In this article, I shall bring forth evidences which demonstrate that the ‘Age of consent’ was indeed, very young, even by today’s standards. I will provide academic sources which show that girls were allowed to be married at the age of 10 years old and sometimes times, as young as 7 years old, legally. It was norm just over 100 years ago to see girls being married off at very young ages. In most cultures, the marriage would have been consummated at the onset of puberty. 1. Professor of history Margaret Wade Labarge “It needs to be remembered that many Medieval widows were not old, Important heiresses were often married between the ages of 5 and 10 and might find themselves widowed while still in their teens.” [1] 2. Professor Richard Wortley and Professor Stephen Smallbone, both of whom state that prior to the 1900s girls married very young, “In Medieval and early modern European societies, the age of marriage remained low, with documented cases of brides as young as seven years, although marriages were typically not consummated until the girl reached puberty (Bullough 2004). Shakespeare’s Juliet was just 13, and there is no hint in the play that this was considered to be exceptional. The situation was similar on the other side of the Atlantic; Bullough reports the case in 1689 of a nine-year-old bride in Virginia. At the start of the nineteenth century in England, it was legal to have sex with a 10 year-old girl.” [2] 3. In the book, ‘Sex and Society’, “Until the late 20th century U.S. age of consent laws specifically names males as perpetrators and females as victims. Following English law, in which the age was set at 12 in 1275 and lowered to 10 in 1576, ages of consent in the American colonies were generally set at 10 or 12. The laws protected female virginity, which at the time was considered a valuable commodity until marriage. The theft of a girl’s chastity was seen as a property crime against her father and future husband. If two people were married and had sex, no matter what their age, no crime was committed because a woman was her husband’s property. In practice, too, the consent laws only protected white females, as many non-white females were enslaved or otherwise discriminated against by the legal system.” [3] 4. Richard A. Posner is chief judge of the U.S court of appeals, Seventh Circuit Chicago. Katherine B. Silbaugh is associate Professor at Boston University School of Law, they say that before the 1900s age of consent was ten years old, “The law governing the age of consent has changed dramatically in the United States during this century. Most states codified a statutory age of consent during the nineteenth century, and the usual age was ten years.” [4] 5. The Scottish Law prior to 1900s by Sir John Comyns and Stewart Kyd, “By the law of Scotland, a woman cannot contrabere sponsalia before her age of seven years. 1 Rol. 343. I. 20. But by common law, persons may marry at any age. Co. Lit. 33. A. And upon such marriage the wife shall be endowed, if the attain the age of nine years, of what whatsoever age her husband be; but not before the age of nine years. Co. L. 33. A.” [5] 6. Professor of Sociology Anthony Joseph Paul Cortese says that a 50 year old man being with a girl under 10 (being intimate) Under United States law was legal until the mid 1960s, “In 1962, the American Law Institute recommended that the legal age of consent to sex- that is, the age below which sex is defined as statutory rape- be dropped in every state to age 10 (Katchadourian and Lund 1972: 439). In fact, until the mid 1960s, the legal age of consent in Delaware was 7 (Kling, 1965: 216). So a 50 year old man could legally have sexual intercourse with a 7 year old boy or girl.” [6] 7. Maureen Dabbagh is a writer and author. Born in Michigan, she serves as a Virginia Supreme Court Family Mediator, she echoes the same statements as previous authors, “…the nineteenth century, the minimum age of consent for sexual intercourse in most American states was 10 years. In Delaware it was only 7 years.” [7] 8. Mike A. Males is an American sociologist who writes from a pro youth rights perspective. Males is a professor at the University of California, he writes, “These early laws specified that a girl consenting to sex had to be at least 10 to 12 years old in most states, with a few specifying ages as old as 14 or 16. In Delaware, the age of consent was seven, based on ancient English laws setting the age squire.” [8] 9. Arthur Siccan Author of the Book: ‘What’s Wrong in America: A Look at Troublesome Issues in Our Country’, goes in a lot of detail on the issue of marriage at earlier times, “Traditionally, across the globe, the age of consent for sexual union was a matter for the family to decide, or a tribal custom. In most cases, this coincided with signs of puberty, menstruation for a woman and pubic hair for a man. Sir Edward Coke in 17th century England ‘made it clear that the marriage of girls under 12 was normal, and the age at which a girl who was a wife was eligible for a dower from her husband’s estate was 9. The American colonies followed the English tradition, and the law was more of a guide. For example Mary Hathaway of Virginia, was only 9 when she was married to William Williams. Portugal, Spain, Denmark and the Swiss canons, initially set the age of consent at 10-12 years and then raised it to between 13 and 16 years in the second half of the 19th century. Historically, the English common law set the age of consent to range from 10- 12. In the United States, by the 1880s, most states set the age of consent at 10-12, and in one state Delaware, the age of consent was only 7. Social and resulting legal attitudes toward the appropriate age of consent have drifted upwards in modern times. For example while ages from 10 to 13 were typically acceptable in Western countries during the mid-19the century, the end of the 19th century and beginning of the 20th century were marked by changing. I believe that a lot of our current mores come from reluctance to let our children mature mentally as quickly as our bodies do. Keep in mind that not all societies share Western mores. And to my surprise, until the latter part of the 19th Century, Children in the Western nations were engaged and married at a much earlier age. The trend to give children more time to mature is relatively new. In his book, The Emphatic civilization, (Penguin, NY, 200) Jeremy Rifkin points out that the concept of adolescence only emerged during the last decade of the nineteenth century and the first three decades of the twentieth century. Society started to think of childhood as extending beyond puberty, into the later teenage years. Before that, children were considered to graduate into adulthood with the onset of puberty.” [9] 10. The ’American Bar Association’ Journal [August 1996]: “1275 English common law criminalizes statutory rape- sex between a man and a woman below the age of consent, which was first set at 12 years. 1576 Common Law age of consent lowered to 10 years. 1700s-1800s Statutory rape at common law adopted in the united states. States set the age of consent at 10 or 12 years.” [10] or 12 years.” [10] More coming Wait! ÷(#) $**#¥×)*#&÷(×¥×(*×*+(×(#(&×*+(*×*#*#(¥+*×*×!×*×)×)×¥

