You should get 3 or 4 Auditors of your choice to go in and re audit this Library. The behavior of certain library supervisors who hold presumptuous and uninformed views on the law can be hazardous. In your case, they harassed you and disregarded your rights. Even when the police arrived and confirmed your right to be there, they did not offer an apology. Taxpayers deserve better public servants who earn six-figure salaries. Your audit was commendable, and it has successfully revealed the incompetence of these individuals. Justice has been served. ⚖️✅
I would like to commend you on that aswell sir. I quickly flip the channel when auditors lash or curse out cops. You can get your point across without it. Again great job!

@@angelforanimals7809 It was "Written" but it's certainly not "proof" that it's against the law to film in a public library or that any library policy supercedes state or federal laws. Just because someone typed that up, doesn't make it proof that it's a state law. Did you notice that no actual law was quoted? Because there is none. Illinois does not have a law that allows a public library's policy to supercede federal law. In fact, no state has that law.

The cameras are pointing downward to actually record private information everywhere we go!. Cell phone companies spy on conversations tracking your every move with gps, the streets, malls, restaurants, people's Ring cameras on their houses, camcorders in private citizen's cars etc...

In Kreimer v. Board of Police of Morristown, NJ, an important court opinion addressing a library user’s right to enter and use the library, the court held that because public libraries are a limited public forum, constitutional protection is afforded only to those expressive activities that are consistent with the mission and purpose of the library. A public library is only obligated to permit the public to exercise rights that are consistent with the government’s intent in establishing the library as a limited public forum for the purpose of receiving information and accessing the library’s books, programs, and online resources.

It is a location to acquire information, to expand the knowledge base of an individual or group(s), to disseminate literature and arts, and to promote the learning process. Due to the exercise of these auditors, I, along with hundreds of law-abiding citizens, have obtained a little more information about the desire for government, including our court systems, to limit our constitutional rights. What the librarians fail to understand, cut and dry, is they are not in charge of that PUBLIC building or of public citizens and those said citizens that lawfully enter and act lawfully. They act like Library Police. Yet, are nothing more than public employees there to ASSIST public citizens that enter the public building. Not act like they are the boss and in charge of the public inside of a public building. That simple.
@@feltonrogers906 Hello, I've managed a public library for about 10 years, and one of the policies at that library is 'Out of consideration for other users and to protect library collections and equipment, drinks must be covered and food is prohibited in the reading and computer areas.' I've fairly and consistently enforced that policy dozens of times, on people with and without library cards, and have faced exactly zero legal consequences despite the threats of several exciting civil rights lawsuits. Public facilities can make and enforce reasonable rules for their use, even rules that address actions that are not necessarily against the law. 'Policy only applies to employees and people who opt in' is a widespread, but inaccurate, auditor myth HTH.
@@nder The thing is you haven't been taken to court. And those who went alone were people who just went along. WE all know that The Constitution places Law above policy and rules. People who threatend to sue realized something was wrong. First time I saw the Law properly applied in a Library was when two Auditors were threatened with arress for recording the facilty and "Policy Stated" etc.This was at the main Library in downtown Detroit. Ten officers responded and tried to push their weight around. One Auditor remained calm and explained that he as a citizen had his right to enjoy the inside of that public building and not partake of any service that was offered and if he didn't partake of any service in any way, he was not bound by any Library policy, and the librarian could not say that he had broken any Law. That being the case ment he could not be legally removed or trespassed just because the Librarian wanted him to leave. The cops all looked at the Sgt in charge and he said, let's go, and the were gone in 10 seconds. I have seen that that senerio played out time and time again.
@@nder agreed. And I don't think it's obvious for a lay person to know what limited public forum is and how that would apply to A. Protest B. Standing silently with a sign C. Gathering content for a story via photography or video. For library, C. is fine. I wouldn't want to bet on B. And A is right out the door. Ymmv of course.

The staff are the ones who are escalating and causing his obstruction of his work. No patrons have complained, but the staff. They just can't be wrong!
Why are people so ARAID OF A CAMERA! The camera doesn't lie, and no one likes to be exposed to themselves and how self righteous they are for everyone to see!
Truer words have never been spoken. If what these people were saying was the truth, you wouldn't be able to record in any building because "sensitive/personal" information is everywhere.
Part of what makes this good is you are articulate, knowledagable and patient, keep it going, I think you should take this to another level and do some deep dirty work exposing corruption everywhere
With these ladies who work for the library, I'm gonna use their logic. I really hate red shirts, they offend me and make me uncomfortable. I'm going into that library and complaining about anyone wearing those horrible red shirts. I know they'll get asked to leave and they should get those red shirts out.

