If commencement certificate lapsed and not renewed by builder. What will affect to OC. Builder say 80% work done and OC will come in 3 months. Is it good to invest in such property. Bank also provide loan and without checking this document was not renewed by builder. How safe for buyers?

सर,हमने फ्लॅट खरीदा है,रजिस्ट्रेशन भी होगया है ,पजेशन भी मिला ,लेकिन बिल्डर OC ,CC हमे नही दे रहा है, तो वोट हम कैसे प्राप्त कर सकते है?

अगर कोई प्रोजेक्ट 'रेरा' रजिष्टर नही है और प्रमोटर ओ सी/सी सी की पूर्तता नही करता है इस सबंध मे क्या करना चाहिये?

In a high-rise society can a builder apply for OC for independent towers or does the builder need to apply OC for a complete society. Also, what are the minimum criteria that need to be fulfilled by the builder before applying OC The builder has to complete the club construction and all other amenities before applying OC

Hi thanks for seeking information from VatsLegalAssociates, So builder can apply OC/CC for seperate towers or even can Apply for the whole project at once depending upon the construction of the said project , also OC can only be applied when the promoter/builder has completed the construction work (including basic amenities like gym pool club etc) and have obtained 4 necessary certificate, but in certain cases (depending upon the authority of each place) OC can also be applied prior to completion of the basic amenities with a promise of completion of the amenities soon. But it must be noted that 4 necessary certificate are must for OC/CC

@@vatslegal It means the builder can apply OC at any time whether basic amenities are completed or not or whether all towers are completed or not..I think nothing is clear in RERA.. every point is in support of builder

@@saurabhmidha3609 not at all ,, you are not getting the point , see as per the written laws the short answer is 'no' a builder cannot get OC / CC until the project is not completed (including the basic amenities) now it depends upon the areas local authorities if they grant them the certificate if a little bit completion is left on work , but if major completion is left then they will not grant them the certificate.

.Hi, thanks for seeking information from VatsLegalAssociates, so if the promoter has taken the Commencement certificate and it is lapsed then the promoter has to renew that certificate because commencement certificate is regarding the construction of the project and hence one cannot construct the said project without commencement certificate, 2) if the builder has completed 80% work and is promising to obtain OC/CC soon then it doesn't have any value because one never know how much time can be taken by the promoter, and even if the promoter has obtained 4 necessary certificate and has applied for deemed OC/CC then also the project is a bit safe 3) see the bank loan works on different criteria and it must not be linked with the safety of the said project bank are there to provide loan on their required documents. There are various examples where the builder have promised to pay the pre emi's after the booking of unit but have never paid any pre emi , due to which banks have started recovery proceedings against the allottee and the builders are even not providing the possession or the construction is still not completed of the project , hence one must invest only in a project where OC/CC is there or deemed OC/CC is there , rest all projects without them are not a good catch.

@vatslegal Thanks for your reply and time. I think you should create awareness about this issue as well. It really dont have much information online. Builders and banks create traps for innocent customers. Even a project under RERA is not safe. The government has also not taken any action, and the project is still ongoing without CC renewal. And buyers dont even know this type of fraud. Luckily, i have asked for papers. And found out this. Otherwise, i almost get scammed by this. I appreciate it. My Promoter is giving explanation to take over possesion of flat ok basis on CC.. they say OC is not required to be taken as per UPRERA. Also saying that in case I dont pay, they will charge late payment charges. Is he correct? I have not taken over possesion yet. Flat is in Lucknow

Hi Anshul , we have to check various factors regarding the same if the promoter has recieved the CC that means the project is completed but because there is no OC hence the promoter is not eligible to provide possession because as per RERA Act both OC/CC is necessary for possession, but as per the circular of 2019 promoter are eligible to provide possession on the basis of deemed OC/CC if your promoter has deemed OC then also it is okay to provide possession, now main question is, in reality is it in a livable condition that is the main question and hence we can request UP RERA for a technical inspection regarding the same , apart from that we can also ask the authority regarding the same by writing it to the authority, if the promoter has not completed the project on time then you can also ask the promoter to provide you the delay interest of MCLR +1% OF THE COST DEPOSITED the promoter might be saying that to you so that you do not file a suit to the RERA court for further help you can visit the website Vatslegal.com there we have posted various things regarding the same

Sirji agar building 30 32 years purana hai... Mumbai ki baat kar raha hu...usme tab panchayat CC hi mila karta thaa... After 2006 or 2007 shayad OC mandatory kar diya gaya ....now if I'm willing to purchase any flat jo building 30 years purani ho toh waha OC to hai hi nahi sirf CC , 7/12 and blueprint.... yehi hai ....toh kya ye flat illegal hai ???... agar nahi toh iska suitable solution kya hai... ??

If the building is completed before 2016 and is not under construction then that building doesnot come under the preview of RERA and they have been approved by the authority and registry is been going on then the said building is legal

Suitable solution is to ask the builder if registry is being done and in case yes then it is authorised then only authority is doing the registry of the said flat
