This guy really doesn't know what he's talking about. It does affect fulltimers that work and in a major way. If SD won't accept the employers (fed required) unemployment ins paymets, then the employer has no choice but to send them to the state of the employer. This also means they are reporting the income of the employee to that state. Now, the employee is stuck trying to tell a state that they may never have set foot in, that their entire income is not taxable even though their W2 shows it is. Filing a non-resident tax return still leaves you paying something. Unless you do shady crap like saying you moved in on Jan 1 and moved out on Jan 2 and you're a "part time" resident of 1 day, you're paying a substantial amount of tax to a state that you aren't leagally required to.

Thanks for your comments. You are wrong on all accounts however. SD specifically allows you to claim residency and get a driver licence in the state. They have a specific for full time travelers. It's directly on their state DMV website.

@businessanywhere Jesus, you are dense. Sure, they'll let you claim residency. That's not the problem. The problem is they won't let your employer pay them unemployment insurance with a PMB address like fulltimers have. Since employers can't pay the insurance to SD, they can't report the employee income to SD either. It gets reported to a different state and you get exactly the situation I correctly described in my first comment. You obviously don't understand the problem. Please stop trying to tell people that are experiencing it, that it really isn't happening.

Further, this is just the real-world, actually happening impact. Consider a "what-if" scenario. My employer has been forced to send it's unimployment insurance payments to AZ instead of SD. Now what happens if I actually need to apply for unemployment? Who do I apply with? SD? No, SD wouldn't let us pay the premiums into them so they'll say no way. AZ? We paid into AZ so I should be elligible for the benefit right? Not likely. I am 99% sure if I had to apply to AZ for unimployment they'd tell me to pound sand. They'll say nope, you didn't live here, we're not giving you squat. It won't matter that they were getting the premiums the whole time. It's just a nightmare in wait for anyone in this situation if they ever needed unemployment.

So if we live full time in our motorhome and use south dakota as our address through a mail service in SD and do work camping gigs in different states how will this affect us?

So, as a full time RVer, I set up SD as my domicile, and work remote for another company. My only residence connection is SD, but I cannot use my SD address as my “home address” for work any longer. It does affect full time RVers with no other residence connections to another state. Additionally, I am working for a Virginia company out of a Colorado location. I suppose o say all this to note that there are those of us full time RVing who were directly affected by the change to the way SD dept of labor classifies our residence.