Her finding is that this copy is a student copy who used it to learn and therefore may have made changes to his understanding. She believes this is not a copy that is used for practice or in mosques. Partially because of technical issues with the audio and the language barrier I don’t think most of the comments reflect that people understand the video. This comment is for the Muslims that think Brubaker is using some missionary tactic vs academic work in his past videos. Dr Hilaili is a Muslim and she holds the belief that the Sana’a were student learning aids. Respectfully Brubaker argues against that and with good reason. It just goes to show you can have sincere discourse without intellectual dishonesty and cognitive dissonance. I do wish she had brought a better support for that theory than the one she provided.

Thank you for this comment. Actually, I am not for the moment taking a position on whether or not it was a "school text;" I was just giving our viewers the opportunity to hear Dr. Hilali's perspective. With respect to the "la taqul bismilla" versus a possible other reading, I mentioned the other only to give viewers the awareness about the existence of alternate theories and also even the mere possibility of reading the bare rasm differently in some cases. However, we did not have enough time to properly develop this topic, and in particular Dr. Hilali did not get the opportunity this time to explain why she settled on her theory when considered against the possibility of reading "al-anfāl." Therefore, we will be recording a second short interview this week for this narrow purpose. Look for that to be posted possibly in the next week or two. Best, DB

Variant Quran good to know your position or lack of position on the purpose of the Sana’a palimpsest. I’ve read other theories that the lower text is a surviving non-uthmanic variant that coincides with the tradition, however I’m not convinced given carbon dating. Also Dr Jay Smith had a review two years ago where his theory takes into account the reading as “la taqul bismilla”, but uses that as more evidence that it’s unlikely to be student work. I’m not sure if you’ll have time to read this comment but if you could, can you clarify on whether you believe the lower text to be scribal errors? Your videos suggest the latter. I gathered from your videos that was your position, so that was why I figured you were opposed to the idea that the palimpsest was some school exercise. I’m intrigued to hear Dr. Hiliali’s theory, but also since it might be closer to her field of study, what her insight is on the theory of Aramaic in early Qurans.
@variantquran4505
@variantquran4505 4 года назад
@@pa21thebeast I am not inclined toward the theory that it was a school exercise, but I am open to it as I am to all reasonable possibilities, and willing to hear arguments for them. I think we are at a stage in the study of these manuscripts when we really need to have lively engagement and the proliferation of theories and discussions. Dr. Hilali has had the opportunity to see this palimpsest in person, and part of her argument for it being a school exercise is the poor quality of the parchment. Since I've not handled it myself (though I have handled other palimpsests of comparable age), I have no way of judging this feature of the object. Even at that, parchment quality is relative; obviously the page was of high enough quality to be erased and rewritten and still survive 1400 years into the future without disintegrating. So, each detail is a piece of a larger argument, and we have to respect the that our knowledge is limited and consider the bits of knowledge that others have gathered. This is part of the conversation. We have plenty of time to critique and argue in the days ahead. In other words, I have a healthy skepticism, but not an unreasonable or rigid commitment to any particular position. Best, DB

