[DASHCAM] Police Caught Red-handed Making Bogus Traffic Stop

We expect police officers to pull people over for speeding or running a red light. But for driving a red Mustang? That’s what happened to Mario Rosales in June 2022.

Mario and his girlfriend, Gracie, had just gotten off work for the day. They weren’t doing anything suspicious, and Mario was following the traffic laws. He turned on his left turn signal as he stopped at a red light. A police vehicle stopped behind him. When the light turned green, Mario turned. The police vehicle followed and immediately pulled Mario over.
Mario was confused about why the police had pulled him over. Were they looking for someone else and mistook him for that person? No. The officers were simply fishing for crimes.
Over the next 20 minutes, two police officers searched Mario and interrogated him and his girlfriend-not just about where they live and work, but also about a litany of drugs, past interactions with police, and their feelings about the U.S. Constitution. All without a single reason to believe Mario or Gracie were dangerous or involved in drugs or that either committed any crime whatsoever. They weren’t; they aren’t; and they hadn’t. When Mario and Gracie asked why they had been pulled over, the officers answered that Mario failed to use his turn signal. But multiple recordings of the incident clearly show that Mario used his blinker. When asked why they were questioning Mario and Gracie about drugs, the officers’ answer was they were “just curious.”
The Constitution protects against this stop-first-justify-later form of policing. Police can’t just detain you to ask you questions, regardless of how curious they might be. That is why Mario and Gracie have sued the police officers and the city of Alexandria-to enforce the constitutional boundaries that are supposed to protect motorists from bogus traffic stops that that turn into free-for-all fishing expeditions for crimes.

They should be in jail. They clearly and illegally pulled this man over on a lie to fish for other charges, that should be treated as a kidnapping and they then held the man under threat of death. We need to be honest about police interactions, anytime the cops do anything to you, it is under threat of death. If he had refused to stop for the illegal detainment or resisted the illegal detainment once stopped, the cops would have tried to kill him if he would have been charged if he killed the cops. Because of these facts, we have to actuality make serious examples out of these cops when they break the law.l or else we don’t have the rights we pretend they are violations, they are just stealing our money and giving us some of it back to stop complaining about it.

There's a video showing a female officer who had the option of writing a female driver a ticket or taking her to jail. The officer was fired because she decided to arrest the driver based on a _"heads or tails"_ coin toss. Because the officer showed no regard to the fact that she was running someone's life, all charges against the driver were dropped.

Cops have more freedom to abuse their power. Innocent civilians have no power to keep their freedom. I couldn't imagine going about my day, getting pulled over for no reason, and then having that dreaded feeling I'm going to jail. Civil rights are supposed to protect the innocent from this happening. It may not be 100% all the time, but it sure shouldn't allow cops to arrest someone with no evidence of a crime.

Once a cop lies about something so obviously caught on his own camera, how can he ever be trusted? Why does he get to keep working with the public and keep his job? Every past and future event he's involved in suspect. Now, he's a proven liar and is a liability to his department and to the taxpayers who will have to pay settlements to his victims over and over.

Everyone should have a dashcam that logs speed and direction of travel, and every time someone is pulled over, they should also start recording on their cell phone, as should every passenger in the vehicle. If possible, have your phones set up to automatically upload footage to a cloud storage location, so when the cops decide to take your phone and destroy it, you still have the record. When they decide to go full tyrant and abuse you and/or disregard your rights, tell them you don't consent to any of their actions, but don't try to argue with them or fight them. Let them dig their own graves, and after you're released from custody, immediately hire a civil rights attorney and sue the shit out of the town, county, state, and, if you can get the tyrant's qualified immunity stripped, the individual officer(s). The place to fight the bastards isn't on the side of the road; it's in court.