Indeed you are. I'm not a First Amendment auditor but have watched numerous videos. You seem to be the most knowledgeable about the Constitution and the law. Just as important you are very respectful and I've never seen you escalate a situation to the point of either party raising their voice or becoming violent. I really think the calm and even tone of your voice keeps the situation from escalating it's too bad in this case the Librarians try to make up their own laws and had no knowledge of the law are Constitution. Too many people think that because their employer has policies that those policies are law. Way to educate the uneducated. It's just too bad that it probably went in one ear and out the other.

I appreciate your auditing; this was my first time seeing one of your audits - and you have done a great job! You almost had me where they were doing taxes. They need close off the public area that is not fully open to the general public.

You communicated very well. The Supreme Court recognizes that “free speech” inherently can make people feel uncomfortable. But it is still legal to express your free speech in appropriate places recognized as a public forum. Recording may make people feel “uncomfortable”, but is legal to do in unrestricted public forums.
LOL. A library isn't an unrestricted public forum. It's a "limited public forum." They can restrict free speech inside a library as long as their restrictions are reasonable and viewpoint-neutral. So yeah, they'll do the same on Tuesday, even though this guy thinks he "educated" them.

The officers showed ultimate wisdom in applications!! They tried to diffuse and Deescalate the now moment by tactfully attempting to get you to comply to make the now moment issue go away. They can ask, but they did not try to enforce a policy. Outstanding- and ultimately upheld their Constitutional pledge to adhere to that which is lawful. Great job by all. Take care. Be kind to each other. I did solve that there were no absolute un level actions from anyone here that caused a high level of anguish. Pretty cool As we all learn peacefully together. Thanks y’all.

What they were saying to you James after the police left is that they “asked” you to stop recording and you would not-that translates to, We told you to stop recording and you did not obey our authority! Thus you offended their entrenched “ego.”

I started watching auditors because people didn’t believe me how cops act. In the 80s. There was expensive cameras Who would waste a kodiac disposable snap shot on a cops. But in them days Cops wouldn’t shoot Ask questions later.
If you stop and read some of those policies of the library they are beyond ridiculous. Filming without permission. Distributing leaflets. Wearing any 'gang' clothing. Flashing gang signs etc. Come on. Is this China or North Korea? Who determines what is gang related? Like I said, beyond ridiculous.
The way you conducted your audit was exemplary, especially given the fact that you, like myself, are a minority! I commend you on your demeanor and attitude. Well I’m from Canada What I remember about this video is that they were trying to enforce policy, not what is constitutional in this instance. So please educate me that policy over rides your constitutional rights? Regards

Being the auditor was there during opening hours and not going into any restricted areas I felt he was acting lawfully within your constitution, and therefore his rights would have been violated? Thx
This was one of the best audits I've seen....gave them every opportunity to adhere to the law, dropped subtle and direct hints about that law and even after the police corrected them they still were ignorant
@@Colgate64 Bruh you obviously know nothing about First Amendment audits. First Amendment audits are undertaken in areas accessible to the public. How else do you think a First Amendment audit can be effected? For verification look at the tens of thousands of First Amendment audits on RU-vid

I'm so glad you pulled out the holdings of _Miller v. United States_ on this audit. I don't hear that one as much as I think I should. For those unfamiliar with _Miller,_ "The claim and exercise of a constitutional right cannot thus be converted into a crime."
Just came across your channel. Wow you are very well spoken, no BS, straight to the point in a professional manner. People should really learn to stop being sheep in this world. You can clearly see how lost these workers are. Idiotic at best.
You've really become strong as an auditor. You're built for this and I really do enjoy your calm and clarity of information to public employees. The only thing I would suggest is to keep your camera on their faces. In fact, you should look at the employees through the camera until you can build the habit of keeping the camera on the people you're speaking to. You should also remind them it's up to them to create privacy if they want it by "closing the door". I don't know what state you're in but states usually have laws that allow for the recording of public employees. You should research that and quote the statute to law enforcement that may not know themselves. Otherwise, love your videos and great job again TTA!
