Debate: Is Sex Binary? Co-hosted by the MIT Free Speech Alliance & Adam Smith Society

The MIT Free Speech Alliance and Adam Smith Society are pleased to co-host our third Oxford Union-style debate at MIT, with the following proposition: “Resolved, that sex is biological and binary, and gender identity is no substitute for sex in social policy.” The debate will be held on Wednesday, April 17, 2024.
Alex Byrne, Professor of Philosophy at MIT and author of Trouble with Gender: Sex Facts, Gender Fictions, and Holly Lawford-Smith, Associate Professor of Political Philosophy at the University of Melbourne and author of Gender-Critical Feminism, are arguing in favor of the proposition. Alice Dreger, historian and author of Galileo’s Middle Finger, and Aaron Kimberly, Executive Director of the Gender Dysphoria Alliance and co-host of the Transparency podcast, are arguing against the proposition. Nadine Strossen, professor emerita at New York Law School and former president of the ACLU, is serving as moderator.
Neither the Adam Smith Society nor the MIT Free Speech Alliance takes an official position on the debate proposition. Rather, our goal is to provide a model of vigorous yet civil discussion for both the MIT community and the wider public. We hope that you will join us in this endeavor.

Sex is binary. If you want to describe the infinite variety of physical representations of humans, you can do that, just come up with a new word instead of confusing everyone by constantly changing the meaning of existing words to fit your latest agenda.

You tell them sex is binary and then they describe secondary sex characteristics and if you point out that's what they're doing they get mad. It doesn't even make sense to say sex is a spectrum with secondary sex characteristics unless you want to get into really weird positions where children start somewhere in the middle, Dreger is less female than she once was because of her age and reproductive capacity, a man who has testicular cancer becomes less of a man once he gets it removed etc.

Yeah that one is great it begot Judith Butler, Andrea Dworkin .. "constantly changing the meaning of existing words to fit your latest agenda." Does family mean the same thing as 50 years ago ? No doubt you are referring to woman, that is what people call me. It's called a working exception & not being dogmatic. As close friend on the phone just said to me she thinks women are feeling threatened, i said they should worry about robots.She agreed.

Worse is that every law on the books is being reinterpreted AS IF it meant gender identity all along. It would be fine to advance policy to give trans protection if its lacking, but we should not be applying these incoherent definitions retroactively.

That's not true. It is only through proper examination of all sides of an issue that you can discover the truth about it. And you can only get all sides if you engage those with differing ideas. That happens in debate.

You can't do that with subjective self identification (anybody can claim to feel a certain way). Self-identification CLAIMS are not among those considered to be a human right. To do so would dilute the notion of rights into uselessness. Claims do not equal rights.

I agree with your thrust. However, it is possible that one day there will be humans who don't live on Earth. But sex is determined by prospective reproductive role, no matter the planet on which humanity lives.

I've seen her do this in her debate with Colin Wright. I'd like to see her put up in debate against someone who was a really great debater and speaker and thinker... someone like Christopher Hitchens but with biology and philosophy PhD's.

@tbessie yes... the decisive victory.. I must say I found the ..doubt the reality of the sex binary pretty unconvincing... seems us humans have very developed instincts, and preferences around this.... ie.. typically there is never any confusion.

@@thurstonhowellthetwelf3220 Additionally, the vast majority of people are biologically sex-conforming and cis, so that kind of makes it easy to be right the vast majority of the time. i really appreciate though in this debate that they acknowledge trying to respect, and protect as many types of people as possible, the majority and the minorities. additionally, making that distinction between public and private rights to restricting users for otherwise publicly available "spaces".

@MoSho23 yes they are thinking about that/taking it seriously. Although Alice's hormone argument for women's sport is plain wrong.. they are much less trans ideological than many governments, US, Australia, Canada, for example.

Thanks to the MIT Free Speech Alliance for holding this wonderful debate! It seemed that all agreed that self declared “gender identity” should not, in any wholesale way, replace “sex” (whether or not it is binary) in law and policy.

Yes, though that agreement is unfortunate, for the debate. It was good to have the two points of view that were present, but as the debaters said, the third point of view-- that what matters is what you declare you are rather than anything objective-- was unrepresented, and its advocates never accept invitation to debate. We at MFSA did try hard to get people like Judith Butler to join the debate, but they refuse to defend their position in public if anyone is there to answer them back.

