Let me fill you in. These attorneys have been preparing for months for these kinds of high-stake trials. He's probably have investigated all of the jurors' background. Every "um...ah...what's that word...?" is calculated to garner jury's attention/sympathy. The defense counsel is presenting himself as someone like a juror: a 55+ year old, likely retiree, who doesn't understand college kids. He's asking the juror to put themselves in the shoes of a college kid to understand his action. This is honestly the most well-prepared argument I have ever heard. It's not the attorney's job to look like the smartest guy in the room; his job is to get the jury to his side. I have seen the best attorneys dressing down, looking folksy, etc., to get jurors to empathize with his clients.
No. His argument is concerning culture and how every American breaks the law due to culture, such as the flow of traffic. That's a good argument. The culture of this person's school contributes to the defendant's behavior. Memes like the ones you wrote ('we live in a society') are hollow simplistic mocking misrepresentations of substantive issues and explanations. I know it's easy to be a keyboard attorney and joke, but it's misleading when the joke exists simply to entice a laugh rather than having any semblance of satire that contributes to a larger point. Yeh thats why the law system is such a complicated mess, especially the Lawyering buisness they get promotions and is able to advance they're carreers the more cases theyve one, this systems not promoting truth and justice its who ever has the best lawyer and the losing lawyer gets a potential downgrade if the more cases he lose, what if the person just keeps getting clients that has large amounts of evidence weighing on against them?
I dont think that's quite right, im not sure about Tennessee but in most jurisdictions the jury ascertains an accused's guilt. If the defendant is found guilty he is remanded in custody and there is a separate hearing for sentencing further down the track where the judge gives out a sentence commensurate with precedent and the facts/seriousness of the crime

Honestly if you think about the traffic analogy it honestly helped boost his argument. Yeah he went on a tangent of course but looking through the eyes of the lawyer, judge, and the jury. For all of those who think this guy is talking out of his ass, he isn't. The first piece about looking through it from the lens of a 51 year old vs the accused is telling the jury that they need to get into the perspective of the accused, not their own perspective. This is called subjective mens rea. For a guilty conviction the prosecutor needs to prove this mental element beyond a reasonable doubt. But this has to be from the accused's perspective, that he had the intention to commit w.e. he committed - from the sounds of it a sexual assault. The lawyer than ended with the accused drinking excessively. This is pointing to the defense of incapacity, if the accused drank to the point where he couldn't even remember what he did; how can the prosecution be sure he had the intention to commit his crime? The answer is they shouldn't be able to prove this beyond a reasonable doubt. Note, I am a law student not from America but the common law system is similar. Jurisdiction can have different exceptions for sexual assaults with the burden of proofs. The delivery I admit was hilarious, but if you had the back drop of what he is trying to do; it's not that bad.

@@georgecarrera18 thing is I belief that the law and facts were stacked against the defendant anyway and the atorney knew that. So he tried every angle which may give the jury some reason to be mercyful. Beeing it the surounding culture, the media glorifying violence or alcohol, anything that makes his client less accountable for his actions helps if you cannot argue law or facts.

When I came into this office for the first time I was amazed by how nice everyone was. They all went out of their way to greet me and make me feel comfortable. As a rising legal guy, I am in full agreement with his argument. Great argument. He has to speak to each soul of everyone there and bring light into each so that they see the amount of darkness that the rapist did. There is no room for adultery. This is punishable by being sent to Hades in the eyes of God. No human being as the right to do such an action. We must pray and bring the victim and offender closer to heaven even if this happened. Lesson to be learned. As a female, do not let anyone into your room who smells like alcohol. A female and another male or a a guy friend who is intoxicated. There are RAs, medical professionals (EMTs), and Campus Police who have been trained to deal with these situations. Do not drink at all period. Stay sober. Stay vigilant. Well, what's this fellow is trying to do is essentially just ease the term the accused dude's gonna get for raping a girl. There must be some one to do the defense, because it's a two side system. And yes, the prosecution side must win most of such cases, and they usually do. Cause they're right and they have a bunch more resource to compete in the court. Yet, the defense lawyer goal is to win at least couple years or some softening conditions. Also, I kinda call recall to his message. That's a fucked up system all around.
