California makes it a crime to record or eavesdrop on any confidential communication, including a private conversation or telephone call, without the consent of all parties to the conversation. Penal Code § 632. The statute applies to "confidential communications" -- i.e., conversations in which one of the parties has an objectively reasonable expectation that no one is listening in or overhearing the conversation. Flanagan v. Flanagan, 41 P.3d 575, 576-77, 578-82 (Cal. 2002). A California appellate court has ruled that this statute applies to the use of hidden video cameras to record conversations as well. See California v. Gibbons, 215 Cal. App. 3d 1204 (Cal Ct. App. 1989). Why does he want to record what they're doing, saying or working on in their office, again? Why does he need to see Federal mail? Does he work for the USPS? Is he a Postal Inspector? If not, he needs to STFU and keep on moving. If you are operating in California, you should always get the consent of all parties before recording any conversation that common sense tells you might be "private" or "confidential." In addition to subjecting you to criminal prosecution, violating the California wiretapping law can expose you to a civil lawsuit for damages by an injured party. See Cal. Penal Code § 637.2. This applies to any citizen in the lobby in situations like this, as well. They have a reasonable expectation and right to not be recorded on video or audio as they transact their business in a city, state or federal building. Period. Michael Keegan, the chief of public and legislative affairs for the Federal Protective Service, told the media in a statement that the settlement between the government and Musumeci "clarifies that protecting public safety is fully compatible with the need to grant public access to federal facilities, including photography of the *exterior* of federal buildings." Again, do you see how many times that the rules say *EXTERIOR* as public property? Interior is not public property. They do not say INTERIOR and this guy does not work for a news agency. If he did, he'd be fired quickly for the way that he acts. He's not 'press' by any means. Senate Bill 411 does not say inside of a State or Federal building. Again, those are not public areas. People don't seem to grasp that there is no such thing as a Federal/State/City building belonging to one or more citizens in general. The employees do not 'work for' YOU as a citizen. Incorrect. Just like the road doesn't belong to you, but taxes of everyone pay for it for the common good. It's not your property. Look up the literal definition of public servant: noun A person who holds a government position by election or appointment. someone who holds a government position (either by election or appointment) They have the right to go about their workplace in peace without harassment from an outside citizen.
