Weirdly enough I kind of meet Ken at a comic convention of August 2023 with a friend He wasn’t at his table but his wife and Ken was getting a autograph of shatner but I did see him out of the corner of my eye when I was walking around the convention and to me that was surreal But I did show his wife my Archie sonic collection and he was selling the original comics for 100 hundred dollars I didn’t get them but I did got a patch

Speaking of time, what would happen if Ken would die? Could Sega regain the copyright? I know at least no one has real copyright towards the characters.

On the one hand, writers and artists in the comic book industry are rarely compensated for the work they do. Honestly, Ken should own more of his own intellectual property. But only what he actually came up with. On the other hand, Ken is such an asshole online it makes it really hard to be sympathetic. The art he's produced since is so ugly it makes you believe Sonic succeeded despite him and not because of. His comments towards Ian Flynn have been unprofessional at best and downright mean at worst. Not to mention, so much of what he wrote was just awful. Flynn is going down in history as the guy keeping Sonic afloat, next to names like Tyson Hesse. Penders will go down as a sour asshole who ruined everything for himself and others.

I actually emailed Ken about this asking if he had paperwork showing he owned his characters... He straight up said he didn't have anything because "Sega and Archie were too ashamed to have a paper trail." No no no no Chief you either have papers or you don't own shit

While your conclusions in this are correct, they are overshadowed by the reality of the situation; 1.) Archie is never going to have any interest in going after those characters, now that they are forever done with Sonic, 2.)Sega- who doesn't even want to use old other media characters they own (SATAM, AOStH, Underground, Sonic X, and the OVA), is NEVER going to even bother to challenge Penders on these character -THEY JUST DON'T CARE. 3.) So, since no one will ever challenge his claims of copyright ownership, yeah, he kind of owns them by default. He's the only one who is ever going to use these characters in a commercial product of any kind going forward. For him to 'not own anything', the copyright claims he filed would have to be contested, they are still filed, and no one is contesting them any longer. Sega could challenge his Copyright, but they won't even bother. Nothing is stopping his claim from legally standing. As much as all of us in the fandom are unhappy about it.

Most of your points are valid but you are wrong about one thing Sega not caring applies to us as fans as well because they don't care about us making so much money or commercial use of the characters for our fan projects such as fan animation or making artwork of the characters and selling it they're not caring mentality applies to us ask fans as well not just Ken The only exception being not to make money off of fan games simple as that

Technically are there 2 factions that still could care. IDW if they ever feel like reprinting old Archie Sonic issues the same why they did with some of there other IP's that they licensed like TMNT and Transformers. and Paramount Pictures if the Movies for any reason want to use any of the characters and or concepts originating from the comics.

@@rynobehnke8289 I don't think either of those will happen, because Sega is insistent on licensors avoiding using archie content. You're more likely to see the SATAM freedom fighters updated and put into the movies, than anything Archie.

Ken owns nothing, legally. Functionally, he's the only one who cares. I still can't wait to see if he ever releases the Lara Su chronicles. Not because I think he'll somehow pull a W and make something worth reading, but because my morbid curiosity demands I see how high the trashheap will pile.

I'm honestly just waiting for the day Ken passes away. He claims to of made a lot of characters, but never bothers to just let Sega keep going its own way as he can clearly make up his own characters for his own stories. He quite literally never needed to be such a petty asshole to drag things into court, but he did. And now... despite some of the good he's done, he'll always be remembered as the most petty person to have ever worked on Sonic The Hedgehog media. As for the ugly comic he's working on, I have tried my damnedest to find 'certian' artworks of it, aside from what little we got and found nothing. Honestly... it's an achivement to make something so ugly that nobody wanted to make any fan art of it in the style its in.

After seeing the original vid and this, I personally think perhaps it'd have been better if the settlement of the Archie case never happened and it was instead given to the jury, considering the common folks *should* recognize Ken's work as being a licensed Sonic work first and foremost-- thus giving Penders a much larger chance to lose the case than Archie, even if Archie's legal team totally blew the actual court case.