In Matthew 3:13-17 We see Jesus (God the Son), The Spirit of God (God the Holy Spirit) descending like a dove over Jesus, and a "Voice from Heaven saying "This is my Son, whom I love; with him I am well pleased.” Angels cannot create life. So who can it be that opened the Heavens that has such power? Note; Thus took place before eye witnesses. This was not a personal hidden revelation. This happened before a crowd. With the love of Jesus Christ, I kindly encourage you to seek out Jesus Christ. He speaks in parables, because the true meaning is for those who believe in Him to understand His words of life . [Matthew 13:10-15] 10The disciples came to him and asked, “Why do you speak to the people in parables?” 11He replied, “Because the knowledge of the secrets of the kingdom of heaven has been given to you, but not to them. 12Whoever has will be given more, and they will have an abundance. Whoever does not have, even what they have will be taken from them. 13This is why I speak to them in parables: “Though seeing, they do not see; though hearing, they do not hear or understand. 14In them is fulfilled the prophecy of Isaiah: “ ‘You will be ever hearing but never understanding; you will be ever seeing but never perceiving. 15For this people’s heart has become calloused; they hardly hear with their ears, and they have closed their eyes. Otherwise they might see with their eyes, hear with their ears, understand with their hearts and turn, and I would heal them.’ Jesus is referring to Himself as the one they should turn to in order that He would heal them. To be cured from this, our only option is Jesus Christ. No man on earth can provide what Jesus promises. Jesus is not just a "mere warner". He is the Messiah sent to save people from every nation and tounge through Himself because God the Father has given Him all authority to pardon the criminal who comes to the Son of the Master to be pardoned. But know this, His words are Life, if you seek Him with your whole heart you will find the truth and the deeper meaning in His parables. Also. Know that whoever honors the Father honors the Son, but whoever does not honor the Son does not honor the Father and eternal life is not in him. [John 5:20-24] 20For the Father loves the Son and shows him all he does. Yes, and he will show him even greater works than these, so that you will be amazed. 21For just as the Father raises the dead and gives them life, even so the Son gives life to whom he is pleased to give it. 22Moreover, the Father judges no one, but has entrusted all judgment to the Son, 23that all may honor the Son just as they honor the Father. Whoever does not honor the Son does not honor the Father, who sent him. 24“Very truly I tell you, whoever hears my word and believes him who sent me has eternal life and will not be judged but has crossed over from death to life. The Baptism of Jesus 13Then Jesus came from Galilee to the Jordan to be baptized by John. 14But John tried to deter him, saying, “I need to be baptized by you, and do you come to me?” 15Jesus replied, “Let it be so now; it is proper for us to do this to fulfill all righteousness.” Then John consented. 16As soon as Jesus was baptized, he went up out of the water. At that moment heaven was opened, and he saw the Spirit of God descending like a dove and alighting on him. 17And a voice from heaven said, “This is my Son, whom I love; with him I am well pleased.” Please. This Gospel has come to the world through literally, blood sweat and tears. Jesus has revealed everything we need to start our spiritual journey with Him and gain wealth that cannot be stolen or for moth and rust to destroy but to have all our spiritual needs met in the Son of God. No Christian believes God had a wife and had sex to produce offspring, but rather a miracle of God. Sent to save us who believe Him as the Son of God who will redeem those who repent and turn to Him that they would be healed. Jesus said: "I am the Way, the Truth and the Life. No one comes to the Father except through Me." Will you come to Jesus to be healed, redeemed, and assured of your connection with God and eternal salvation? Or will you reject the Son and the Father also only to go before His Throne who has heard a loving warning, and denied it and also the hand of God that reached to you through Jesus so as to build a relationship with you, purify you, transform you and meet all of your spiritual needs in Christ Jesus because of the pride of dead religion, having an outward appearance of holiness yet denying God's power in Christ and remaining "Though seeing, they do not see; though hearing, they do not understand." (Matthew 13:13) And depart where there is a weeping and gnashing of teeth where there is the great divide away from God in darkness and torment forever. Will you choose Jesus Christ? Or the pride of dead religion?

