In this episode of Critical Mas(s), Massad Ayoob discusses the three legs that hold up the table that defines the set of circumstances in which the use of deadly force in self-defense is legally justifiable in court.

One of the most well-known and high-profile cases involving the use of deadly force in a self-defense shooting is State of Florida vs. George Zimmerman in the death of Treyvon Martin. Mas discusses the legal facts of the Zimmerman case that were examined and ultimately resulted in Zimmerman's acquittal, and apply to cases of lethal force in self-defense writ large.
The following factors are considered any time there is a shooting or application of other forms of deadly force in self-defense against an immediate, otherwise unavoidable danger of death or great bodily harm to yourself or somebody you have the right to protect: ABILITY, OPPORTUNITY, and JEOPARDY. Force of numbers, disparities in physical size, strength, or the presence of a weapon are a few examples of Ability. Opportunity to employ their intent to cause harm (within certain distances, whether there are obstacles, etc) must be present, and Jeopardy is their manifested intent, either by words or actions, that your attacker is going to carry out the threat that they pose to you.

Critical Mas(s) with Massad Ayoob is a show that provides expert analysis over a wide range of contemporaneous topics related to civilian and law enforcement self defense, the use of force, and second amendment issues, provided by a renowned and established author with a career spanning decades in training law enforcement officers and the public at large, who is frequently called upon to provide expert witness testimony.
ABOUT MASSAD AYOOB:
Massad Ayoob has been handgun editor of GUNS magazine and law enforcement columnist for AMERICAN HANDGUNNER since the 1970s, and has published thousands of articles in gun magazines, martial arts publications, and law enforcement journals. He is the author of some twenty books on firearms, self-defense, and related topics, including “In the Gravest Extreme” and “Deadly Force,” widely considered to be authoritative texts on the topic of the use of lethal force.
The winner of the Outstanding American Handgunner of the Year Award in 1998, Mas has won several state and regional handgun shooting championships. Ayoob was the first person to earn the title of Five Gun Master in the International Defensive Pistol Association. He is the current President of the Second Amendment Foundation. He served 19 years as chair of the Firearms Committee of the American Society of Law Enforcement Trainers, and several years as a member of the Advisory Board of the International Law Enforcement Educators and Trainers Association. In addition to teaching for those groups, he has also taught
for the International Association of Law Enforcement Firearms Instructors and the International Homicide Investigators seminars.
Mas has received judicial recognition as an expert witness for the courts in weapons and shooting cases since 1979, and served as a fully sworn and empowered, part time police officer for 43 years, mostly at supervisor rank. Ayoob founded the Lethal Force Institute in 1981 and served as its director until 2009, and now trains through Massad Ayoob Group. He has
appeared on CLE-TV delivering continuing legal education for attorneys, through the American Law Institute and American Bar Association, and has been retained to train attorneys to handle deadly force cases through the Armed Citizens Legal Defense Network. Ayoob served for two
years as co-vice chair of the Forensic Evidence Committee of the National Association of Criminal Defense Lawyers. He also appeared in each episode of Personal Defense TV (Sportsman’s Channel).

Hes been in 🚔 & legal use of force training since the 1970s. Ayoob has many articles, DVDs 💿, videos. Hes trained or assisted class training of military, SWAT, US marshals, agents, troopers.

In 1985 I purchased my first handgun (A Taurus PT-92-Still have it). Shortly thereafter a good friend of mine gave me a small paperback book about the general ideas and theories regarding self-defense and lethal force. I still have that book and have re-read it several times over the years. (Along with purchasing several copies for gifts to friends.) That book is "In The Gravest Extreme" by Massad Ayoob. I can think of nothing else that has had a greater impact on my outlook as to defending myself and others. While I am absolutely opposed to any form of gun control, I could agree to that being mandatory reading prior to anyone purchasing their first firearm!

In the Gravest Extreme was originally published in 1980. Deadly Force, 2nd Edition: Understanding Your Right to Self-Defense, was published in 2014.

Your means of escaping a deadly situation are much hindered compared to a non disabled person. That is where it is important that justice is blind. What I could escape from maybe you couldn’t and every case needs to be decided on the merits of the individual case.

@Kenneth Wilson Knife attacks are very fast and deadly, but still, if I turn around and run while drawing, my glock 19 loaded with jacketed hollowpoint would completely destroy you. But that's if I'm not in a small room. And you're getting filled with lead even if my throat is gushing blood, you know? It's kind of a suicide attack unless you're REALLY good, or the defender is either poorly trained or just completely caught off guard. No one should have to go through that kind of shit, though

Knife is the easiest weapon to use in close proximity. Alot of people accidentally shoot them selves pulling a gun before shooting a attacker.

I think people are missing something in this equation, the 21 foot rule is if the attacker has a knife that is drawn vs someone who has a gun that is holstered. If your gun is unholstered and the assailants knife is drawn, the person with the handgun has the advantage.

