Federal lawsuit claims common fridge failures are corporate fraud

More than 100 people are making a federal case out of their refrigerator troubles. They’re suing over fridges that they say failed far faster than they ever expected. Chris Chmura and the NBC Bay Area Responds team recently looked into the issue -- including one Redwood City woman who’s had three new fridges in just five years.
A Los Angeles law firm is leading the case and is aiming to make it a class action lawsuit. The lead attorney says there are possibly “tens of thousands” of consumers whose LG and Kenmore refrigerators died earlier than they should have.
At the core of the federal complaint is a component at the core of many refrigerators: a linear compressor. It’s what keeps the food cold. LG makes it and advertises the linear compressor with a 10-year warranty. Online, LG literature states “20-year durability.”
But the lawsuit claims the compressors are failing far earlier than 10 years in both LG and Kenmore models (Kenmore used an LG compressor). The plaintiffs argue LG, Kenmore, and several large chain stores were aware of the issue. Those consumers say the companies defrauded them when they bought LG or Kenmore models, some of which cost more than $2,000.
LG told NBC Los Angeles that it doesn’t comment on pending litigation. Kenmore said it no longer uses a LG compressor.
People who bought an LG or Kenmore refrigerator after January 1, 2018 might be able to join the lawsuit. You can learn more about the case by contacting the law firm: bhtrialattorneys.com
Christine Roher at NBC Los Angeles contributed to this story.

UPDATE: Our team recently looked into the latest twist in the case. LG is arguing that owners can’t sue. Instead, LG wants to force owners to go to arbitration. And part of the company’s argument hinges on people’s refrigerator boxes.

@timex513 by any chance was the cord replaced on it at some point? I ask because if it's a 2 prong plug (guessing it is because if it was a grounded 3 prong plug and something was shorted internally it would be tripping a breaker) if the cord was replaced and neutral was swapped with hot, it would still run, but it's possible the frame of the fridge may be tied to hot which would explain why it would shock you. This is not the only possibility, but a plausible one.

Here in NZ, fridges are so crappy, that if ANYTHING happens to your fridge in the first 3 years of ownership, they don't even send a repairman, they send a new fridge. The $3K fridge we just purchased is very inferior to the $2K fridge we bought in 2018. And that's saying something. @@AdityaDodda generally if you know your rights you can push the manufacturer to replace it without the hassle of going to Fair Trading. Even if you do have to fill out a complaint to Fair Trading its pretty easy and they do things in about 14 days. For example I had a fridge that goes in the car runs on 12 volt. It had a fault and it was sent away to the manufacturer. It reached 14 days of being away to be repaired and once it reached that point I could request a replacement as it had been more than 14 days to complete the repair. The next day the shop was given the authority to provide a replacement as the one that I sent away was still not even being looked at on the bench for repairs so I got a replacement one it was really quite easy. Under the consumer law the amount of time is it specified however legal precedent under gives you a general time frame certain things have to be fixed within 5 days 7 days 14 days or 28 days. For example essential things such as hot water systems, cooking appliances, pool pumps all those sorts of things have to be done in a reasonably quick period of time because they are causing undue burden and may also cause further damage by not having them for example a pool will deteriorate quickly if it doesn't have a pump and filtration system that works. Major electronics such as televisions, phones, laptops those sorts of things generally fall into 14-day repair periods and less essential things such as game consoles and other things that aren't essential to someone's ability to work study those sorts of things are usually more in that 28 day range. Some things are even required to be provided with a temporary or replacement device immediately such as CPAP machines or things that are life saving or critical to someone's ability to contact emergency services. For example someone who has pre-existing problems and their phone is not working they need to be provided with something that will fill the gap while their primary devices fixed.

Being in appliance service for 43 years, I can say without hesitation that the failure rate on LG and Samsung refrigerators were far above the industry norms. However the LG compressors were dying left and right. We couldn't keep up and regularly referred consumers directly to LG. Such a shame that people spend upwards of $3000 on something that doesn't last 8 maybe 10 years tops, or worse, fails in months.
@Jimster481

I definitely agree that LG linear compressors fail more often than other brands' compressors, but it seems to be specifically in places that have unreliable power as the compressor can fail in mid-cycle when it is randomly turned off. Overall, having one of their smart inverter compressors is much better than the linear ones.

My Samsung appliances all died within 4 years. Fridge, gas stove/oven, and microwave too. Microwave was first. It started taking 20 mins to heat up stuff that should take 5-8 mins. Like a baked potato, for example. Next was the oven. Then the refrigerator died. I was glad to get rid of that as it froze up constantly. About once/month, I'd have to empty the freezer, take the panel off the back wall, and use the sink sprayer to melt all the ice freezing up the radiator looking thing. The condenser? We went through this on our own about 5 years ago, as our LG fridge compressor failed after 2 years. At least at the time, there was no service company within 2 hours of us that would touch the linear compressors, so we bought a Whirlpool and it has worked out great. After we bought that unit though, a service company from 60 miles away picked up the LG fridge to repair it and months later told us it could not be repaired. I brought the NYS AG into the convo as well as the CEO of Lowes, and about a year after the initial failure, they sent us a check for the "pro-rated value of the unit", about 1/2 of what we paid for it. Glad we at least got something out of it, but it took dozens of hours over many months to get that far.

