What about if you're just a sole proprietor? Would I need to trademark the business name? I am wanting to be a full time artist to it would be ~insert brand name here~ Studio. Can I even file for that if I dont have an LLC?

Question I have a legal company name in which my competitor may The Trademark which is similar to my legal company name. His trademark is in the final stages of approval and mine is still pending. I was reading the files and it said the examiner found no conflict between pending (mine) and the mark that is in the final stages of approval. If the examiner found no conflict does that still have legal grounds for a cease and desist after approval? If my mark is similar to the one being approved but the examiner found no conflict in order to approve my competitors would he be able to tell me to stop using my legal company name?

Well, sort of. We don't get any special treatment, but chances are we won't make the mistakes that will hold up your application either. I see lots of people file on their own and make avoidable mistakes that will delay their registration or even cause their application to get denied.
