Megyn did not fact-check Rubin's racism, she just fact-checked him on who is assigned to the various courts. Megyn is equally as racist as Rubin. Also Megyn is equally as ignorant about the Middle East, Africa, Asia, South America, Haiti, as Rubin.
The left had the same racial view of that court. They just cheered at the initial story because it fits in with their politics whereas it doesn't for Dave. That's the only difference in this case.

I'm remembering that one white lesbian couple that accidently got a black guy's sperm and then didn't want the baby after having carried it to term because it wasn't white. Yeah, 100%, gay people can be racist (just as non-white people can be homophobic of course) and when they insist that the black struggle is the same as their struggle, what they don't understand is that they can at least be in a closet and still enjoy white privilege. A black person, gay or otherwise, can't do that. You can't "hide the black". Some (usually white) progressives like to draw 1 to 1 comparisons on gay versus race struggles and it's offputting. It's a bit like white feminists telling other races of women to unite with them against male chauvinism but they downplay race issues. All bigotry and discrimination should be opposed but it's not all the same and those differences matter in a society that still has various hierarchies.

Ignoring the fact that what he said is factually wrong and the court he mentioned isn’t exclusively made up of only Black women. What exactly is his issue with a court that hypothetically was made of exclusively Black women? I’ll bet you could find a southern city with a population that was 70% African-American that magically had a court exclusively stocked with white jurists. What would ol’ Dave’s objection be in that example?
His issue is the same reason the left led with this story and touted it as a victory for their side. Demographics give pre-judgment info. The court, if they have 5 black women, are more likely to be staunch Democrats and not Republicans. This is why the left celebrated it and then when it came out it was not true, they just backed away and now this stupid video plays Dave Rubin as a racist, but so too would every leftist who first celebrated the fake news (including these 2)... just because they're on the opposite side of an issue doesn't mean their take isn't playing on the same prejudicial info. Whites were 85% of the NY state population back then so having all 5 be white would be statistically a 44% chance even with nonracist employers, VERSUS today black females make up only 6% of the workforce in New York, so having FIVE black females judges is statistically a near impossibility without conscious racist selection: 0.06 x 0.06 x 0.06 x 0.06 x 0.06 = 0.0000007776, literally less than a 1 in a million chance non-racist employers would pick 5 in a row. Whereas even today, the chance a non-racist employer would hire 5 white judges would be 0.75 x 0.75 x 0.75 x 0.75 x 0.75 which equals 0.31, so there's a 31% chance that an impartial, unbiased employer would hire 5 whites in a row even today vs. a 1 in a million chance of only black females. Keep in mind this is disregarding the huge asian male, asian female, hispanic male, hispanic female populations as well, there are far more of them in the legal profession as well.

The NY Supreme Court has over 100 judges, but appeals don’t go to just the “supreme court”, they go to the appellate division, which has a number of judicial departments. I understand that this appeal will go to the first division which has like 20 judges. It’s so annoying hearing idiots talk BS without asking someone who knows something to explain things to them.
No, he'd assume that five Jews or five white guys definitely got the jobs based entirely on merit. But I suspect he's basing his impossibility "calculation" on blacks making up 13% of the overall population (and black women would presumably make up slightly more than half of that of number). That definitely means it's unusual (but not impossible, obviously) for all five supreme court judges to be black women but if whites make up 60% of the population (and slightly more than half of that number is made up of white women), then on average and all things being equal that supreme court shouldn't be comprised of five white guys either, and yet we know Dave wouldn't have any issue with that in the slightest.

There is one black woman on the New York Court of Appeals, the highest court in NY. The chief judge is an African-American man. There are three other women: one is Latina and the other two are white. And the remaining two judges are a Latino and a white man.

He's not a journalist. Some media outlets, however, reported this which is why he repeated it. Also for these 2 to pretend like they didn't have the opposite take of Rubin, to cheer for this potential court because of their demographic, is so disingenuous. They prejudged the court and what they'd potentially rule in the case the same as Rubin did. The reason it's "virtually impossible" to overturn Trump's conviction is because the vast majority of appeals don't work, regardless of the demographics of the court.

As a former affirmative action officer in higher education, as far as hiring and the false notion that it's quotas, that's so wrong. Search Committees are formed -they hire the best qualified applicant without regard to race or sex or gender, how do they look on paper & how do they interview? Can they do the job that they are applying for? I'm so sick of all the misinformation around hiring. Especially in affirmative action. It's been working correctly for a long time unless there are bad actors, of which there are some. Those are the racists. I weeded them out, and there were some in HR but I said goodbye!

What the hell is judicial thinking? Judges are actually supposed to apply the law and so all judges should be on the same page there especially if there’s plenty of evidence the only place a judge’s discretion comes applies is in sentencing but there’s still guidelines for this.