@@LesserMoffHootkins We can't tell from the video shown. Louisiana law requires drivers to signal continuously for 100' prior to a turn. There is no indication if the victim in this video turned his signal on while sitting at the intersection or prior to the 100' minimum. But that's largely irrelevant, because the intent of turn signal laws is to prevent drivers making unannounced, i.e. _UNSAFE_ turns. After coming to a complete stop in a lane with a protected left, with no traffic waiting to go in the opposite direction (from across the intersection), and clearly signaling well before beginning to negotiate the turn, the driver absolutely met the intent of the law in this situation. If the driver decided to fight the ticket, most reasonable judges would throw it out because nothing about the turn was unsafe. A full-blown asshole might not throw it out if the swine's dashcam footage clearly showed that the driver didn't signal at least 100' before the intersection.

It was disgusting what the cops did,but Mario is a pushover,made the corrupt cops job of ticketing him so easy, people need to educate themselves so this cannot happen, plus growing a pair, because everytime someone like Mario rolls over ,the cops expect everyone to do the same and get very offended and belligerent when that doesn't happen,so the more people that stand up to this behaviour,the less of it we will see.

@@chriswilson3009 I get what you're saying, I really do...but cops have been known to shoot people when they decide to stick up for themselves. I don't think he "needs to grow a pair" I think people who see him as a pushover need to be a bit more understanding of WHY he was compliant. Did you see when he reached in his pockets to empty them how he hesitated? I feel for him in that situation, feeling like your rights are being violated and there's absolutely nothing you can do about it.

I heard of a town in Ohio that gave so many tickets for dirty tail lights, the state finally took away the town's incorporation, so they could no longer have a police dept. That should happen a LOT more in EVERY State!!!

@@averagejoe396 The Fed can't 'unincorporate' States. When some tried to voluntarily leave, the Fed started a War to force them to stay. But in other ways, the Fed tries to coerce States into doing wha the Fed wants. At the same time States were forced to remain in a 'voluntary' Union, States lost a Lot of power and Rights the Founding Fathers had delegated to States. The Fed gained a Lot of power and ever since has gained more and more. People should go go to council meetings and communicate with their representatives. But few bother to keep up with what goes on. Sad. The tiny town in OH was near a large city and had a highway going through it. Most of the tickets were geven to people who lived outside the small town. Often in these instances, city councils and city attorneys are in on the ticket schemes. Brookside, AL has a tow company involved. Brookside is an example of a town that should be unincorporated. Something I wish more people would catch on to is corrupt police unions. Police unions should be disbanded as they exist today. They empower officers through their careers to think they can do whatever they want. Police unions are very powerful and most of the time operate under the radar. If there is strong reform within the structure of police departments regarding the unions, change will be visible.

We already have legislation to prevent this type of abuse. Problem is, as stupid as police are, the general public is way more stupid. Police are taught to manipulate people into cooperating. "Well, if you don't have anything to hide" "do you mind if we?" "Well it's for our safety, we really don't want to do this, but can we?" Etc, are just tools to get you to give in and say yes. If everyone in the United States just handed over their identification, then answered every single question with "I'm invoking my 5th and 6th amendments, I do not wish to speak with you or answer any questions without an attorney present" traffic stops like these wouldn't last 20 minutes. Then the illegitimate turn signal charge would be thrown out. Instead, they found more stuff because he felt like explaining himself constantly.

Happened to me in ‘05. Pulled over outside my house, after returning a video rental. I saw them at the light when I pulled into the store. When I left, they were nowhere to be seen. Drove 3 blocks, turned left, cherries. Said they’d been following me with lights flashing since I left the store. Detained me. Called in backup. Called in the dog. Asked to search/searched. Separated my brother and I to talk one on one. Found nothing. Someone reported me for being a drug dealer out of my car. They had no proof, but I was guilty until they were satisfied. Told me I could go, but I just stood there at my car, and they started asking why I wasn’t leaving. Cause I was in my driveway. 🤦‍♂️

@@karinaz8756 It didn’t end and I should have sued. I didn’t realize until later that I had a really good case. They claimed I had stolen tools (all mine are marked with my DL# and phone #), claimed my firearms were suspicious (in Texas....), said my shooting range bag was an “active shooter kit”, threaded 26 times to arrest me for unlawful carry of a firearm which I wasn’t carrying, threatened to bust out my window to get my “active shooter bag” and so on. I’ve learned a lot since then.