Evidence points to the Quran being mostly an Aramaic, non-trinitarian Christian Lectionary. Islam has no religious presence or identity in the 7thC. But there is a lot of polemic evidence of Anti-Trinitarianism. Including the earliest dome inscriptions on the Temple Mount. It isn’t coincidence that Jesus is referenced historically as MHMD. Mohammad was never one person. It was a title awarded to Jesus that the Arabs perverted references of, in creating their own messianic prophet.

Even today there are books that Non Muslims have written calling them Qurans especially after 9/11 who is to say this book is not simply an Arabic, purposeful, misinterpreted version of a Quran just as Dr. Hiliali say her work was a subjective exercise.. These two are having two different conversations. One who is trying to figure out what is going on in a text and the other is trying to prove that the Quran is not real, Learning to read the Quran has many,many rules in order to preserve it. As well as reading the Quran by different ways, there are 7 rewayyas in reading which are different pronunciations which are used to help deal with the variety of accents so that the Quran should never be lost and should always be preserved. The lower text could be just recycled.

A man of God/final messenger sent from a HOLY GOD should also be holy and not debased like he was! According to the Quran, even Muhammad prayed for forgiveness but there is a sinless one - Jesus. even the quran dont dare to claim he sinned and agrees with the Bible that Jesus is sinless and born miraculously from virgin birth. Devout muslim here and a big fan of your work. Even though you mention intellectual honesty is a given, I very much appreciate you stressing it as well. Dr B. Did I understand correctly that Dr. Asma commented that canonical variations is another term for qiraat? What is the difference between variations and variants? Dr. A’s conclusion regarding the lower text I think is brilliant. You mention that laa taqul bismillah could also be read as al anfaal given the textual skeleton, what in your opinion given the context is stronger opinion?

No you dont... the muslim claim is, the quran we have today is preserved and goes back to the prophet of islam.. there is nothing in this video or in any other video with quran variants that makes this claim false.... Every single word of the quranic manuscript we have today can be traced back to the most anciant manuscripts... it does not matter if we find qurans with errors or variants..... the muslim claim is that the quran we have today is preserved and goes back to the prophet. Here is another leading scholar on the subject: "The Codex Amrensis 1 was among the examples that illustrate the existence of an ancient pattern of transmission whose characteristics closely resemble the Vulgate Qur’anic. The manuscript was probably produced in the first half of the 8th century by a professional copyist, although is small in size (which is related to its horizontal orientation) and bears evidence of an attempt to economize parchment". Cellard mentions that only 20% of the manuscript remains, although its construction indicates that it originally constituted a complete, possibly several-volume Qur’ān: "Among its important textual features is that the order of surates and verses conforms precisely to the order of the standard edition of the Qur’ān. The text is also identical, with the exception of several copyists’ errors (which are common in any handwritten text). There are a number of orthographical variations, particularly linked to notations of long vowels that are indicative of an older version in the in-progress Arabic writing system. But this manuscript was clearly already part of a pattern of highly controlled written transmission of the Qur’ān". Dr. Eléonore Cellard This is what muslim claim is and no variants or scribe errors can falsify it....

