@@painterman235 I think Rice v. Connolly [1966] 2 QB 414: Establishes that refusal to answer police questions or assist in their inquiries * does not in itself * constitute obstruction. And/But, PACE Code A, Paragraph 2.2: provides that: "Reasonable grounds for suspicion depend on the information available to the officer and the individual’s behavior. Suspicion must be based on facts, information, and/or intelligence which are relevant to the likelihood of finding the item sought." Misuse of Drugs Act 1971, Section 23: "A constable may search any person suspected of having controlled drugs in their possession." So ‘I think’ this is how the grounds work? Of course I am no expert in law.
true but its not just these 2 individuals its police officers as a whole overwhelmingly dont understand yet that they cant just detain people randomly (a small percentage obviously seek to do their jobs to the best of their ability just like with any job), that there are very specific circumstances for it, and thats why auditing, done properly, is a must and not just some weirdo activity like most ppl see it as. maybe im naïve and they do know they shouldnt be detaining people without set in stone grounds and they just know theyve been getting away with it for decades so its the easiest way to do their job, but i think a lot of them genuinely dont know the law as well
@@ItsEasyJustLift I think the majority just simply don't know the law and aren't well trained. They also have a general sense of impunity and don't worry about consequences of doing something wrong. Then, in my view, you get the much more dangerous ones who actually do know the law yet chose to wilfully abuse and misuse it for their own purposes. This adds a level of deviancy and malicious intent which is missing from from the ignorant ones which don't know the law, which is bad enough in its own right. The quality of policing has absolutely nose-dived in the UK over the last couple decades. We're at an all time low, civil rights have been assaulted, police powers massively expanded, and not to be such a pessimist, but I only see it getting continuously worse over time.
I think it’s pretty basic stuff with searches, it just cant be based on a hunch. It has to be something tangible. He might have gotten away with it if it hadn’t been for that pesky law (pace) they made forty years ago,😊.
So he was about to walk off, then you spoke to him, then all of a sudden he suspects you of having drugs for talking to him, what a effing corrupt clown
Obviously no valid reason for what they did, but I must say that does look like the kind of area where if you were into drugs, you'd know where to get them
Right, isn't it obvious that these type of youtubers intentionally try to look iffy, so they get interactions like this for youtube? I like watching them too, but it's obvious this is what they want. My guess is, if we saw it from their angle and 5-10mins before, it'd look like he was watching them and trying to look like he was avoiding them as in intentionally trying to look shifty.
Avoiding police? As soon as they worked out Reggie, they couldn't walk away fast enough. Remember coppers. There are more of us than there is of you. Be very careful in your next moves.
Walking away from them are grounds Walking passed them are grounds Making eye contact is grounds Looking away are grounds Being in the area is grounds Leaving the area are grounds
So if I pass away outside and they come up to me since I will be somewhat stiff and unable to move will these be grounds for detainment because I am hanging around the area likely being anti social ?
6:18 'If you've not got anything on you that's fine.' No, it's far from fine young madam, it's a violation of a citizen's human rights. You had absolutely no proof or evidence to suggest he was carrying or using illegal drugs. You can't use 'you walked away from us' as an excuse to carry out a search. That's not good enough.
I hate the police like the rest of us, but the behaviour seemed suspicious enough to warrant a search, as much as a 'coincidence' as the wrong direction was. We all know he does this on purpose.
@@geoffcarlton4047 Firstly, the 'rest of us' DON'T hate the Police. We want them to act professionally. Just that. Secondly, constable, there were no grounds for the search. Walking away, or not wanting to speak to the police, should not be a detainable action.
@@geoffcarlton4047I agree , but suspicion isn’t a crime, I’m suspicious of lots of police and idiots but don’t mean I can put citizens arrest on them , not arguing with you bro🫡👍
5:52 Regie stated, I don't do drugs." Plod responded "I know," then it continued to search, blatantly abusing police powers and violating Reggie's rights.
I'd guess in the polices defence, you don't need to do drugs to have them on you. Still a bit weird how quick it turned from "have a nice day" to "I'm searching you" though.