If you don’t engage, everything gets shuts down. Even if they pull you out of the car , you sit in that uncomfortable silence until they let you go. If they want to escalate to get a reaction , decide if you want to take the hit . A false arrest is a slam dunk lawsuit.

We used information obtained from th Institute of Justice to help defend out neighborhood from eminent domain. The said they could not take our case because no Federal money was involved. We still have our neighborhood, but it seems like others still want it.

A couple of points I noticed: 1. Alexandria dropped the charges, but only *after* Mario got the police video - which the prosecutors must have already had. 2. The video plainly shows the police car 'failing to stay in lane' as it follows Mario through the left turn. Is anybody getting a citation for this? Didn't think so.

Merely dropping the charges is a joke. The police here should, at the very minimum, be responsible to pay fines to their victims and make a formal written apology. The officers involved, AT MINIMUM, should be placed on unpaid admin leave and forced to attend classes on the constitution. Then put on probation just like a criminal would be.

@@rickb1387 Fully agree with you Rick, after blatantly abusing the citizen's rights the officers should be punished for AT MINIMUM an equal amount of time without pay that the citizen suffers until the charges he/she is victimized by are dropped. It should be noted that by ticketing Mario for failing to use his turn signal, they filed a false police report, which itself is a crime for which the police officers should be prosecuted. (Not merely a civil violation.) Not only that, it's a crime of moral turpitude and dishonesty, which means the cops are not fit for police work, which means they should be fired.

@@Milesco agreed. They sign a sworn affidavit on the ticket that they observed what they put in that report. That should be grounds for suspension or dismissal. Getting an observation wrong is one thing....for instance bright sunlight obscured the flasher...but the camera proves there was no mitigating circumstances to observation of the very clear signal.

Of course they did! They fear a jury. Charges will always be dropped, or attempts made to settle out of court, when you push for a trial because they FEAR a jury. A jury verdict indemnifies the system to respond and change, when you settle nothing happens and the status quo is kept so they can continue business as usual.

It's truly frightening the change our police have made over the last 30yrs! That whole 9-11 and militarized police force after that is war against us the people! Officers in the US kill over 1000 people each and every year. Is that abuse of the badge? Well obviously but the training don't help as they are trained to shoot for center mass until the threat is neutralized but evidently thats not always the case either as recently Sheriff Grady Judd says after the suspect shot a swat team member we unloaded on him and when he stopped shooting we didn't. I'm not saying the suspect was right but should we really be shooting for center mass when rarely does someone survive that? Should shots continue after the suspect is down and no longer shooting? I'm afraid one day it maybe my family member or yours who is executed in the streets no judge or jury! Something needs to be done we can learn a lot from other countries police such as the UK.

Key would be to request the body cam, but NOT submit it as evidence. Get the cop on the stand, and ASK him, "Did you witness me fail to use my turn signal?" When the cop says YES, whip out the dashcam as REBUTTAL evidence, and DEMAND that the judge hold him in contempt, or charge him with perjury.

Cops have been coached by attorneys and prosecutors for decades to answer any damning yes/no questions with "I do not recall", because there is no way to prove someone's memory is functioning properly or faulty when it is the other. There is also no law that makes a faulty memory criminal. You will rarely ever see a cop truthfully answer a yes/no question with a yes/no answer. They are prepped for rebuttal evidence in that regard. Even if they say "I do not recall" and you whip out the video, it doesn't constitute perjury because "not remembering" is not the same as "lying". I mean, good advice, but they've already been prepared for such situations.

I'm sure a middle ground would help. No need for over 1000 people to be executed each and every yr by US police! Obviously that's a tad excessive simply because they can kill with no need to worry. It's not just the officers it's the training primarily since they train them nowadays to shoot for center mass (slim chance of survival) until the threat is neutralized (executed).

If you’re legally detained AND the cops fear for their safety, they can legally do a Terry stop pat down. I think this video did not explain it thoroughly. Of course the cops abuse this and pat you down while searching for something else regardless if they really do fear for their safety.

