord waives the right to remedy if they take a payment while knowing that there’s a lease violation in Florida. 8+ months of checks coming from somebody not on the lease is going to make any judge think really hard about whether this is a non-issue and twist the knife into the management company.
Strictly speaking from a legal standpoint. Although I agree w/ you, he is not on the lease, so he is there illegally. The rules are in place for a reason. I agree, they need to reimburse this gentleman, but alas, he is not on the rental agreement, thus breaking the law. Do things the right & honest way and problems like this will not arise.

The moment they cash that first check with his name they don't have a case in my opinion. This is just a clear case we made a mistake but we're throwing it all on the victim to save our own asses. My heart goes out to the little girl. Having your home dumped out and all your toys and things thrown away is so so traumatic for a child. I hope she and her father can heal from this trauma.

People wonder why NY and CA tenant laws went too far. They had to deal with this kind of abuse. As governments always do, they OVER reacted, but you can see why. Landlords abusing tenants can be as bad as tenants ripping off landlords.
I’ve worked in property management for 5 years and what the management is saying is true in the sense that we cannot discuss lease material with non-residents. However, it is also illegal to enter someone’s homes without a proper eviction through the court. They were 100% wrong and tried to use that sliver of truth to protect themselves.
Yet they were taking his money and never asked for or required the lease holder to be the one who brings the payment.. The ex girlfriend wasn't the one who went to the leasing office to pay the rent each month he did. The leasing agent on the video is absolutely abhorrent. She's trying to ignore what they did and use this as an excuse but notice the level of apology doesn't match the level of nastiness that she's exhibiting on the video. They had no warrant and no legal right to enter the unit. Even when a marshal shows up to complete an eviction the leasing manager should always pull the lease agreement to make sure it matches what's on the warrant from the court so as to prevent these types things from happening. I realize that when they are dealing with minorities and low income residents they are given carteblanc to operate in such dispecable manner. I would not have accepted anything from the trash. I'm only glad he was able to get pictures that he can use as evidence in his case. How do we know some of those same workers didn't steal what they want first from his things before putting the remaining items outside? Prayerfully he's able to purchase his own house cash when this case settles and begin to build wealth for himself and his daughter and so that they won't ever be put through this traumatic, disrespectful and humiliating experience ever again
It is not illegal to enter someone's home with or without a court order. That doesn't matter for entry. I have the full right to enter whenever I want if I place it there like that. If I want to give you 24 hour notice. I can and will, if I choose. What I don't have the right to do. Is remove all your stuff, without any notice at all and a court order with cops present.
This is definitely unacceptable regardless of whose name is on the lease. It could have been someone visiting and this occurred. Wrong apt is a liability of the complex. They're not taking responsibility for his properties which they should. Surely, accountability of the apartment need to be addressed. Sorry this has happened to this young man & his daughter. This wrong need to be made right. Compensation to be given to the young man.
This is beyond ridiculous. The management and owners of this property should be sued into oblivion, this is completely unacceptable. A message needs to be sent out to this type of business operating in the area.

Nah they need to pay him back all that was lost. That “mistake” was clearly on their behalf. Absolutely unjust and unacceptable behavior. As the rent was paid in full to them and the sublettor didn't gain anything there was no harm. They could have evicted him but that's about it. Going in and removing all his stuff? without notice? That's just straight up theft and property damage. This will be settled the moment a judge actually sees it.

If he was subletting without their knowledge, I think management would still have to follow the law providing him with the legal notifications. They cannot just appear and remove his belongings. Renters and squatters have rights. Plus, they are admitting guilt by trying to retrieve his belongings.
The fact that they do this and then find a way to justify kicking him out anyway is insane, but also a big thank you to that property management company for also doing a bit of libel and slander just to make that lawsuit that much more lucrative.
Sadly libel and slander wouldn’t be valid here as it has to cause some form of monetary damages which this wouldn’t. He should however be able to sue for way more than what his stuff was worth. More importantly it also damages the leasing companies reputation and in a world where these stories spread like wildfires that can serious kill their business

Especially of rent was paid in full, they cannot legally give him a 24hr eviction notice without proper reason. His ex being on the lease is not a proper reason since they still took payment from him for months prior. What they did seems like targeted wrongful eviction after wrongful destruction of property.
I had an apartment complex sue me for living in their apartment without being on the lease. The judge took one look at the case and said that because they took money from me, that was, in fact, a contract. I hope he sues them for a crazy amount of money.
A WHITE KAREN runs the rental office. She thinks she can outsmart everyone cause she has been doing this for over 20-25 years. It costs them nothing because they have 3 lawyers ON STAFF. They are just a Real Estate management firm; not the owners of the building; and they have a very limited shell company setup, to minimize liability if they are sued.
A criminal act being downplayed, without any accountability is what this boils down to. I would be livid if this happened to me. My personal space being violated and my belongings being thrown out? I would be outraged as well as hurt. Some things you just can't get back. I would sue the hell out of the guilty party. SMDH.
@@Algebruh2407. It's not a tort action by any means. A tort action is a class action lawsuit where lots of people sue a corporation. Think about the ads you see for mesothelioma, Camp Lejeune contaminated water, the Roundup weed killer causing cancer, etc. In this instance he does not have any case against the property manager as he was illegally living there despite not being on the lease which was a requirement. He also claims he was sub letting from his ex gf who had the original lease and then moved out of state despite sub leases not being permitted. It sucks for him but there is nothing he can do.

By law, a tort is just an act or omission that gives rise to injury or harm to another and amounts to a civil wrong for which courts impose liability (In basic terms, a civil wronging). Class action lawsuits aren't torts, they are just a form of lawsuits where a group can sue for damages under tort law, usually when the cases are all similar and people don't have enough money to all file lawsuits.

Management took an action on the wrong unit and after finding out the occupant was not on the lease they felt unaccountable for their mistake. As long as they were being paid thousands of dollars monthly for rent they could have cared less about the occupant's status in the apartment. Sadly, management wants to be justified in their error with no repercussions...
This is outrageous, I hope they have to pay him and OBSCENE amount of money! Not only are they incompetent for going to the wrong apartment, they're also completely immoral for trying to find a loophole so they wouldn't be held accountable.
That loophole won't hold up. He has been paying rent under his own name since the girlfriend moved out, and they have been cashing those checks. That means they knew he was staying there, subletting or no. If he has a lawyer even half awake he can clean up.
Hes got partial responsibility here too. He f d up when he didn't get on the lease the day he started living there. Because of that, he's got no ground to stand on unfortunately. People need to know when to take an “L.” After they did that to him, they refused to man-up and say they were wrong and compensate him. Instead they were trying to find every reason in the book to justify what they did to him and his child. No integrity.
