Thanks for the explainer Terry. Enoch has snookered himself. On the one hand the courts are illegitimate when they don't give him exactly what he wants and on the other they are legitimate when he goes seeking compensation all while being in contempt of a court order. That's never going to wash with the judiciary.

Hi again Terry, I wanted to separate my comments earlier from the Burke portion. My mother had a similar view as Mrs B senior. Her opinion was what she thought was from God and if I questioned it, which I did from age 7, it was the devil talking through me. I said goodbye to her w years before she passed. I never went back. Didn't attend funeral. There was no point. My wife, whom she treated with contempt went as did our children, and this was fine with me. Have I any regrets,,,not one. Do not be hostage to duty or sense of obligation. I had 2 years of depression in 2012- 14. Lost everything. Rebuilt my true self bit by bit. Evaluated everything. Mrs Burke has successfully educated her children, but in what direction? Can they have an independent future???. Regards Ger

They have education and qualifications to beat the band but absolutely zero social skills or any concept that anyone besides themselves has any rights at all. There's a real self absorption about the fanatically religious. In a way I feel sorry for them and hope that they can break away from the cult because their lives are going down the tubes fast. The parents have a lot to answer for here.

Well said Terry. As always, you've nailed it. It's amazing that even now, some people can't grasp the difference between personal beliefs and a society of laws, which is simply summed up with: You may believe whatever you want, but you may not do whatever you please. I think it's about time we made better use of our resources, detention should be for those who are a danger to society rather than those who simply piss society off. Perhaps, for those like the Burkes who simply piss society off and other non-violent lunatics who simply refuse to behave, our system should develop a series of fines proportionate to the offender's means. The system could be backed with automatic interest in the event of capricious non-payment, and leans on property, future income, social welfare etc., in a similar manner to the collection power in revenue. I honestly wonder if the afore mentioned were the case where the 'ungovernable' were forced to pay into the system they despise rather than the system effectively financing their bed and board, how many of them would be willing to stick to their interpretation of Iron Age principles by repeatedly breaking the law knowing that each incident would diminish their wealth, with repeated incidents only multiplying the factor by which it was diminished. It would certainly make me pause for thought. Anyway, keep up the excellent work.

Enoch Burke was framed. The judge said he was " trespassing " when he clearly wasn't. All the published videos/photos of him were on the public road, outside not inside the school. So,the judge is a liar. His court order is a sham.,Burke has a constitutional right to protest outside the school,once he does so peacefully. Therefore,his character has not been impugned by this bogus court order and he's entitled to compensation as his good name was thrashed by the Independent, who have apologised to him,and admitted they printed a pack of lies about him. The judge has issues. He needs to be removed as he's brought Irish law into disrepute, again. Irish women and men have taken to the streets in protest at yet another mad judicial decision not to imprison a member of the Defence Forces who savagely attacked a young woman and left her for dead. So,people who make such outrageous decisions need removing ASAP.

Ammi and Enoch Burke have racked up possibly >€500,000 in fines and legal costs. It looks like they have no intentions of paying any of that. At what point is a person denied access to the High Court service? They are clearly not interested in the authority or decisions of the court. Burkes have shown themselves only to be interested in theatre and making Xitter movies to stir up division. I wonder if their tax affairs are in order, they must be due a gift tax bill if they are being funded by other extremist radicalised groups.

A fine day you have there, Terry. It would be my contention that Burke will spend the rest of his days arguing with the law - & you're right, the irony & paradoxical demeanour he exerts to defend the indefensible could be better employed were he to crack on, keep his nose clean, & stop bitching. Now tho', he is virtually unemployable - & it's all his own doing. In regard to the garage work in your youth, sure, I too had humble beginnings, sweeping floors & stacking shelves in a local supermarket - & later, working behind the bar in a pub/restaurant; I've been a qualified Physician for thirty nine years (fortieth will be in October of this year), & certainly, a world away from the days as a sixteen year old - unknown promise, hey. Please Jesus someday I will go to Tesco and look back at my retail days after I've gotten into a law office... not there yet... more work to do... I'm not really old and I look younger than I am but I wonder why I never thought of Law when I was 18 ...I wasted so many years. I never thought of it as a career... I'm obviously a mature student. I have an arts degree that I joke about because it has gotten me nowhere 😭

Wether Enoch Burke was in contempt of court or not. The idiot should be given something like community service, like cleaning up graffiti or environmental services , but not jail time , that looks extremely stupid on the tax payer and the law society making an ass of themselves.

The idiotcy matter is that a judicial desire becomes an edict of the asshole law society court system. Which makes taxpayers imprison our neighbours over nothing. And it's very expensive. How fucking stupid Ireland has become?

The law is not the law. The law is deliberately over complicated to create an unnessary industry. Sentences vary for the same crimes all the time. Why should a judge have the right to dictate different penalties for the same offence? The drink drive law should be repeated for every law. If you drink and drive, you're going to lose your driving licence for a year, no mitigating circumstances. So before anyone drinks and drives, they know the penalty. The judge doesn't sentence them, they sentence themselves if they're caught. The law is unnessarily complicated in order to give jobs to the boys. Who can forget the 15-year tribunals that basically didn't punish anyone. This is clear evidence the system needs looking at.