Real criminals are dangerous to deal with, this poor guy was no threat and an easy target for their extortion. LEO delay engagement when there is a real threat/violence (see Uvalde, TX, they stood around for an hour waiting to engage.) Traffic stops, jaywalkers, men with cameras in city hall…they show up 5-10 strong within minutes, and immediately engage. With hero’s like that who needs enemies?

I think every newly licensed attorney should have to do a few years of pro-bono/low pay work like this or as a public defender. Gives experience to the attorney as well as cheap/free service to those in need. Also, any recent law graduate not able to find a job could take on the smaller/easier civil rights violation cases and work on contingency. There are many $50,000 winnable cases out there. Split 40/60 and that's $20k per win. A boatload of 1st amendment auditors need this and could keep these lawyers in business.

For one thing, you're up against a government agency that has unlimited resources to fight you. For another, you have a court system that works side-by-side with cops every day. You have pro-law-enforcement and pro-government judges who are chomping at the bit to rule in favor of the police and throw out your lawsuit. Most of these judges are former prosecutors. And worst of all, you're up against court-invented legal doctrines and roadblocks that make it almost impossible to win a case against the police -- most notably "Qualified Immunity", which insulates the police from civil liability for constitutional violations -- even blatantly obvious ones -- unless an appellate court has *_previously_* found the specific actions of the police officer to violate the Constitution in a substantially identical prior case. Since every case is unique, this makes it almost impossible to win a lawsuit against the police, even when what the cops did was clearly illegal. This is a good opportunity for me to ask you and anyone else reading this to contact their elected representatives, both state and federal, and tell them to *abolish Qualified Immunity.* It's an unfair and unjust doctrine, invented by the courts (talk about judicial activism!), that deprives victims of police abuse from getting the compensation they deserve, and eliminates accountability for bad cops and bad police departments.

In my forties (I"m an old dude now) I bought a red Mustang, same as this driver. Pulled over regularly by mostly bored cops. This was a time when there were no smart phones to record. Stopped many a time, lengthy delays, cajoled and threatened. Having a clean record seemed to piss Police off, maybe it was the car?, no matter, I lost all respect for Police after innumerable stops and their ego driven attitude. Many times an officer would try to escalate the situation. I never took the bait by remaining calm. Best advice I'd say, is to record EVERY interaction with Police and shut up. Stay safe.

This happened to me in Goodyear AZ, they pulled me over for no license plate light, when I asked if I could see it since I just replaced it that day, the officer said nope can’t let you do that, 3 more cars showed up, I’m guessing the next officer was a supervisor, he came up to the window and said I’m good to go. Never, NEVER, give the police permission to search your vehicle. It's not that they won't do it anyway but don't give them permission. I once had a hitchhiker (yes this was many years ago) drop a bag of marijuana in my car. I never knew it until a friend of mine was getting it the car a saw it. I'm sure if the police would have found it I would have gone to jail. So just because you don't think there's any contraband in your car doesn't mean it might not be there. As far as this video goes it baffles me that the cops could be so stupid. Keep the good stuff coming folks.

The masses are still blind due to the indoctrination we go through during childhood. Schools and parents telling kids that cops are the good guys and just to comply with whatever they’re told to do. Competitive policing has to go! These guys want to write as many citations as they can every day to pump up their chance for promotions and probably just to make their day at work more interesting. I'm sure they will get a nice little slap on the hand and a wink from the supervisor.

I don't drive much anymore. When I was a truck driver, we were hassled by DOT police constantly. Now if I see a cop way back behind me, I find a store or some place I need to go to do some business, if at all possible. Or just make a number of turns before they have a chance to get close. Don't want to be anywhere near them. Can't trust them at all!!!!

The Civil Rights Lawyer channel sent me here. Everyone needs to take the time to file lawsuits for this to end, but many lawyers need to work pro bono on some of these slam-dunk cases, because regular people will be dissuaded from pursuing litigation when they are asked tp pay a hefty retainer for the lawyer to begin work.