Thank you for this video I personally shear the same thoughts as Dr hilali we need to study the historicity of the manuscript and put it into context. The Quran was revealed orally and by this time the language was evolving with different dialects and diacritical markings introduced so when people like a Bedouin Arab heard the Quran his writing may/ may not have long vowels or certain letters was left out etc..the manuscripts are in different writing styles also eg..kulfic, Hijazi etc. Like the Sanaa palamsis was a school activity like we have today as we memorize portions of the Quran we try to write it from memory then check our mistakes etc.. For this reason Muslims have said the Quran is preserved as the oral readings are intact and is reviewed at least 5 times per day in the salawaat. It was a Good discussion.

[The Qur'an] is strikingly lacking in overall structure, frequently obscure and inconsequential in both language and content, perfunctory in its linking of disparate materials, and given to the repetition of whole passages in variant versions. On this basis it can plausibly be argued that the book is the product of belated and imperfect editing of materials from a plurality of traditions.1 This is the conclusion Michael Cook and Patricia Crone came to after following the scholarship of Dr. John Wansbrough. The argument is that textual analysis of the Qur'an will lead one to realize that Islam's holiest scripture is actually nothing more than a compilation of variant traditions; traditions that were floating around at the time of the book's writing. The claim that the Qur'an is the word of God is, wholly unsupported. This is a claim that Muslims accept on blind faith. The style of the Qur'an is something that will undoubtedly come up when putting forth any theory about the Qur'an's origin. The Qur'an, is narrated in the first person. It is generally presented as God's word to Muhammad. The variant stories presented in the Qur'an result in the Qur'an as not always presented as the speech of God. One of the many variants is when Muhammad went from Mecca to Jerusalem, stopping at the al-Aksa Mosque. The problem is, the al-Aksa Mosque in Jerusalem was built roughly 46 years after the traditional time given for Muhammad's death. Therefore, if this verse is in fact claiming that Muhammad paid a visit to this Mosque, one would have to conclude that the verse was an interpolation added into the text. Zulfikar Khan's essay "Koran - The Ultimate Truth"is an unflinchingly brutal attack on the Qur'an's integrity, which focuses mainly on the issue of contradictions in the text. Zulfikar Khan exposed numerous contradictions in the Qur'an, and there is no doubt that Muslim apologists will offer all kinds of wild confabulations in an attempt to reconcile each one. It is quite obvious that in the world of apologetics, such characters are more than willing to sacrifice their intellectual integrity in order to salvage their cherished beliefs. Numerous conflicting statements in a text is a sign that the text is from a plurality of sources. The reality is we have no reliable sources from which we can make any decisions with regard to the role Muhammad played in the creation of the Qur'an. The Qur'an itself tells us nothing, outside of a few ambiguous mentionings of a certain muhammad, or "praised one." All information on Muhammad, who he was, his interaction with Jibreel, his prophethood, et cetera, are derived from a highly questionable source: the ahadith. These are traditions that were, for the most part, written down and compiled more than two hundred years after the events they are allegedly relating. In fact, by the admission of the Muslims themselves, the most respected ahadith are those compiled by Imam Bukhari, who died in the late ninth century (roughly 870 CE), nearly two hundred and forty years after the time that Muhammad allegedly lived. Furthermore, the dating system of the early Muslims is so weak that the issue of the gap in time between the writing of the ahadith and the events they are reporting becomes even more of a problem. According to Islamic tradition, Muhammad was born during 'am-al-fil, the year of the elephant, which was allegedly 570 CE. This was, according to Islamic folklore, a year that many of the pre-Islamic Arabs remembered, because it is when an army of Ethiopian warriors on Elephants was repelled by birds throwing stones. Following that, we get another tradition that tells us that Muhammad was called to prophethood at the age of forty (approximately 610 CE). It is from here that the Islamic calendar starts, based on a shaky tradition, that is itself based on another shaky tradition, and therefore it is totally unreliable. Muslims will, no doubt, demand that we accept the highly tendentious ahadith collections as a reliable source of information, but there is no real reason to do so. Many of these traditions contradict one another, or are of a highly absurd nature. Even worse, the Qur'an itself seems to warn the believers against resorting to any hadith-based information. One verse of the Qur'an warns against those who spread "frivolous stories" (lahv-al-hadith), and yet another says, in a very straight forward way: "tilka aayaatullahi nutloohaa 'alayka bil haqqi fabi-ayyi *HADEETHI* ba'dallaahi wa aayaatihi yoominoon," or "These are the revelations of God which we recite to you correctly; in what hadith other than God and his revelations will they believe?" From the literary point of view, the Koran has little merit. Declamation, repetition, puerility, a lack of logic and coherence strike the unprepared reader at every turn. It is humiliating to the human intellect to think that this mediocre literature has been the subject of innumerable commentaries, and that millions of men are still wasting time absorbing it. This description of the Qur'an by Salomon Reinach is rather fitting, particularly the part about repetition. One would wonder why the same statement needs to be said over and over again if it is from a single person. What is worse, many of these duplicate statements differ in context and wording. Once one is aware of this, it is easier to understand the theory that the Qur'an is a work of multiple hands. The Qur'an is given to repetition of whole passages of variant versions. Blatant contradictions have been shown. How can we conclude that this text is the word of an Almighty God, or even a single Arab nomad? It is quite clear that the Qur'an is, as Cook and Crone said at the outset, "the product of belated and imperfect editing of materials from a plurality of traditions." There is simply no other possibility. Whenever the Qur'an was compiled, its compiler(s) took numerous variant traditions into consideration, and included many, or even all, of them into the official cannon. The result is the Qur'an we have today. Orientalist scholar Dr. Christoph Heger wrote: The transmitted Qur'an is the work of multiple hands, comprising texts of different origins and having gone through various stages of editing. It is a really rewarding target of scholarly research to discover these various origins and strata.