@@jovialnobody Because the arguments that she is making are not based on Queer theory or gender ideology but on known variations and choice. At no times did she demand for people to use pronouns for example . You are entitled to not like her arguments which are very simply to allow for exceptions such as myself. The link of the video had two purposes . One evidence of a far outlier and that it is a known, studied phenomenon yet not called intersex because it is not known to be genetic & has biological causes . She specifically made the point many times that we are still learning...Few people actually know that HSTS transsexuals are thing or that there is a biological basis because it is mixed with other groups, conflated with other groups. When you pretend that it is as simple as large gametes or "sex is immutable " it becomes much easier to control the narrative every bit as easily as feminists or TRAs & Queers theorist do simply in a different direction.

@@non_ideological_transexual7414 I think what GC folk are trying to say is that when it comes to sex, you don't get a choice; when it comes to gender, maybe you do, depending on your definition of "gender". And as far as "variations", it's irrelevant. A rare incongruity of sexual development has no bearing on the bigger topic, whether sex is biological, binary, and immutable. That is the proposition under debate here.

@@uncleskipsprairiejustice9367 The interesting thing is that it is Terfy radfems or radfem influenced "GC"s that want the legal certainty of gamete sex , occassionally agreeing to allow XY intersex females in so that rights can be held on to by sex alone ,hoarded ( look at the WDI ) . Alice referred to specific known brain differences in HSTS transsexuals ( sexual inverts ) which Radfems dispute as being different from typical males ( so they can exclude by the nature of all males being capable of great violence ) but in fact there are decades of data ,live MRI studies recently to back it up. Radfems and almost all feminist deny any brain sex differences to "help" their argument. Denying any such thing as gender or what you want to call it as representation of what people read as a sex is to revert back THEIR argument that a determination must be made by gamete sex alone...no other criteria ever. I am gender incongruent more correctly sex incongruent ( but feminist like that even less). People like myself are diagnosed with two primary things early onset gender dysphoria which has a specific meaning and Gender identity disorder ( GID ) which means we desperately want to live as the opposite sex. For over 30 years most all radical feminist have wanted to push back on our legal accomodation where we obtain a gender recognition certificate allowing birth certificate change thru a now lax process. .Radfems have written whole books on it ( again they want only XX gamete sex ) so they they can exclude us from any place that they determine a "female / women's space" including medical care , to remove what has been allowed under law for over 70 years unofficially and 30 officially in western countries and a few others. When Terfs and GC say that sex is immutable they mean that you cannot possibly live as the opposite sex ( we do ) and they do not want us to be able to. There are many thousands of us as distinct from "transwomen", all the ones that i know pass easily as do i living as women for anywhere up to 40 years and Terfs , GCs , radfems simply do not like it and see us as a territorial threat. No woman i know or have ever talked to about this thinks the same as the tiny number of women that do. Normal women are concerned with the trans in sport , self I.D ,affirm policy that's it . Gender ideology , Queer theory being taught are a separate issue. We should be talking about the feminist ideology as well which has done far more harm over decades. When the politics allow for it sexual inverts will be recognized as a form of intersex it is simply a matter of time only slowed by the nonsense of the "transgender umbrella " and gay vs homosexual politics. So much talk about "intersex" people when the vast majority of the debate regarding so called "trans" people has nothing to do with intersex. Perfectly healthy and completely physically typical males, according to trans-activists, can just identify as a female and are therefore a female - .... hold up, what happened to all the big hyper nuanced talk about gametes, genes, and hormones? All that just goes out the window the minute someone self-ID's as something? The whole movement is incoherent and illogical from top to bottom and should be rejected wholesale.

the term “intersex” needs to be replaced by something else. It seems to suggest a third sex, a third box. Humans started evolving into mammals 200 million years ago, and all mammals have only two sexes. We are not clownfish, we are not snails. We are mammals, male or female, with or without developmental anomalies.

@@Mel-wn9gb I think the term intersex might be an example of what George Carlin called “soft words.” Shell shock became battle fatigue became PTSD. Starting in the 1980’s self-help self-esteem (self-absorption!) era, there has been a trend to soften the harsh realities of life. Birth defects became disorders became differences as in “difference in sexual development.” You’re right: we should go back to “male with DSD” or “female with DSD.” They are still either male or female, that is, on the developmental pathway that would ordinarily produce small gametes or large ones.

