Driver Harasses and Threatens to Kill Me Because I Won't Move Into his Imaginary Bike Lane

We're on Lake Murray Blvd heading for the 8, when a driver honks at me and tells me to move over. You hear my response, and that sets him off into taunting me, then threatening to kill me, then punish passing me, and continuing to yell at me to use the bike lane that isn't there, until he delays traffic continuing to yell, and I'm back in the bike lane.
By all means, avoid this guy driving a white Jeep, CA 9HDH217, but don't lose sight of the larger issue: this crossing is designed for these kinds of conflicts to happen. Caltrans needs to make it safe to cross the freeway for people outside of cars.
Also, I sent this to the La Mesa PD in hopes they'd cite him for reckless driving and threatening to kill me with his car, but I was told my Officer William Wilson that he doesn't think it was that bad, and that is was partially my own fault for reacting to the aggression. Good ol' fashion gaslighting and victim blaming. He said that the driver is wrong, and maybe they'll talk to him to "educate" him about how people on bikes can use the road. All I learned in this process is that the police don't actually protect people on bikes. I already knew drivers were unhinged.

These videos can be scary, but please know that my goal isn't to deter people from riding bikes in San Diego, but to show the real-world conditions. Sometimes it's pleasant, sometimes it's just fine, and other times there's tension and conflict.
The roads in San Diego should be safe and accessible to everyone without the use of a car. My hope is that these videos help those in power make better decisions for all our safety. I also believe that the more people who decide to ride, the safer the roads will become.

Yup. America is a cesspool of f'in AHs. It's not going to be fixed in our lifetime. If you want to live a bike life, San Diego ain't the place, unfortunately. Cops are not going to help you. They're jerks themselves and may make things worse.

That’s why I don’t ride bikes. If my city had practically laid out bike paths (instead of just a 2 miles stretch on the outskirts of town that serves no real transportation related purpose), then I would ride my bike.

In Los Angeles you would have won a $1,000 lawsuit from the driver because we have an anti-harassment bicycle ordinance in our city. You would have won for sure because you can't honk at a bicycle rider to distract them and you can't punish pass a bicycle rider.

Thanks, @mariusfacktor3597. Officer Wilson told me that they can't cite people for infractions based on video evidence, and have to see it in person. I wish we had your laws, as well as the kind in NYC where people can film idling trucks, send it in, and get a portion of the ticket pay. If we had that for drivers who park in the bike lanes in San Diego, well, a bunch of us would be riding nicer bikes!

​@@RidingBikesinSanDiego - We have the same "LEO must witness it" laws in Nevada. But now, they have cameras all over the valley, and live feeds to a hub with LEOs watching. There is another way, though. The LEO won't cite a traffic infraction, but you can press charges for threat and assault, and take the driver to court for that. If you genuinely feared harm or death, you may have a case.

I filed a similar complaint against an officer and his 3 supervisors, because they all agreed "that's what you get for being out there" and "you're out here looking for it and that's why you have a camera." I swear that Ashley Neal has an in with the police in the U.S. LOL

It doesn't surprise me that the cops were useless. I've had them run their sirens and get over the speaker to tell me to get off the road, despite my states law saying what I was doing was legal.

I don't know who has jurisdiction where; I do know that Officer Wilson told me the guy wasn't being that aggressive and that "I'll kill you with my car" isn't actually a threat, so what do I know

@@RidingBikesinSanDiego The reason I ask is because you said right before the truck appeared that you were entering the CalTrans area. So it's certainly possible Wilson didn't know or want to tell you CHP could/would deal with the issue. I'd expect CHP to have a much less dismissive attitude when it comes to aggressive driving. It might be worth an innocent call to find out.

@@RidingBikesinSanDiego this is why people need to have mandatory drivers test every 5 years. specifically in the new vehicle laws implemented in the last 5 years. but that won't happen because driving is mandatory in CA. it's not there are youtube channels that talk about how to ride bikes in CA

My brother was intentionally run over in 5pm traffic in San Francisco for an interaction similar to yours. Be careful you are the softest material on the road. Broke pelvis in 2 places when the car traveled over him.

@@RidingBikesinSanDiego it was their first offense so they were let off with no charges. Even after the driver tried to pull the bike out from under the vehicle in an attempt to run. He is fine and back to riding but it’s not worth it.

You said he needed to be in a completely separate lane when he passed you. Wouldn't that mean you weren't allowed to lane share when you pulled up to the car at that second light? Truly curious. Don't know the laws in your state.

Thanks, @jmrandom194. I appreciate the question. A driver has to change lanes before the pass, because they can kill a cyclist. I don't have to change lanes, and my position at the second light is on the line between the straight lane and the turning lane, and once I cross the intersection, I'm in a painted bike lane up the hill.

That guy was being a jerk.. I’ve had times where I was going to be late for work though because someone is traveling in the only lane of travel going half the posted speed and accelerating slow from stops it does get annoying.

I hear you, @JesseSkwierawski. I think it set me off in a different way because I was slowing for the red, which is an unusual time for someone to honk. I've come to expect it more on some straight-ways. His chirping from the start, telling me to move over, was also where we were after the horn.