JESUS COMMANDED TO THE FOLLOW JESUS, JESUS NEVER COMMANDED WORSHIP OF JESUS. @@channelone3773G I know that many people assume that the accounts that were written quite a bit later are true, and I am not saying for sure that there is not truth contained in them. The question is, how do you know that a specific claim contained in the histories (such as any of those you have mentioned already) is true? It is one thing to say that you believe because you just trust al-Ṭabarī and others (concerning that point), but for historians who are trying to reconcile all the evidence, we need to rest our conclusions on evidence. When different pieces of evidence seem to contradict each other, then these contradictions must be resolved. So, you have ninth century purported historical accounts, and then you have 7th and 8th century manuscripts, and you have inscriptions (such as the Dome of the Rock), and you have coinage, etc. All these things should be taken into account. It may be easy to say "Oh well, the physical evidence does not matter because someone said that people had the Quran preserved perfectly in their memories," but that claim cannot be verified apart from the physical evidence. In other words, you can believe it, but for a historian we cannot state it so confidently -- especially when the early historical sources have been demonstrated to be unreliable in so many places. Fred Donner has dealt with this very nicely in his book "Early Muslim Conquests." Among scholars, the problems in the historic accounts of the time are well-known and acknowledged.

Definition of thw Quran is: "the revelation revealed from God, to the Prophet Muhammad (peace be upon him), via the angel Gabriel, passed on via mass transmission, whether orally or textually." Based on this definition, anyone challenging the Quran must find something added or removed from the Quran, by someone other than the Prophet Muhammad. This you wont find. Btw, all the" variants" are taught by the Prophet and fit the above defintion. Therefore, it still counts as part of the preserved Quran. I imagine many people wont understand what i just said.