First, I'm glad that there is an institution brave enough to hold this debate, and people brave enough to participate. It shouldn't require bravery, but nowadays it does. The trans activist side is hard to listen to, as expected. Using pathologies (rare ones) to define the entire group. Equating people born with genetic disorders with autogynophiliacs when it's becoming clear that many (most?) men who transition later in life are AGP, and symptoms of AGP are now often called gender dysphoria in children. There are two sexes. To resolve the problem of genetic disorders (as it appears we must if we want people to stop bringing it up) we can simply say there are females (which is the default) and not females. You are either female or not. XX or not. Females deserve safe spaces. Period. If there are edge cases we can deal with them, but we don't have to allow men to invade those spaces in order to do that.

Grasping for straws. Exploiting a small minority's severe health issues to say anything meaningful about the vast majority is both manipulative and unethical in my opinion. And it doesn't even stop there since they also overstate the number of people suffering from these rare conditions. The only thing proven here is that nature sometimes f'***s it up which we already knew. Sometimes people are born without an arm but nobody concludes that actually humans only have one arm or that arms exist on a spectrum.

It's not about biology strictly speaking in terms of gamettes . I have lived as a woman very easily for many years. I am still "technically" a biological male. This would not be possible it what you said was actually important. This is far more about phenotype & genetics. BTW two of these people have your view largely speaking if you know anything at all about this group who i know from the past are respectful and actually want real dialogue and a deeper understanding than "THAT'S A MAN"

Perhaps if they had some disagreement on the biological data, featuring a biologist would help. But they both seem to agree on the biological data that uses a binary sex framework. They just disagree on whether or not we as a society should adopt such a framework so as to construct day life systems and identity etc.... This seems like a humanities question, at least with a background in biology.

If that's the case then the title of the debate is wildly inaccurate. Is gender binary. Is sex an important societal differentiator? The role of biological sex in gender. Titling as used, and lack of biologists being involved seems to be designed to conflate gender and biology?

Biology. What is sex? The arrangement of specific reproductive organs in a system. What system? A biological system. SO, what is the non-strictly biological aspect you claim? "I am still "technically" a biological male." - so, there you go stating biology "This is far more about phenotype & genetics." - that comment alone exposes your ignorance on the whole topic. Yes, the cross-examination from the +ves was a bit weak. Alex explained the misunderstanding of a binary well at the beginning - despite there being only two "boxes", there may be some in neither box and some in both, but there's no other box. The five sex redefinition is a bit like having the definition of human as "bipedal talking ape", and then adding new species for those who can't talk or have fewer than two legs. Disturbances in the development of sex aren't new sexes, they're just disturbances in the development of sex.

I think what Alice doesn’t seem to understand, in the example of Lia Thomas, that her ideas of the nuance of sex provided by people with DSDs has been co-opted by transvestites. Remove the trans category and talk about people with medical conditions then we can talk about the nuance needed to consider social issues relating to these people.

My opinion: Alex and Holly are correct, Alice is wrong, and Aaron surprised me in some ways. Since ‘he’ knows ‘he’ is sufficiently masculinized to pass as male, ‘he’ seems to say he would - out of consideration rather than public policy - use the men’s restroom and locker room, etc. That’s good. But the problem now is that the male festishists and self-ID men invade women-only spaces. They are not as considerate as Aaron. Holly said it best: policy can protect even the tiniest minority interests, at least from outright harassment and discrimination, but it need not do so to the detriment of the hard-won rights and protections of women and girls.

Listening to Alice Dreger is unfortunately like listening to bad arguments from a decade ago. She's become incredibly rigid in her thinking and I've seen her elsewhere explain that she stopped paying attention to the trans issues for years. She's completely lost sight of the bigger picture. And uses examples and stats that are irrelevant, out of date or debunked years ago. She makes clearly false claims like that ppl who say sex is about gametes later say it's about hormones in sports. That's literally the opposite side that say it's hormones not sex. In fairness she did admit she has never ever thought through the issue of why single-sex spaces exist with reference to crime. Then she talks about "female-typical" which literally requires a belief in binary sex lol.

Just because a category can get blurry on the edges of a definition doesn't mean the underlying reality is subjective. Biological sex is actually a super clear concept based on what type of reproductive system an organism possesses. In humans and most other organisms there are only 2 sexes: male and female. What trans activists like Alice do is try to muddy the waters by arguing that because what we consider to be the precise point of a sunrise can be arbitrary, that means that a sunrise can occur in the middle of the afternoon. This is a textbook non sequitur and it's pure sophistry.

An anomaly, disorder, deviation does not change the basic categories of female or male, sex. Some people are born blind, or with low vision, or deaf but humans are defined as having the senses of hearing, vision. Women need safe spaces and fairness in sports and it is not helpful to muddle this because some men may feel like a women or more likely be aroused by the thought. Men can feel as androgynous as they want but in the law women were defined as a sex class, although Biden just destroyed women's rights.

