Sir one small doubt A is land owner B is a builder. A owns land. under a Development Agreement, B builds 8 flats on plot owned by A. In turn, he hands over 3 flats to A. Now, B starts accepting advances as Flat Booking Advance and became liable for GST. Now, my question is what are the implications in case of A who neither incurred a rupee for construction nor eligible for any ITC?

Nicely explain, just question that if any building is under construction, flat which not sale by builder when gst is payable or paid by builder for that flat? And when any flat sale by the builder at the time of under construction when gst is payable by builder before possession or at the time of possession? Thanks

What will the implications if partly constructed building got 1st occupancy? For example if G+4 storied building was being constructed and 1st floorr and ground floor was prepared and sold out, so is gst applicable or not.

Explanation is required in case of unregistered Developer. Generally they charged additional 5% over sales price and collected from buyer. Can they do so?

सर बिल्डिंग कम्प्लीट होने के बाद विदाऊट कम्प्लिशन रेट पे दिया. और वह रेंट एग्रीमेंट बाद में सेलिंग के वक्त दिखाया तो जीएसटी कमर्शियल बिल्डिंग में लँड ओनर को सेल करने के लिए नही लगेगा क्या. यह बहुत बडा कन्फ्युजन है

Is the same clause is applicable in both the cases ?? Is abatement for post booking also available in commercial construction also for post booking ??

Thanks for valuable information. I just have a doubt when Builder buy materials, he pay gst to suppliers according to type of material. Again he is taking gst 18% from flat buyer and giving to govt. Is it double gst. Kindly explain

Sir I booked a flat in 2018.and pay 2 lakh booking amount. But builder cancelled that flat.and asked to refund or take another flat. I agreed another flat. In affordable housing. Flat value 20lakh. My agreement done in 2020. I full flat amount paid time to time till 2023. Now builder asking gst charges 8 percent. From 2019 gst become 1percent. So please advice which slab gst I will pay to builder.

Can you please explain whether contractor giving works contract services to builder having houses of below & also more than 60 square meters. Whether contractor collect GST 12% or 18%. Builder forcing to bill at 12%.

Sir , Our Society is entering into DA with Developer Now they Suggested NO FINANCIAL TERMS WILL INCORPORATE LIKE RENT HARDSHIP , CORPUS , SHIFTING CHARGES etc. in Main Body of our DA to avoid Stamp Duty unnecessary but same will be appearing in PAAA where in individual Area , Floor Plan , Amenities , Rent , Corpus & Shifting allowance will be appeared and stamp duty will be paid on same so to avoid DOUBLE STAMP DUTY so let me know the effects in case any dispute comes in future between Developer & Society , should we adopt this Short Cut for the benefit of Developers , Are we Not COMPROMISE our Safety Advice

Sir, I booked a flat on March 2017(pre-Gst) with total consideration of Rs 52 lakh. I paid amount of Rs 10 lakh during agreements of sale(on March 17). Balance Rs 42 lakh got sanctioned by bank on sep17 & paid to builder. Question: I have not got positions of flat till yet as it is under completion. Now builder is asking for GST amount from me. Shall I need to pay Gst as it is booked in per-gst era ?

Actually builder is liable to pay GST Hence, you are also liable to pay GST

Hello sir. Sir maine 2 bhk flat feb 2018 me purchase kiya hai.@ 12% gst ke hisab se.agreement registered bhi huva hai.or maine 5 installment bhi pay kar diya hoo as per 12% gst.with principal amount. Ab new rule aaya hai 5% GST ka from 1st april 2019 se. Ab mujhe GST ......kitna pay karna hoga.5% gst ya 12% gst . Builder 12% demand kar raha hai. Please suggest me...

Hello sir. Am your RU-vid subscriber. Mere kuch doubts hai. Mujhe 15L mein 350gaj plot lena hai. Jisme mujhe 18% GST on plot cost i.e 15L, 4.9% stamp duty, 1% Registration charges and advocate charges dene ko kah rahe hai. 196543+77580+15832+15000 = 304955. Kya 15L ke plot parr 3 lakh 5 hazar ka kharcha aata hai sir. Aur bol rahe hai ke 6L white mein aur rest of the amount black mein dene ko. Toh sabhi govt charges mujhe 6L ke white payment parr applicable hoga ya 15L ke total payment parr. Plz guide. Need your kind advice. I already msged you on your RU-vid channel. Aapka video 3 saal purana hai. Mujhe 2021 ka update chahiye sir plz.