Learn the difference between Tort and Criminal law. Defamation is entirely a tort where plaintiff seeks remedy/ remedies for a statement, that they believe is false, published to a third party and damages their reputation in the eyes of reasonable members of society. The Sunday Independent met the threshold of the first two but not the last as in the view of the judge he has no reputation left that can be damaged.

@OscarOSullivan then the law is not the law. Judges can make it up as they go along. I believe this system facilitates corruption. There should be fixed penalties for individual crimes. The law is overly complicated to facilitate an unnessary industry. 90% of which could be swept away if the system was simplified.

Thank you for the information it is greatly appreciated. Was it an instruction or a demand from the school? Article 44 gives you the freedom to practice your religion, I do agree that making the demands of others in the name of any religion isn’t protected and should not be protected under the constitution. It seems to me he is protesting the situation by staying in jail but is he really deciding to, as in are you saying he is free to go at any stage but chooses to stay? Maybe my comparison is not valid as they are two different situations, my point is it seems to be a lot of time, energy and effort by the state in pursuing the case and it seems other more serious crimes don’t get that attention. If what you are saying is true and he is holding himself in jail on purpose and not under any forced obligation to stay then I could be wrong about the situation as I don’t know as much detail as I should and I am only speculating on secondary information. I am open to be corrected on anything I think I know, and thank you again for the information I just hope it is accurate.

He can leave jail anytime he chooses. He simply needs to undertake to abide by the court order to not trespass on private property.

@@terrygorry awh I see thank you for the information, so he is basically protesting the decision. I still believe he should not be forced to leave his occupation or place of work for refusing to use compelled speech. As I say I have not researched the incident properly so my understanding of the situation could be wrong, and I am open to correction or clarification. I think a lot of people may not know he is choosing to stay and have an incorrect idea of what’s happening, having the discourse helps to bury those wrong assumptions. He

Well in fairness he shouldn’t be in the situation in the first place. Many people in the country that have got away with having children images in their phone and have got a slap on the wrist (if even that). The fact this started because he wouldn’t use speech forced upon him and took a stand is the reason for the spiralling events and I agree at times he hasn’t done himself any favours but it doesn’t take away from the fact that it shouldn’t have been such a big deal in the first place. This LGBT stuff is lunacy and should not be forced upon anyone and I do not hold hate in my heart for anyone who is apart of that community, I hate any ideology that forces itself upon people and forces speech upon a population even under the vale of virtue. If this came out as me attacking you or anything you said I am not, I apologise if it reads that way. just having the conversation.

@@buster931000 you missed the important detail that Burke demanded that the instruction be withdrawn from everyone else at the school as well as himself. That is beyond any rights bestowed under Article 44. He also refused to respond when asked how he intended to address the transgender pupil. He is deciding to remain in jail so comparing him to a criminal is chalk and cheese. He hasn't been sentenced for a crime. He is in contempt of court because he believes that the High Court authority is lesser than his religious authority. He's clearly on a mission to divide.

Well Terry, if Mr Burke should appeal the contempt order he more or less recoqnises that Order, it's then a yes or no for the Courts, and will be most probably a no. He becomes a hostage to fortune. If he refuses to recoqnise the order he then holds the neutral position, and can seek it's quashing, and he has done so. He won't be successful but he will not be a contemnor, that exists only in the minds of the courts. This position you have failed to see.

Hi Mary Enoch is becoming unfortunately a martyer to good honest thinking and yet an Irish scumbag that punches a young young 6 times in the head and left her unconscious and boasts about on line how he put her in her place and gets off free from the Judge because he didn't want him to lose his job in the Irish Army yes he is a soldier begs disbelief and yet Enoch is bedding down in Mountjoy tonight let's have an opinion and if the Irish government respects transgender views why do t they recognize Chistian views the only hope is that the Irish Muslims will support Enoch Burke and because of the woke agenda Enoch might get released.

I don't understand the whole obsession with Enoch burke and his family. The state have politicised this case. People are trespassing all day every day across the countryside on private land and the state has no interest in pursuing these types of cases. A demonstration isn't a breach of the peace.

He is simply in civil contempt of court and has been jailed for that, for failing to undertake not to trespass on private property. That is all the court order is about. How would you like it if someone showed up at your back door this evening and stayed there? And you got a court order and they ignored it and showed up at your back door repeatedly. What would you do then?

How can you trespass in your place of work? If the employer has barred him from the premises based on his employment contract t&c's why are the guards getting involved in a civil matter?

Two wrongs don't make a right. If they release him he's going straight back to that school and the whole circus begins again meaning significant disruption and hassle. He is welcome to take his case through the courts but he is not welcome to keep trespassing at a school he no longer works at.