Alice accused the positive side of a circular definition of sex, but that's what she has. She repeatedly referred her different dimensions of sex (gonadal, endocrine, etc.) to those of the typical male or female, but unless one has some referent for those words, it would be impossible to say what was typical of a male or female. Furthermore, the swapping of those typical features according to gender identity ideology - females with beards and males with large breasts - means that even a typical conglomeration of features cannot define the male and female. If enough transitioned, the definition would be watered down until there would literally be no sexes, just types. The positives have a perfectly linear and one-way definition of sex, based on the organisation of the body for one or other gamete production (despite possible failure to reach one or other in a few cases). With that ideal condition, it is possible to discuss the characteristic features, even the "gender", of those, and recognise through that what a typical male or female is like.

The argument offered at 23:00 is so disingenuous. Imagine I have a car. I take a shotgun and shoot the engine block. Now the car cannot run. Does it cease to be a car? No, obviously not, because we are not infants and we understand the concept of object permeance and change over time. A woman who ceases to produce eggs due to menopause is still clearly a woman because she did, at one point in time, produce eggs. Alice says that a menopausal woman or a person whose genitals are damaged by trauma continues to be male or female, but what she's ignoring is that what defined them as a male or female in the first place has not changed, it's just become history rather than a present condition. But it's 23:30 that really sends me up a wall. I am so sick and tired of trans activists trying to use males with CAIS as a foot in the door to allow transgenderism. Alice actually cheats here, saying "a girl with CAIS" and "she," but these are inaccurate. There is no such thing as a girl with CAIS, *only males have CIAS.* That's the whole point. Alice then goes on to attempt to engender pity for males with CAIS by describing the "existential crises" that they may experience. But here's the thing: The insane definitions or sex and gender provided by trans activists cause the intrasexed (those who fall within the normative definition of sex) to have an existential crises. If causing CAIS males to have an existential crises is bad, then causing non-CAIS males -- who vastly outnumber CAIS males -- to have an existential crises must be vastly worse.

A problem with this debate is that Alice is focused on intersex people and Holly is focused on transwomen in female spaces. These are two totally different things. I would go even further to say that transgender people 2 pathways: feminine gay males who want the accoutrements of girls from( a young age, and erotically cross dressing early teen heterosexual boys (as seen in medicine up until 2015) are totally different, both from eachother, and the new population of girls who want to identify out of femaleness. Treating them all as ‘trans’ is unhelpful and leads to lots of angst and conflict, and does a disservice to gender confused teens who could use better options than becoming life long medical patients if it’s not the best pathway for them.

Secondary sex characteristics are on a spectrum. You can have taller than average women or shorter than average men, hairier women, less hairy men, women with deeper voices, men with higher voices, women with smaller breasts, men with breast tissue. Sex itself is not on a spectrum. There are only two sexes in humans. Disorders of sex development only prove that. They're medical conditions in which the pathway to one sex or the other went awry. They're not alternate sexes. What any of this has to do with the ideological concept of 'gender' is anyone's guess. It's just a red herring.

Neither side of the debate discussed why sex is being compartmentalized into parts when our sexed humanity is a wholly functioning system. It is an integrated biological system that is integrally connected to, and very much interdependent on, a much larger biological system (the entire planet-HELLO!), the whole of which continuously reproduces life through reproductive sex. The further we stray from this reality, the more reliant we become on technology, and the more confused we become about who and what we are. That intelligent people are led so easily astray of this fact, is a testament to how utterly captured the world is by tech supremacism.

Can someone please introduce a discussion about the fallacy of gender non conforming. This is a social contact based on what? If people's born with penises want to wear dresses, then why does society need to judge them? We are gradually getting to a point where people don't raise eyebrows at women openly saying they want to be drainlayers, boxers, ie roles that have traditionally been reserved for "men". If we move to a point where we remove assigning dress codes, work choices, etc as something that defines you then we wouldnt be having this discussion.

