Are flail mowers allowed to be used off the ground and how close to houses and people

You can use the flail head off the ground although it is easier to cut material when it is on the ground and riding on the rear roller. It is a little difficult to keep the material flowing by the blades when the head is free floating. And the machine should never be used around people, especially when off the ground.
