Why are fathers not sueing the states? They claim child suppirt is a responsibility yet women in my state can have aboetiins and even hand over child to state forcing tax dollars to pay for a childs welfare. This is discriminatory and sexist.
Non child support for 2 years but got a 40k truck and a house with a saltwater built in swimming pool 🏊♀️... in my eyes sell the truck or assets what u think that mother is doing trying to support ur kids... selling n doing all she can... i cant get over how men just get away with this
Of course - but make sure you file for custody or modification of custody and work out a consent order with the other parent. T]at said remember ... emember in NC that if you do not file a motion to modify child support, every payment that comes dues (meaning the due date is reached and passes) becomes vested and cannot be retroactively modified. So if you failed to file the motion to modify - those payments are due and cannot be modified.
A father must support his child whether he is injured or unemployed. His child should wait until he gets a job to eat? Or get better from an injury? What the mom should tell the son? You are eating just 15 days this month, you'll eat again when dad gets better!!! Awesome 😁

My son was laid off due to corona drawing unemployment and child support is witheld. Should he still ask for a modification. Are the courts holding hearings during the pandemic?
@joann - if he is making more with the extra $600/week unemployment then it is unlikely he should file for a motion to modify - HOWEVER, the moment he stops making the extra he definitely should file immediately for a motion to modify. If he doesn't file a motion, he cannot retroactively modify and will be responsible for the full payment because the law does not allow modification retroactively unless the motion is filed and then only back to the date of the motion being filed. Cape Fear Family Law ex keeps saying that she’s dropping off court order for child support but she won’t give me the papers is this even legal don’t t I have to be served personally ? Becus I keep asking her to give me the forms but says she’s gna drop it my job ??
They don't base the amount on the extra stimulus added, call the cs office they lowered it for me to 17% and said if you want it lower you have to go court and ask judge.

Yes, I would say it does help. What also will help you is if you treat getting a new job like a full time job. Keep a calendar and record of everything you do from 9-5pm every day. Spend that time searching for a job, attending interviews, filling out applications. Once you get a job, even if it pays less, then you should file a motion to modify for child support again - depending on all the factors and facts in your case (which you need to have reviewed by an attorney). Did you have an attorney representing you at your motion to modify?

Just got a letter today about a court date in 3 weeks. I'm about 8 months behind. Does it help going into my court date to make a payment? Does it matter to the judge? Do I need a lawyer or is the first hearing for contempt usually just a slap on the wrist and they give you time to catch up? Thanks for any advice!
Make a payment for sure. Go to court with some money to pay also. The court wants to see that you will pay consistently and on time. If you have not paid due to a job loss or change of income, file a motion to modify. Remember that regardless of how you FEEL about child support - you should pay your mortgage, your child support, and your car payment (in that order) from your income. And if you are smart - set it up to wage withhold per check so it is automatic. Yes, they tend to only slap on the wrist, but you never know. Depends on if you were working not paying, your attitude, etc. Go and ask for a court appointed attorney and a continuance and even if you don't get an attorney appointed (which they have to offer you - don't accept that they don't if in NC) - then get a continuance and make payments on time to get back on track.
OH and remember - the people who "represent the agency" there at court get paid bonuses if they collect money from you in a lump sum at court. They are not interested in your problems, just in getting payment.

Can I sue child support that take the money out yet they make dead line two days before my pay date so I get late fees and increasing debt slowing rising up again I am tired of ringing them and asking why they making the dead line before pay date I’m done with corruption
What if your child turns 18 and you pay up to her birthday but didn't know the law states that you have to pay until she graduates from high school. That left 3 months of non payment. Once I was informed, I paid the 3 months. Custodial parent filed a criminal contempt order on me. What should I do?
@@CBApp-un1dq It went just fine. The judge didn't acknowledge the criminal contempt claim and the 3 months had been paid before court so the judged terminated child support.
Then you should be fine. You cannot be in contempt (civil contempt) if you comply. Also, they have to designate in NC if they are seeking civil or criminal contempt and most of the time they only seek civil. Hope that helps.
They are trying to serve me with contempt. They haven't served me the paperwork yet. It's my first contempt. They are trying to make me pay $28,000 in chikd support and i have been out of work for the past two years due to drug addiction and being in rehabilitation. I've also had problems with mental health. Is me being in a MAT (medication assisted treatment) program efficient enough for proof in the contempt?
First, we are glad to hear you are in treatment. That said, no being in treatment alone is insufficient to cover you for contempt. Remember in NC that if you do not file a motion to modify child support, every payment that comes dues (meaning the due date is reached and passes) becomes vested and cannot be retroactively modified. So if you failed to file the motion to modify - those payments are due. Now, that could mean that you file the motion to modify NOW and then work out a payment plan for the future. The longer the wait - the higher the amount. But generally the court will work with you as your recovery is best for you, the child, and the person you owe child support to. GET WELL and remember you are important and valuable! Keep your head up!
