The former Barcelona and Brazil footballer Dani Alves has been sentenced to four years and six months in prison for the rape of a 23-year-old woman in a Barcelona nightclub in December 2022.

The 40-year-old was ordered to pay €9,000 (£7,700) for physical damage to the victim and offered to pay compensation of €150,000, which the court considered an attenuating circumstance when passing sentence. He will be under legal supervision for a further five years as well as having a restraining order banning him from contact with the victim for nine years and six months.

His lawyer seems proud that it’s “only 4.5 years and not 9 or 12”. If your client is innocent, don’t talk about the length. Especially, if you appeal, they may cross-appeal and request a longer sentence.

Actually that provisional 4.5 years sentence is what is now allowing Alves getting out of prison while he waits for his appeals being resolved. He had done a quarter of that sentence so the law gives him the option of asking for provisional release. Had it been 9 years he wouldn't be out of prison in this very moment. Also 4.5 years is a moral win that is easier to overturn into an acquittal than an original 12 year sentence (even though I know for a fact that they're not going to acquit him due to extra-judicial reasons that have been present from the very moment this whole thing started).

@@Juicerock12 9k is joke money. It should have been at least 50k. Bit it was reduced from 9 to 4.5 years because he paid compensation of 9k. But 9k is grossly inadequate relative to the gravity of the crime. Not nearly enough. 9k doesn't go far in Europe

you may not know but Alves is going to go home from next May, having to go to prison only to sleep, from Monday to Friday. Weekends free. It happens that he was in preventive prison for one year, so he will be out of jail in 4 months. BTW he paid 100K (not 10k) to reduce sentence to half. If you have money you can do this in Spain.

Just one correction: the money he gave before the trial doesn't technically reduce the time he has to serve into just half of it. It "only" reduced the sentence in two years. Had he had a potential sentence of up to 10 years, for instance, it would've been reduced to 8 because of that "reparation payment", as it acts as a mitigating factor.

@@dexterwestin3747 Civil suits are not judge under the "beyond a reasonable doubt" standard, that's why you'll see so many civil suits been won even though they lost the previous criminal case (like in the OJ Simpson one). In this case, after reading the 61-page sentence (I'm Spanish and it is publicly available) I'm positive that there's plenty of reasonable doubt here, starting with the fact that her account can't be taken as reliable the very moment the tribunal admits that what is seen in the CCTV footage prior to the toilet situation has nothing to do what she decribes (she painted it as if she was disgusted by him from the moment he is introduced to he and, somehow, she even was in fear of him... but the footage shows her being quite flirtatious with him before both agreeing to meet in the toilet). This case woul've ended in an acquital in the US.

@@georgezee5173 Yes, there would be a decent chance he would be acquitted but now the accusers are going the civil route (if the man is wealthy enough) to reach a settlement or they will come to an out of court agreement and then still go after the man like that woman in Las Vegas and CR7.

@@dexterwestin3747 I totally despise the fact that they would allow to use a civil court to judge a criminal case, because in doing so you're actually bypassing the actual judicial channels to get an easy "guilty" sentence (which is not actually "guilty", since civil suits don't decide about guilt, but 95% of the population can't tell the difference). In my country, in these casesm they would only allow you to go the civil route once the other person has been criminally charged.

The issue is that a lot of women lie to get what they want, especially when someone rich is involved. I think we should at least wait for the outcome of the appeal before we judge Dani Alves. Miscarriages of justice are not uncommon.