His demeanour is irrelevant. He abused his powers. His colleague supports the badge of devision. Both were not professional or he would not have done it. He had nothing better to do. Young and trained to be authoritarian.
Polite cops , so what , a lot of psychopaths are very polite and hide behind their manners . Reggie thank you for showing us how we are controlled and bullied . ❤
So for changing direction walking in a street and not wanting to talk to the police means you can be searched for drugs then? This is absolutely bonkers. I hope you take these clowns to the cleaners Reggie.
Walking away from police is not sufficient grounds to suspect any sort of unlawful behaviour. They are grounds on which to believe the member of the public did not want to be inconvenienced by some BS unlawful made-up search by the police. "The whole demeanour" - what he means by that is that he tends to punish people that don't lick his boots - by using the process of the search as the punishment. Reggie did not have slurred speech. He was walking in a co-ordinated way. He is not a known drug user or dealer. An area being relatively high for a certain type of crime is not sufficient reasonable grounds to do fishing searches. All in all, another claim for compensation via HNK. This might be a relatively low amount of compensation, due to it being a quick search. But even so - we all know that he searched you for completely unlawful reasons. Police earning the hate - yet again.
Who told you that, absolutely untrue, they must have reasonable articulable suspicion of a crime, mere suspicion is an opinion, nothing more, nothing less, it's here say.@@ronmccullock1407
If it's a high crime area! Do your job your paid to do! Instead of sitting in your cars all day doing nothing, Waiting to jump the queue in the shops to get your scram...
His grounds are worthy of a comic sketch-is it his first day in uniform? What is obvious is that he has no idea about any guidelines . Please, can we have a trophy sent to the station for this fool-he gets 1st prize for 2024 even in May.
Simply walking around in that neighborhood makes you a suspected criminal…yet the residents can walk around without being accosted? So really the police are protecting the criminals??
Imagine that walking away from a constable is grounds for a search, which items would it indicate the person was carrying? How could they possibly know that Misuse of Drugs Act is the right legislation?
100% HE SHOULD SUE THEM BOTH IN CIVIL COURT ON AN INDIVIDUAL BASIS AND THE FORCE THEY WORK FOR FOR NOT TRAINING THEM CORRECTLY AS THEY OPENLY ADMIT TO THEIR OWN CRIMES AND PROFESSIONAL CORRUPT FAILINGS.... ALL ON FILM X
I've just done a quick search on Blackpool crime rates. The crime rate is 97% higher than other towns in Lancashire making it the county's most dangerous town. In 2023 there were 10,388 violent or sexual crimes and 2283 reports of criminal damage. There are also several unsolved murders in the town. Looking at these two constables we can clearly see why.
I’m glad you mentioned unsolved murders in the town. I used to work with a guy who lived in a town near Blackpool. I thought he was exaggerating when he told us about there being lots of murders in Blackpool. Particularly of homeless men and drug addicts found in alley ways but not many of the murders were solved!
There seems to be confusion between discrete (separate, divided) as in the order and discreet (secretive, not openly) as discussed by you and the officers. Senior police management at fault again.
The police officers were friendly enough but overstepped their powers. Being suspicious or having the wrong demenour is not grounds for a search. This illegal search should be referred to the ICPO.
“You walked away from me, so now I’m allowed to search you for drugs!” Do we live in a police state?! Please, PLEASE, put in a claim against these absolute clowns…
Sue them both, the chief constable and the PCC, for unlawful detainment, assault and battery, its the only way these thugs in uniform will learn, in addition, its about time these rogue's were hit in their own pocket, maybe then they will abide by the law, currently the tax payer pays up for these total clowns who think they can abuse the public without loss of their own earnings, ive already written to my MP, as a similar thing happened to me, resulting in a £5,000 pay out, come on Chief Constables and the PCC, GET A GRIP.
please take them to court as a civil claim over this- its simply been "we want to stop you under anything we have made up because you don't want to speak to us" this is outrageous. that young copper is on a power trip and is a future wayne couzens- imagine this being a single woman been harrassed
