The original statutes passed by congress authorizing special council appointments were limited in time frame and have since expired. Garland had no authorization from congress to appoint any special councils Nor was the proper procedure followed to begin with. The person must be nominated by the president, and then confirmed by the senate.

He asked Cannon to appoint a Special Master to determine which documents were personal and which were government and suggested a specific Republican FISA judge. DoJ immediately agreed. Instead of making that decision, the SM asked DT to state on the record which were which. Cannon said DT didn't need to and dissolved the SM.

There's a process for appointing a prosecutor and they didn't follow it. Since this was an appeal judge, the judge took the first legal error presented to her that would kick the trial to the curb. It wasn't the only legal error that disqualified the trail, it was just the first of many. Too many screw ups by the court and prosecutor. To top it off what Trump did wasn't illegal in the first place. Trump's conviction was never stand up on appeal. Heck I'm not even a lawyer and I could have won his appeal. The trial was joke.

Presidents are the only folks who have full discretion and authority to possess and keep classified records after they leave office. NOT Vice-Presidents, NOT Senators, NOT congressional Reps, NOT judges, NOT agency heads, NOT their wives, NOT their pals, and NOT their business partners. Presidents during their term of office have full authority sand discretion to DE-Classify documents. Senators, and nor Vice Presidents NEVER have such authority. EVER. The fact that an administration chooses NOT to prosecute, or otherwise turns a blind eye and ignores criminal behavior by pals, buds, besties, family, campaign contributors and other suchlike people, *_DOES NOT MEAN that a CRIME is NOT a CRIME._*

This is our news media. She neglects to mention the Difference between Mueller and Jack smith which is at the route of the issue. MUELLER had been approved by congress while Jack Smith was never approved by congress. He was acting as an Officer who answered to noone. He was not an inferior officer. Garland could have chosen from any number of Lawyers who had been previously approved by congress. Jack Smith was a private citizen with TDS who had unlimited tax payer funding to get Trump. Smith had argued both that he was an inferior officer and a superior officer depending on the argument before the court. No self respecting council approved by congress would have ever taken this case. Jack smith is a dirt bag.

She left out the fact that SCOTUS justice Thomas wrote a concurring opinion on Trump’s immunity case that seriously questioned the legitimacy of the appointment. BTW the SCOTUS district that covers this case is under Thomas’s jurisdiction. The likelihood of success on appeal is very slim.

Garlands apointment of Smith is invalid anyways because the statutes cited are not valid spending clause statutes because the bills involved did not first originate in the House as required of all spending clause laws. This means Mr. Smith needed a seperate congressional approriations law introduced first in the house of reps and then passed to the senate.