I’m glad Alice Dreger is not making social policy. These need to work for the majority of people, not the rare exceptions. Do we need to treat all people with respect!? Of course! But it is impossible to consider all needs equally with limited resources. My disabled partner and i could expect that she has the right to access all public spaces as equally as non disabled people, or we can make our own accomodations so that the majority of people are not inconvenienced by government bankruptcy and the physical rebuilding of nearly every building and conveyance on the planet. I do agree with what Dreger is saying about policing behaviour but not sex in theory, but in practice, males, empowered by the law, are making women feel unsafe, and I’m not sure that legislating them into any space they identify with is the answer… I have known 2 transwomen in my life, back in the 70s and 80s. None of these issues of bio men in women’s spaces was an issue back then because both were respectful of our differences and laws had not yet changed to allow self ID, (and with it, bad actors). It is the legal primacy of gender identity over sex that has caused all the problems. That, and a sense of narcissistic entitlement that i never came across in transwomen of previous eras. There are two ways in which the question 'is sex binary' can be understood. It could be a question about the facts: is the world such that we can more or less truthfully say there are these two types of things 'male' and 'female'. It could also be a prescrptive question about our concepts: should our concept of 'sex' be binary such that it is organised into 'male' and 'female'. To me, the second part of the question is more pertinent. We can all agree on the facts, but what those facts mean in terms of how we use the relevant concepts, is the question that has the most pertinent social, political, medical, etc ramifications. My position is that our concepts are idealisations. Concepts can only ever imperfectly match reality. In physics, for example, you learn an equation that models the ideal movement of a weight, but that model won't take into account the numerous changeable factors, such as air density, humidity, wind, etc. Yet, the model still has enough utility that we choose to use it to make bridges, towers, etc. Same with the concept of sex. We have the concept that organises two groups of organisms on the basis of gamete production (functional or not). And the concept, has social and political salience (for example, insofar as the large gamete people, females have been oppressed on such a basis, and such we need the concept as such to describe and make political concessions for this group conceptualised as such), medical salience (insofar as some medical conditions, their co-occurances, etc can be tracked by sex, as understood in terms of 'male' and 'female'), etc. In other words, broad reaching, idealised concepts have huge utility, even though they are imperfect in their representative qualities. Indeed, almost all concepts function in this way. The opposing team seem to not understand that this is how concepts function. And it doesn't prevent us from recognising peculiarities, exemptions, etc, such as intersex conditions. So the question really is, is the concept of sex as a binarised categorisation, most useful? To which I would answer: yes.

The other confusion on the opposition side is that they seem to take 'sex' as a cluster concept. That is, sex is determined by whatever mixture of sex characteristics one has, such that sex appears to be a continuous concept (but really, if this were graphed out, one would find sex characteristics lumped into two "hills" of the bell curve... I wonder why). But the concept of sex the affirmative team speaks of, and the most utilitous concept of sex (I would argue) is organised according to gamete production (functional or not). Actual manifestations of sex characteristics IS varied and complex. But our best *concept* of sex is binarised, nonetheless.

Forgetting all of Dreger’s unconvincing attempts to muddy the waters with exceptional* cases, we all know what a male is (*I’m not saying that the exceptional cases aren’t important and worthy of respect, only that it can’t make fair public policy based on those cases). Because the hormones do many things those are just easily identifiable. We could talk about the different effects of Estradiol , Progesterone compared to Testosterone and out some long standing feminist lies. Would you like that conversation ? Maybe the differences in how they affect crying or orgasm...yes more lies from feminist around those as well. Carole Hooven told me she is afraid to write a book on females like her book on Testosterone . Who do you think she is afraid of ? Certainly not MRAs .😂

Many times people simply troll me and then start repeating back to me line by line feminist theory & text as if i know none and think it came from their mouth. I have talked to so many women in life and recently on twitter where some real conversations can be found. I understand shying away from social media and also just having a life. For quite a few years i simply tried to present a view & share some actual information that TRAs nor feminists/ Radfems/ GCs/ etc do in between bans and being threatened ,doxxed. Jennifer Bilek posting here is one of the worst in misrepresenting to only a narrow thread of the range of things happening all at one time in order to blame men only, stereotypical feminist .

Genetics. XX, XY and age range for further details. Girl,women and boy,man. How fish changing sexes is different from human. Biochemistry and human psychology. Also one few talk about. Is gay,lesbian,trans is or leads to dead end genetics. I.E. procreation dead end. Doing things to kids, even imprinting in ways. Seems sick considering the statistical percents in the larger population. As far as sexual preferences and exclusion or inclusion into a group. That has happened throughout history in ways. Society censorship and classes a part of that. Nice that you got into the rare cases. Though I think some might want to look at fish to human and sex change in a lower class. Also Biochemistry to go along with biological production and expression. The social imprinting and chemical imprinting of sexual preferences can be talked about. Or Biochemistry and chemical leaching or such. You have genetic Biochemistry and biology as part and biochemical imprinting and mental part. Not to get into dominant and receive or submisive parts.
