Depositions of Jacksonville Sheriff's Office in Police Brutality Case: JSO Officer Tim James

At about 2 PM on April 27, 2016, Jacksonville, Florida resident, Mayra Martinez reported to her first day of work at Scores Bar after recently moving from Orlando. She was reportedly fired after being served alcohol (or something else) by fellow Scores employees. Scores called the police and reported her as “trespassing.” She was kicked out without her purse, social security card and other belongings. Police arrived quickly. The events thereafter can only be described as a disturbing series of violations of her civil rights and human rights. This deposition was taken in that civil case.
I. UNNECESSARY USE OF FORCE (PARKING LOT)
Rookie police officer Akinyeme Borisade of the Jacksonville Sheriff’s Office reported to the scene. He and a fellow officer pinned Ms. Martinez on the ground and used “ground and pound” techniques on her. It appears the officers also hit or shoved her head into the asphalt. She can be heard screaming from a good Samaritan’s dashcam, “I didn’t do anything.” The arrest report differs from the dashcam, as these officers where not aware of being recorded using unnecessary force.
II. UNNECESSARY USE OF FORCE (JAIL)
Ms. Martinez was then transported to the sally port (intake corridor) of the Pre-Trial Detention Facility of Jacksonville Sheriff’s Office by the same officer. Footage depicts her handcuffed and standing around being largely ignored for some time awaiting processing into the jail. At some point she says or does something officer Borisade disagrees with. He approaches her and shoves her into the wall. She reflectively kicks back and he pummels her in the stomach, chest and face, knocking her completely unconscious.
III. FAILURE OF OFFICERS TO INTERVENE
Officers have a duty to protect individuals from constitutional violations by fellow officers. Therefore, an officer who witnesses a fellow officer violating an individual’s constitutional rights may be liable to the victim for failing to intervene. You can clearly see this in the above video- apathy, lack of concern, repeatedly failing to intervene or taking over for the officer who clearly had lost his composure. The Blue Line was protected despite clear abuses of power.
No supervisor ever stepped in or controlled this probationary officer. Sure they terminated him after the incidents, but it was too little, too late.
IV. FAILURE TO PROVIDE ANY CARE OR CONCERN FOR UNCONSCIOUS VICTIM FOR 15 MINUTES
Detention and correctional facilities have an obligation to provide adequate medical care to detainees and prisoners. They are in the care, custody and control of the institution, and are unable to seek their medical care elsewhere, as free persons may. As such, considerable time, effort, and expense must be devoted to protecting injured or sick inmates. What you see in the above video is beyond disturbing. Ms. Martinez was left to potentially sustain serious neurological injury, or die, without one person checking her pulse, breathing, whether she would choke or aspirate on her own vomit, etc. She did not move for nearly 15 minutes and no one showed any care or concern about it.
V. REFUSAL OF HOSPITALIZATION RECOMMENDED BY EMTS BY OFFICER BORISADE
Once Jacksonville Fire and Rescue were finally called by JSO and arrived, they were given false or a fundamental lack of information. The EMT report indicates officer Borisade only admitted hitting her in the stomach and claims that pain in the stomach was all she complained of. She is clearly unconscious at the time of the incident. The report makes no mention of any head trauma. Making matters worse, the EMT report indicates EMTs repeatedly urged Jacksonville Sheriff’s Office to allow them to take her to a hospital in the ambulance located only a few feet away. However, the very same officer who harmed her was authorized to refuse her further medical treatment or hospitalization “against (the EMT’s) medical advice.” He had no business being in her presence at this point, much less making medical decision on her behalf after committing multiple crimes of battery against her.

Since this is a civil action, I assume James was not allowed to hide behind the shame and disgrace that is qualified immunity.