Most people don't understand how fast or deadly any attack can be. A lot of range trained guys like to talk about what they can/can't do with a firearm, the same way academics like to talk about how real/unreal the danger a subject is in, the reality of the situation is unless you're trained to hold off you're attacker while you draw, that pistol on your hip is largely decorative, and if you're the one with the gun you're likely going to be considered the "bad guy" by a vocal majority.

When a man gets in 6 feet of you with a knife ,he now has equal chance to kill you with a knife as you have with a gun to kill him. Deadly force is not shooting him in the leg. You should not own a gun if you say this.

Yet another fantastic video. It really does behoove all of us who carry to realize the tremendous importance of the phrase, "With power comes responsibility." Likewise, something I also say when I'm teaching, is that with knowledge comes responsibility. I spent 22 years in the military, and one thing we were always taught was situational awareness. Quite often, there are visual clues that we can pick up on that indicate bad intentions by others. Not always, of course, but a keen eye can catch things that seem a bit off. At that point, it's best to get out of the situation immediately, if possible. When it's not possible, this triangle that Massad shares with us should be running through our minds if we find ourselves in a situation where we may have to draw our weapon. I honestly hope I never have to draw my weapon on another person, but it's ignorant to think life is a bed of roses with no people around with bad intentions. Be safe. Be observant. Be vigilant. As a former LEO let me add that if the Police persist in demanding a statement simply grab your chest area and tell them you are feeling a tightness and pain and need to go to the hospital NOW and want an ambulance NOW!! No Police Officer who values their job / pension will deny your going to the hospital for a possible heart attack. This buys you time to call or have someone call your attorney (IF you carry you better have an attorneys phone number) and guide you through your statement.

A couple weeks back I was attacked by a drunk. He apparently thought I was someone else and grabbed me by my throat. I lifted him off the ground and then threw him to the ground. I do carry 24/7 but I felt he was done after him hitting the ground. I maintained eye contact while walking away. I did have a second of thought of pulling my 357 magnum and shooting him in the face but I did not want to have a death on my heart. I will use deadly force if no other option is available. I pray he gets help for his alcoholism issues.

Even though you might have been just in return deadly force, you might have been caught up in jail and court systems for years. If deadly force isn’t necessary, like 100% necessary, then don’t use it. Good choice in the end.

I love Massad Ayoob. The man is a wealth of knowledge and is someone that I have learned a tremendous amount from. There are not a lot of other people out there, who have the same, if not more, wisdom, insight and knowledge concerning self defense both with and without a weapon as well as firearms knowledge and firearms instructor skills. He has always done a great job of breaking down both what is and what is not any justification in a deadly force encounter.

I paid less than $200 for a legal protection insurance policy just in case I'm ever in a situation when I may need to defend myself or my loved ones. Why can't everybody insure themselves and spread the cost of defense among ourselves? After all, the chances of any one of us having to use our handguns to defend ourselves is so small, the chance will probably never happen in our lifetimes. So why not purchase an insurance policy that will pay ALL of your legal fees in the unlikely event that you will need this insurance? You won't go broke for a few hundred bucks if you buy insurance for something you should never likely need to use. IMHO of course.

Dahell!? What was the charge? I had someone come in an open door into my foyer, the weather was great and sunny, airing out the house. I said "Hello" as I was getting to my walker. Half a head peeked, it looked like the neighborhood delinquent, I knew he would beat the shit out of me if it got hand to hand. I dialed 911, put it on speaker, stuck it in my shirt pocket, talking to them, pistol in my strong hand, moving slowly toward the foyer/him. Saw him twice more partially, before I heard him bolt. Went and shut the door, and sat down on the couch and reholstered. Bam, bam, bam, I got up and yelled it's unlocked, Deputies came right in two of them, one went around north side, one went around the south side. lol 4 deputies in total. They did ask if I was armed, yes, they asked me to take it off while they scouted the woods and up and down the street. Okay, I had a paddle holster, took the whole thing off. Filed a report stating what I knew and who I thought it was, then they left. Mind you I had spoken with one a few times, which was about the kid I thought it was. Arrest you? Again *_DAHELL?_*

Thank You, Sir. That was an excellent description of what is required to use lethal force. I'm a former Deputy Sheriff in Texas. This is what the general public needs to know. As a young Peace Officer, this realization of the presence of lethal force, in any encounter with a citizen, was the single, most important thought in the back of my mind. Observe, direct, and command, in a criminal contact. I would apologize later, if I seemed rude to anyone whom I found to be, shall I say, in the wrong place at the wrong time. I was sworn to my duty, and took that duty very seriously. Thank You again, Sir.

