Great explanation. Most people who explain this take the lazy way and use a prior statement in a deposition because they can ask the witness if they were under oath. I think that non testimonial statements are more prone to the witness just lying about having said the statement.
First off, love your videos, thanks for all your help. I’ve been fighting a DUI Manslaughter charge in which I’m not guilty. I recently found out that the lead/head investigator on my case is a documented liar within his own agency. He got a disciplinary write up for not being truthful, he radioed in that he wasn’t in pursuit/ giving chase and actually was. 8:02 with due respect, aren’t you being dishonest deceitful of the witness since you are lying, or tricking the witness? How is this meant to be about the truth, going about dishonest ways of getting the information? This is the scary part of the judicial system. Seems hypocritical asking witnesses to tell the truth? Maybe 🤔 as an average person, I am misunderstanding this twist.