"Since this is a civil action" you assume the former officer was denied qualified immunity... Obviously, since qualified immunity only applies in civil suits, idk anything about whether or not qualified immunity was denied... Would the judge have already decided prior to pretrial depositions whether or not the officer was entitled to qualified immunity? Or are deposition transcripts the source of information used by the judge to decide on the application of qualified immunity? Or does he not make that determination until after hearing testimony? Surely the judge has to have some kind of information to base his decision on... I'm legit asking because I don't know exactly when the judge decides whether immunity will apply... Are you saying he makes that decision as soon as the suit is filed, without any information on the case itself? "The shame and disgrace of qualified immunity"... Is qualified immunity always an indication of shame and disgrace? Or might it depend on whether or not the doctrine is applied as it's intended vs applied when it shouldn't be, obviously just to protect a blatantly obvious dirty cop? I believe the doctrine itself is useful and necessary when applied as intended... which is to prevent officials from being endlessly tied up with frivolous lawsuits filed with malicious intent. The negative result being a likelihood that with enough frivolous suits filed, eventually the odds are that a judge or jury may get one wrong and award a financially devastating decision on a frivolous suit. It seems reasonable that taking everything an official had ever worked for when he'd not committed any crime would make it difficult to retain good officers and recruit new ones if it became typical for officials to lose everything financially for doing their job. This was at least part of the thinking that lead to the doctrine being implemented. Of course it leaves room for abuse and using the doctrine to protect officials who don't deserve such protection. Which one might argue is why it's a judge who applies qualified immunity when it's not warranted who is worthy of contempt, not the doctrine itself. And seeing how the judge who decides an official is entitled to immunity is an elected official, there's simple recourse and remedy available to correct the situation if a particular judge is guilty of applying immunity in cases where the officials are not entitled to it. Any shame or disgrace should be reserved for the judge who grants qualified immunity when it's not warranted. Being the target of a frivolous lawsuit hardly makes anyone deserving of shame or disgrace. To characterize a case in which the official is covered by qualified immunity as it is intended in frivolous suits in which the individual is entitled to it as being shameful or disgraceful seems misguided and inappropriate. It occurs to me that many who have jumped on the social media fueled "end qualified immunity" bandwagon tend to be less than well informed, often not understanding the doctrine at all, believe that qualified immunity is strictly a corrupt trick used to shield bad cops when they abuse citizens. ... Which would explain why one would characterize the doctrine as shameful and disgraceful. The incorrect application certainly qualifies as such, but the doctrine itself does not. And the entire public focus on blindly ending the practice altogether is a misguided distraction keeping the uninformed preoccupied with a non solution in order to protect those who deserve to be removed from the bench for misapplying the doctrine to protect cops unworthy of protection. The states which have already done away with qualified immunity have not experienced any significant improvement in police conduct or reduction in cases of abuse of power. The public has come to believe that ending qualified immunity is some magical cure for all that's wrong in modern American policing. Nothing could be further from the truth and the idea is just a dic|rsuin that keeps people from taking any action that's actually needed in order to create change in policing, which is based largely in holding elected officials who hold power in policing and the criminal justice/court system accountable for their failures and incompetence which infects leadership throughout their agencies, and allows for toxic cultures within agencies and adversarial "us vs them" mentalities to proliferate. Until the public demands accountability from their elected officials, those officials will not make the changes necessary to demand accountability within the agency from the top down.

He was at JSO for 5 years and he managed a "couple" disciplinary complains, he cost the city at least 110k in lawsuits and killed a guy in a car "accident". Great cop! I would like to hear his deposition while he was connected to a lye detector, because 95% of his answers: I don't recall, don't know, no, maybe is a total *BS*!

He wasn't quoting lyrics that he doesn't know the meaning of, he was saying the quiet part out loud. I'd bet my farm he's battered a lot of people in his tenure then charged THEM with "resisting" and "assault on a police officer". Guys like this know how to work the system and fabricate instances where they can escalate and go hands on to hurt someone that made them angry.

I noticed he mentioned all of the areas in which they received training - driving, defensive tactics, general orders, special orders, etc. What was conspicuously missing was training regarding the Constitutional rights for individuals including the First, Fourth and Fifth Amendments.

Well, it's pretty obvious that when grenades go off they explode. So when he said, "I'm about to go off like a grenade," he was saying he was about to explode. Yet his answer is, "I really don't know what I meant by that.' You meant that you were about to explode! They thought bc she was a stripper that they could treat her with complete disregard but she took them all out! I don’t agree with sex work and society telling us that there’s no shame with being hoe-ish but the reality is we should have self respect and worth and have decorum along with integrity… being modest is a lost art these days, but nevertheless, we should treat everyone with respect. Just bc someone committed a crime doesn’t mean they seize to be human.

This goes to very poor field training. People may not expose their anger issues in an interview, oral board or even in the academy. I find it hard to believe this guy never showed inappropriate aggression while in field training. In fact, it’s one of the responsibilities for the training officers to evaluate that and make appropriate documentation. This guy would have never made it through field training riding with me. You need to pick brains, and pay close attention how they behave in stressful situations. All of his FTO’s probably had the same attitude. I mean like at his face! He limbs like he’s about to kick everyone butt in the room and he’s just having conversation. Imaging how he would react with someone calling him names or being disagreeable.