Don’t know where to start with my praise of what Mr. Massad Ayoob offers. Many people offer great gun critiques and reviews/pointers, but Ayoob stands alone in how a) comprehensively and b) eloquently he summarizes your legal authorization to employ deadly force. I watched the entire Zimmerman trial. Even though he had the defensive elements on his side the outcome could have very easily gone against him.

Excellent assessment of the Zimmerman case, yet I disagree with you on the point preclusion. Zimmerman was given the benefit of preclusion because he was the only person that survived the altercation. Basically the winner dictates the history. There was nothing he said immediately after the shooting that convinced me that he wasn't the agressor. Since the shooting, Zimmerman has done a really good job showing his true character to the world.

Both parties were the aggressor MJ. Essentially both parties actions can be summarised as confronting a person they believed to be a threat. The only real difference is that the physical and witness evidence is that Martin was the first to physically attack, which because it is impossible to know the preceding course of events (as they were not witnessed) means you have to conclude that Martin was the one who instigated the violence regardless of what kind of person you think Zimmerman is. Additionally, Zimmerman has spent years being vilified by half the country and the entire media apparatus. Do you not consider what kind of changes that might have to a person's personality?

@@Isadore First off, advice from a dispatcher is not legally binding. Secondarily it is okay to disobey the law depending on circumstances. It's actually a law that you have to disobey the law if you believe obeying will cause more harm than disobeying. I can't remember the term for it at the moment though.. Possibly it's "Defence via necessity" .

Nothing in my 6 years of firearms training really prepared me for a 1974 gunfight w/three armed robbery suspects (you authored an article in a 2016 edition of American Handgunner). Our training had mostly been bulls eye w/our revolvers, and putting the empty brass in your pocket when reloading. All our range training changed after my experience that night and we began to learn to fight w/a gun, as opposed to get a good bully eye score and move on.That said, if you’re going to get formal training find an instructor that will teach you how to fight w/your gun. Mas Ayoob, or Clint Smith @ Thunder Ranch, come to mind.

@AL It should work fine, as would any service caliber, but your best bet is to find out what the local police carry and get that. One shot stops are a myth, shot placement is what carries the day.

It is a dam shame the law abiding citizen has to resort to buying some insurance policy to try and get you off the hook for a self defense shooting. and as far as these frivilous civil law suits from the families of the deceased who actually was the initiator the judges should throw these right out of court and make the attorneys and family members pay the courts for the waste of time.

14 months ago I was doing laundry before work when I noticed a large man picking on a little lady I moved in to defuse the situation and he began to bully me I tried walking away and he followed me and started touching me he then went after the lady as she exited the establishment yelling at her and hitting her window with his fist and cursing her as she drove away he then came back at me again and I kept telling him to stop and not to come near me but he kept getting closer, drooling, and snarling, with more hate, and anger than i've ever seen before in my life. I stood there, yelling at him to go away, and when he got arms distance from me I punched him three times in his face. the man was twice my size and I was very concerned for not only my own safety, but that of others as well. I let him get up and he called the police I was charged with Mayhem and assault with a deadly weapon I plead not guilty and waited in jail for 5 months.the judge suggested that I not testify on my own behalf so I did as he suggested and did not testify they refused my character witness and used my mother without my permission or consent they instructed my mother not to say anything about the fact I've never been arrested before and that I've been a security guard for the past 7 years I was convicted of assault inflicting great bodily injury and sentenced to two years in State Prison I did 9 months and I just got out on good behavior and I still don't see why they would want to ruin my life over this when I was just trying to help. Im glad that im alive, and everyone is ok i still feel so super violated by the system. It's insane.

I learned in Universal Kempo just how fast someone can cover 15 feet with a knife in their hand. I'm a disabled veteran and my disabilities will no longer allow me to fight. Thus, I must carry. Thanks for this video - if I learned anything, it reemphasized that there's allot more to this than just carrying a gun. Once the lead leaves the barrel you can't take it back. Training is key to staying out of prison for defending yourself.

Succinct, accurate and sensible, even for New Zealand where I live. Here, self defence is a bit harder to prove if you use a gun because the law says that if you are not at the range, then the gun must be locked away, unless it is under your immediate supervision 'within the curtilage of your dwelling'. The police don't like that bit because it gives us the freedom, in fact, to be armed to some extent at home, and even if one's use of a firearm is justified self defence and the court agrees, they will try to prosecute under the storage laws and take your guns and licence. They even tried it in the case of an incident in a gun shop.....that one got thrown out....