It’s supposed to auto-order filters, a smart feature that never worked. It’s a good thing Kenmore is out of business because I’d never buy another one. My husband is cleaning up the water mess from our cracked water valve as I write this; the last technician who came to our home warned us to watch for this exact valve to break because he fixes a lot of them Turns out the part is $70. We had our previous fridge for 15 years and never had a single issue with our previous Kenmore, which is why we bought another, which we deeply regret.

The other problem is companies only providing you with refurbished parts when your original parts fail and most refurbished parts are done with trash, repair components and sweatshop labor. Lots of time refurbished parts are really not even changed from how they were received back and basically just stabbed to go back to a new customer.

Ended up not getting replacement and had to use my very old mouse which still works and that one costed $25 and it was on 2014! I wanted new mouse because the old was all worn out, even though it still worked flawlessly. I decided to remove the cables and solder a new one on damaged mouse, when I checked inside the original cable they where insanely thin almost hair width and a lot of filler. Thats when I noticed that it was made that way so it could get damaged easely. And all that "braided protection" is nonsense, it always makes cables stiff after a year and brings problems to joints. This seriously needs to stop.

Yes! Auto makers do it to! It's called "planned obsolescence"...they are engineered to fail, so they can sell you a new one. It's not a new business method, it's just new to major purchases like cars and applianaces. They also make them so they cannot be serviced, or use integrated parts so you have to replace entire circuit boards instead of just a single component. And my biggest question is, where are all the environmentalists who should be outraged that all these fridges are ending up in a landfill after only a few years? So much for "going green", huh?

@@crazybobby14 I never had a cable problem before. Mine was always left button double clicking because the clickers are cheaply made from china instead of the good ones made in japan. However, I did buy a Sennheiser HD 660 S ($400). Good headphones, but the wires kept breaking on me. I had to buy a pair of wires that weren't from sennheiser. Learning to solder for this very reason is probably worth it.

We just went through this same issue with GE. Basically new unit for $3,000. Freezer failed after 14months. GE wouldn’t do anything due to the warranty expiring after 12months. Then the fridge went out 2 months later. They “weren’t able “ to fix it. So we lived out of a mini fridge for a month. The “discount” they said they would give us to buy a new unit after all of this wasn’t a discount at all. The prices quoted to us were more than we had paid initially. We ended up buying a new unit at Lowe’s, and we purchased a 3 year warranty that wasn’t available to us through GE. It’s not just a brand issue, it’s an industry issue.

DO NOT buy LG or Samsung appliances. Kenmore is also LG. It’s not just the fridges. The same shoddy materials and design extends to washers, dishwashers, and stoves. Just insane. I manage 70 rental homes and both LG and Samsung appliances and HVAC often fail within 3-4 years. I’m constantly having them get fixed, often multiple times. My usual recommendation to any landlord stuck with one is to dump it and buy a new unit of any other brand. Just not worth the hassle.

Moral corruption is pandemic, so this "trend" of corporate fraud will not be reversed by human, political means, as Jesus said at Matthew 24:12, that "the love of the greater number will grow cold", so that greed and apathy takes center stage instead of integrity. There is no stability, no desire to make a lasting product, just one to quickly place on the market to sale. However, there is one thing that is completely stable, and capable, and will enforce moral integrity, a heavenly government called God's Kingdom, "a Kingdom that cannot be shaken" (Heb 12:25), that will remove moral corruption from the earth and transform it into a paradise for "meek" ones to enjoy forever.(Ps 37:11, 29) This arrangement is designed by God, whose name is Jehovah (see Isa 12:2, KJV) to last everlastingly. Wow !

Ours failed at five years, but luckily, we were covered by an extended warranty and there was a class action case that had LG replacing the compressors at no cost. Years ago - at least 15 - a friend's son got his first job out of engineering school, where he had worked very hard and done well. He had a great work ethic and was horrified to find, at this company, his job was literally to design parts to FAIL. Another friend who had a Kenmore stove discovered one day that the oven door was stuck shut and she could not open it. So she called Sears and they sent a repairman out and she watched what he was doing because the problem was so strange. She asked him what happened, and he did explain it to her but said if she told Sears he would be fired. Basically they had designed it to do this in order to force service calls. There was a little metal ball, of some kind of metal that wears down, that ran up and down a little groove in the side of the door when it was opened. When it had worn down enough, it dropped into a little hole at the bottom and jammed the opening hinge. So he removed it altogether, did not replace with another ball, and the door has been fine ever since.

I got an LG because it was the only fridge that would fit that had the setup I wanted. It replaced a 7 year old Kenmore which had a bad compressor, so technically LG. I was so frustrated trying to find a “reasonably” priced fridge, the side by sides (which I like) that were whirlpool and GE were somehow smaller than the kenmore side by side they’d be replacing. I also read a lot of bad reviews about the GE being loud. I also looked at a $2,500 GE model which would have fit and been fine, but a lot of people said it was loud, plus I didn’t want to spend that much. I got the LG for $2,000 and it has two separate freezer drawers which I really like. I like this setup better. It’s quiet as well just like my kenmore. My fingers are crossed that it lasts. I didn’t like anything else, if I had a wider space I’d have had more options for what I wanted. I didn’t want to be unhappy and end up with another fridge with issues because honestly a lot of people are having issues even with other brands. I think things have changed and where things are produced have changed.
