Can't help but notice that the first officer who was sooo sure he was legally seeking to get an I.D. unlawfully detaining citizens and violating fourth and first ammendment rights, completely disappears as soon as it's established, that the cameraman never committed ANY crimes. 6:17 Dont attempt to pass the buck onto your IT department. I work in IT, and have for over 20 years. Every government organization has policies in place barring such practices. Its data security 101. 10:49 Wait. Is he suggesting he didn't realize all data containing work information when working for the government falls under data retention policies? I mean every policy I have read makes it clear they are. These policies are public record and many states and federal organizations make these policies available online to read yourself. Its also likely they had you sign this policy when you started working for them.

This kind of casual sloppiness regarding emails is probably pervasive throughout government and this is the fault of the government itself caused in large part by a lack of continuous training and monitoring, administrative laziness and possibly done purposefully with the direct intention to avoid FOIA, a designed loophole, Rules for Thee but Not for Me.

If you are a federal employe any email you make related to your work, is a federal email and is required to be archived. He was some kind of high ranking member of "Tonys" team. He knows what a archived required email is.

No doubt. I worked with civil service employees my last five years in the USAF at Robins AFB Georgia. I had been in the AF for 15 years when I got stationed there, and I had very limited experience working with non military federal employees. The majority of people in the rank and file were hard working, honest people. Many of those in the higher pay grades were just like this guy. The promotion system is very political in those higher positions, and they want "yes" men, and women who'll never rock the boat. The system is broken.

As someone in IT, we do not put applications on a users personal or work phones if we are using an MDM software, it will simply add a work email to an official app such as IOS mail or Android mail and secure the phone only, it would never add third party mail apps such as Bluemail which he is referring to which manages multiple email servers. iTunes Company Portal did not exist back then for Microsoft MDM software. In which case I can assure you he is 100% lying.

Yeah, I'm definitely not buying that he didn't know what a federal record is. He gets mandatory training on it every year. Almost every document, including email, generated by your agency is a federal record. That said, he is probably right about how deleting emails works. Those are stored on a server/cloud somewhere and you should be able to delete the local copy from your machine without totally erasing the permanent record from the server/cloud. Whether that was the case in 1998, I don't know. But nowadays, definitely. Otherwise they would have removed the option to delete from the email client altogether as security control.