There's a recorded 911 call where the operator specifically told Zimmerman to stand down & wait for actual police. On the recording, Zimmerman is heard saying, "these assholes, they always get away." Where've you been? That's OLD REAL news. Look it up. This account is bullshit because it infers that Zimmerman returned to his vehicle and waited for police. If true, that would mean that Martin pulled Zimmerman from the vehicle and the resulting fight & shooting would've occurred near the vehicle. So yeah, this account is utter nonsense and NOT an official account. 🤷🏾‍♂️

@@billycarr1254 Zimmerman broke a few rules that got himself into the mess he was in, but he didn't initiate the fight. He broke simple rules like "Don't be at Stupid Places, with Stupid People, at Stupid Times!" From all the recordings brought to the case, at the end Zimmerman thought he was law inforcement chasing "the bad guy," when he was just supposed to have called 911, just like any private citizen! But, few things that "legally" also somewhat justified him going around the neighborhood (that I don't fully agree with) but it was inside a PRIVATE GATED community. Its like having a backyard. What's the boundary or limit of your yard? Up to the fence! So when you pay HOA fees and live inside a GATED community, that technically in some way becomes your yard. Anything inside the "fence!" On the other hand, Martin instead of just leaving the scene and saying "you know I'll just trespass some other time when 'MALL COP' (Zimmerman) isn't around," he decided to commit a different crime, "Lying in Wait." Which is when you pray on someone. This Kid wanted to get back at Zimmerman for chasing him, maybe knowing he called the cops on him, and decided to take action into his own hands. In the Recording Zimmerman gets told by dispatch that "he didn't have to do that," meaning try to find the perpetrator, let REAL law inforcement do that. As he "walked" back to his car, didn't necessarily got into his car (even if he just stood there) Martin was now following Zimmerman. How do we know? Simple! Zimmerman couldn't see him "they always get away!" Yet he turns around and there's the perpetrator. So legally Martin was "lying in wait" watching him, following him, and sadly acting on Zimmerman. Remember its legal to carry in FL!

I became familiar with Massad Ayoob when he was writing articles about guns and shooting for Backwoods Home magazine back in the 70's. I was a different man then, with much different ideas on how and where I wanted to live. His experiences and his knowledge surpass the vast majority of Yucktube "experts" giving advise on guns and/or shooting. If he says it... you can take it to the bank. Now... I am confined to a power scooter (a BIG target for anyone wanting some "free stuff"). The ONLY recourse for me if attacked... is to shoot to disable. There is NOTHING I can or could do physically to deter an attack.

Piss pore advice from someone that has no clue what your talking about. What about the security cameras that saw it. What about anyone that whiteness it that you probably didn't notice because you were to busy fighting for your life. Are you a Doctor? How would you know if he/she is actually dead. Are you planning on putting one in the head to finish him/her off to shut them up? Do you actually believe the Police won't figure that out? What if whomever ever you shot especially with a handgun doesn't know their supposed to fall down and runs away? Are you going to keep shooting or chase them down and shoot them some more? What the hell are you thinking? Even if you don't actually think that, why are you saying it on a public forum? Should you be involved in a self defense shooting unless security cameras or eyewitness show otherwise your story will have enough measure of doubt to get you at least locked up until it gets sorted out. Guys like you shouldn't carry guns, because you will end up in prison because you were stupid enough to turn self defense into murder. In 40 years in law enforcement I saw a lot of you drag em inside types end up in prison. The dead do speak. If you don't know how, Good luck Cuck Chuck, prisons are full of people that thought nobody saw it.

Depends on where you live. Learn your local laws. Self defense in your home varies by state. What is legal where I live in Michigan is not legal in California or even in Ohio one state over. Regardless of the law I would try to make sure the person was actually a threat before I shot them. Just standing in your house doesn't always mean they are a deadly threat. They could be drunk and confused and went in the wrong house. They might have mental problems or dementia. My mom has dementia and wondered into someone elses house a few house down once. Thank god they didn't just shoot her. Back in the 80's my cousin went to prison for shooting someone in his yard. The guy had a gun and was in his front yard. He got a shotgun and fired out the window at him. He felt justified but he ended up going to prison because the guy wasn't in his house. When I lived in California in the 90's it wasn't legal to shoot someone inside your home unless they posed a threat. The state felt that your TV or whatever wasn't worth a life. Maybe those laws have changed since then, I don't know because moved to a different state. I would suggest doing some reading or watching some videos on home defense and check your local laws. Then make a plan from there. It is no different than making a plan for a fire, you really should have one.

In fact, in North Carolina, you can shoot at them before they even pass the door threshold if they are attempting to break in. Having children in the home backs you even more.

One thing, “dead man tell no tail”, Trayvon Martin can’t defend himself, and second; Mr Zimmerman profiled, stalked and confronted (armed) in a confrontational manner Trayvon on that rainy night. Had This tragedy been reversed. Trayvon would have been protected under the “Stand your ground law”.

I think you missed his entire point. Martin was profiled because he was looking through windows in an area that had recent break-ins. Zimmerman was returning to his vehicle according to the audio picked up by the phone call (aka "evidence"), so he couldn't be "stalking" him. At that point the provocation counter was reset because Zimmerman was returning to his vehicle.
