My dad used to do EXACTLY what he's talking about and made good money doing it. He used to track down the people who were owed money and got paid to get their money to them. This was totally legit!

You were paid out of the proceeds the homeowner received. The rip off was that thousands and thousands of people were paying $60 for this "business" so instead of a few hundred people pursuing this business and making a little money, you had thousands of people making next to nothing, if they made anything at all. Potential customers would receive hundreds of letters from people pursuing this and, if the potential customer figured out why they were due some money, none of the people sending letters would get anything. i doubt that most of the people that bought this material ever made a dime. Well, except Don Lapre selling his material made some money.

One of the main charges against him was making outlandish, unsubstantiated claims for his products. But isn't that pretty much what all marketers do? mlm, gym equipment, makeup, all the crap on QVC - all made to sound better than it really is. Why doesn't the makers of ShamWow the magic cleaning cloth go to prison? This worthless stuff has been hawked for decades on tv.

I think part of it is because it's one thing to exaggerate how awesome a product is, it's another to defraud people by offering services that do not do what the sellers say they'll do. That's what ended up screwing Don Lapre. Infomercials claiming ShamWow is the best damn cleaning cloth ever made are legal, provided it *does* clean. But if they claimed ShamWow can cure cancer, that'd be illegal.

There's a name for that. It's "puffery,"which is legally permissible. Saying that "Our hamburgers taste the best" is puffery because it can't be proved or disproved. Saying that "Our hamburgers are the healthiest" is fraud unless you can prove it.
