Dr. Bricker: Nice presentation on EMTALA. You left out two important components. One, if you do have insurance, the insurance company is supposed to treat the ER visit as IN-NETWORK, regardless of the contractual relationship of the ER. Two, the "Layperson" rule. The Layperson rule says, if you, a layperson, believe you are having an emergency, then you ARE until a trained specialist (usually a physician) deems you are not have an episode of care that can cause loss of life or limb. As a Patient Advocacy firm, we handle this issue all the time. Insurance companies determining, after the visit, it was not an emergency and then refusing to pay. A few well written letters clears this up, but the insurance companies make you jump through the hoops to get paid.

I'd love to read an example of "a few well written letters..." to insurers reminding them that they do not diagnose or determine care. I always appreciate a great "you're wrong and here is why." Professionally of course!

For people who complain why healthcare cost is so high, and why health insurance is so high, THIS is why. Hospitals will make it up somehow, there is no such thing as FREE healthcare. Somebody is paying for it one way or another. Hospitals increase prices, insurance companies have to pay out more, and so they charge regular folks more for health insurance.

I thought that the law allowing non profit status was supposed to be a subsidy to deal with the cost of the uninsured?

This law only applies to hospitals that accept Medicare or Medicaid. It’s literally written all over

2:21-cv-05587 RGK-RAO , Im Chris Wilson and I'm suing St. Francis Medical Center in Lynwood CA for Emtala violations and neglect of medical duties. I have them in default for failing to respond or otherwise defend. Frcp 12. They have moved to set aside , is serving the registered agent of service the only way to sue a LLC? Because a hospital executive signed the proof of summons and has submitted declaration stating I myself tried to serve him, which is false and on camera , my friend she is the one who served the documents. The overall question is can a hospital employee, who is an agent of the hospital , accept on the hospitals behalf ?

Very nice video doctor What If women is pregnant in usa and she was here on temp visa visa expired she has no social security no no job no ID Will emtala cover her delivery charges in hospital Plus what are her options

Yes, Hospital has to admit her and deliver the baby. Patient still financially responsible. She will get billed by the hospital and if she does not pay, it will go to collections. In some states, the hospital can sue her in court and garnish her wages, but that has become somewhat less common. Difficult situation. Thank you for asking.

So what you're saying is, you'd rather have the tax payers all funding the hospitals instead of giant corporations. The EMTALA act should be for Americans, since Americans are the ones you want to fund it. Why is anyone and everyone allowed to come into this country and get free medical care, when the citizens of this country have to pay (by getting jobs with insurance)?

It should be the case that underage children always be treated and the government pay for that because nobody wants kids to suffer, but fully grown adults should have thought about what to do if they get sick BEFORE they decided to sneak into the USA. Why do you want our healthcare system to be like theirs (socialized medicine). If it was so great, why would they be trying to sneak over here?

This law was for under insured and poor united states citizens. Cause you know before Obama care health insurance didn't have to take or insure you if you had pre existing conditions to save them money. So not everybody was allowed access to health insurance and if you need emergency service they were not required to save you or take you. So yes this law was necessary and you are creating a fake issue by saying that only immigrants use our health care system when in reality united states citizen get surgery out of the country cause it way cheaper than the US.
