A friend of mine inherited a house from a relative and it was left standing for about a decade. He wants to move into it and fix it up so he can live in it again. Originally his father rebuilt the house on a derelict site before planning permission was needed to do so. He has found that the house has been listed as a derelict site too since he inherited it. However in the 15 years since the passing of his relative there was some falling tree damage to a section of roof and the rafters etc have rotted away in that area. He's been advised that replacing that side of the roof would require that that half of the roof be removed and put back up which requires planning permission. The same engineer also advised that he could replace the frame of the roof from underneath rafter by rafter without removing the tiles first. He could then go up and start removing small sections of the tiles to replace the batons and liner under the tiles and fill in the holes and that this would qualify as maintenance and repair and not require planning permission. Is this true? Could he get around planning permission by repairing the internal structure first then repair the roof and liner in sections?

One more for your list Terry - works authorised by a Notice under S.11 of the Derelict Sites Act 1990. And - nothing on a protected structure is exempt, no porch, no back extension etc.

That's good information, so in the case where dorner window replaces a velxu window it's not in compliance and you have to apply retention order from council, is that a big ordeal.

Thanks for the video. Would you have any idea about planning permission requirements for a mobile home or tiny house on a trailer? Or there different rules for a tiny home if it's on a trailer with wheels and therefore not static? As long as you have the land owners permission, is it ok, or would you still need council approval?

Nice video Terry, hope you are well. Just one other thing. Make sure that there is no conditions on the parent grant of planning that prohibits the construction of an extension that would otherwise be exempted development. Just on certificates of compliance, I'd like to get your take on it. Let's say someone is buying a building that is not a private dwelling, factory, petrol station or oil refinery and that building predates the Building control act. Should we be insisting on a certificate of compliance with the fire services act of 1982?

A building that predates the Building Control Act can predate or post date the Fire Services Act 1982. If the development predated the Fire Services Act it would not be reasonable to seek a higher level of build/compliance than was in force at the time, is my humble opinion.

@@terrygorry I would be inclined to agree with your logic on this, however, the fire services act applies to all buildings other than the ones I listed above, regardless of age and can be very onerous on owners. I think the position of this is ultra vires and is prohibitive particularly when it comes to apartments in old buildings. All apartments predating building regulations must comply with 'Guide to fire safety in flats bedsits and apartments 1994'. It's almost as restrictive current building regulations. As a result I'm seeing our old town buildings falling into excessive disrepair because the cost to bring into compliance is extremely restrictive. Have you seen this?

I have a question... if a mobile home is being used as an extension on to a house, does it need planning? It's a cheaper alternative to brick and mortar.

i saw an episode of grand designs and people were allowed build on greenbelt land providing the property compliments the land. is there any such law in Ireland?

Yes, we have plenty of planning laws. And just like in any law there are exemptions and exceptions

Hi Terry congratulations on your video & youtube channel, to which I have subscribed. My question is....I have sale agreed on a listed building built citcs 1890. It has a small extention to the back built in since 1987. How can I get a certificate of opinion of compliance. I have written record of planning permission granted by town urban council at the time but I cannot find record online on county council site. Any helpbwould be grately appreciated.

Hi Terry, thanks for posting the video. I just have a question in regards to a stables that l want to covert into residential. I would be living in the property. The stables is concrete structure and is well over 25 yrs old. What planning permission do l need to apply for in your opinion? I had heard that change of use planning permission is enough for converting an agricultural building to residential and then require just planning permission for a septic tank. Many thanks, Sylvia