The sidewalk, in this case, isn't safer than keeping the lane and going straight, as the sidewalk cuts over the cars accelerating to get on the freeway. Also, once over the bridge, the sidewalk has all kinds of obstructions built into it that a bike can't easily get by.

Bikes and cars don’t mix. This reminded me of the day I was at a red light, a woman passes by on her bike and I watched a car run her over. The car never stopped. Another driver stopped and ran across the street to the fire department for help. She was ok and then she wasn’t.

Well, you can be in the right, or you can be in the right and cooperative. When I role into an intersection like that, I tend to be close to the right line. This way if a car driver wants to turn right, they have room and the turn lane to do so. Drivers behind me usually know that as the light turns green, I will move over to the right giving them room to pass. Plus, I learned a long time ago, A soft word turns away wrath, but a harsh word stirs up anger.

Thanks, @markguido9530. The camera wasn't on, but I had a guy honk at me a few days before this, and I gave a friendly wave. At the next light, he rolled down his window, leaned over his kid in the front seat, and must have said "f-you" to me 4 or 5 times. The only thing I said back was, "You talk like that in front of your kid?" Angry drivers are going to be angry, and I think it's misguided to put it on the people quietly using the street on a bike.

@aye54 Thanks, and you're right that I could chill. But I'd argue a few things. First, I never say "Fuck you," I say "You don't have to honk at me. You'll fuckin' wait." There's a difference. Also, who needs a gun when they're pointing a car right at you? People always say "what if they have a gun," but a car is a fine weapon. You can kill someone in the US with a car, and face almost no penalty at all...

To put a person in a car on equal footing as someone on a bike is silly. But the goal posts are always moving in favor of drivers.

That jeep guy initially just got your attention and pointed to the right lane like stay on the right bro, he wasn't being rude or anything as he didn't slam on his horn, he was even confused with the biker's instantly aggressive and mental reaction and made a hand signature like "da fauq?" then he got pissed. It takes two to tango if the biker wasn't acting like an angry child at first and started his interaction normally, that the guy would most likely be like oh my bad i am an idiot didn't realize right lane was right turn only. You reap what you sow. I am not defending the jeep guy's actions by any means but simply pointing out this was solely escalated by the bike's initial reaction and response, so easily avoidable. I wouldn't dare find out if the guy in a car is crazy and going to pull a gun on me or run me over if I was on a tiny bike.

@gandhisFlipFlops What you might not understand here is that horns are always aggressive. He doesn't have to use it, yet he does. But, sure, go ahead and blame the guy on a bike instead of the guy in the car. You mention a gun, but who needs it when one's ankle is hovering above the accelerator of a 4500 lb bullet? Every car is a weapon, and every driver is constantly on the trigger. There's no safety for people outside the cars.

@@RidingBikesinSanDiego That is a very subjective opinion to find horns in any context and situation to be aggressive. I think most people would have quick tapped their honk. Why open the window and yell just to hope you hear or look? work smarter not harder. Things and words aren't offensive unless you make them to be. Everything is in your control when it comes to your emotions and perspectives. You can get mad at an idiot flipping you off or you can laugh at them for example.

Why not middle or right of the lane but as close to the cars as possible is it another opinion widely shared by people who ride bikes? In this particular spot, I stick to the middle or left of the lane because it gets me out of the way of the drivers behind me who are using this same lane to get on the freeway to the right. Sometime I'm to the left or middle in a lane to get out of the door-zone of parked cars. Sometimes I'm in the middle or left because the right has more pothole damage. No matter my reason, I'm riding where it's safest for me, and anyone driving behind me will have to wait; I'm where I'm supposed to be for my own safety, and according to the law. I hope all of those answers make sense.

A driver of a motor vehicle shall not overtake or pass a bicycle proceeding in the same direction on a highway at a distance of less than three feet between any part of the motor vehicle and any part of the bicycle or its operator. The driver of a motor vehicle overtaking or passing a bicycle that is proceeding in the same direction and in the same lane of travel shall, if another lane of traffic proceeding in the same direction is available, make a lane change into another available lane with due regard for safety and traffic conditions, if practicable and not prohibited by law, before overtaking or passing the bicycle. If the driver of a motor vehicle is unable to comply with subdivision (c), due to traffic or roadway conditions, the driver shall slow to a speed that is reasonable and prudent, and may pass only when doing so would not endanger the safety of the operator of the bicycle, taking into account the size and speed of the motor vehicle and bicycle, traffic conditions, weather, visibility, and surface and width of the highway. 27001: The driver of a motor vehicle when reasonably necessary to insure safe operation shall give audible warning with his horn. The horn shall not otherwise be used, except as a theft alarm system which operates as specified in Article 13 (commencing with Section 28085) of this chapter. TL/DR: Trying to hit someone is bad. Bikes have the same rules of the road to follow as any other vehicle on the road. When passing a bike you must merge into the other lane of traffic to pass. Finally don't honk unless it is an imminent threat to yourself.

@@mariomcpokemon It is illegal to use your horn to admonish or intimidate. It's only for letting someone know you are there, such as a car backing out of a parking space who might back into you.
