You know that the judge wouldn't allow you to quit at this stage of the trial. Especially not for the reason that Trump wants to exercise his constitutional right to take the stand. I don't believe he will. But I would love for him to do it.

I do agree with Cobb on letting go, however I have an issue with the fact that Trump's lies are not taken into consideration. Trump has a very long history of lying about many things. Cohen has owned his, that makes a difference.

It probably would work, except his lawyers would quit like Ty Cobb said. That seems to be one of the few ways to control him. Remember when he almost made Jeffrey Clark acting attorney general? The whole top echelon of the DoJ threatened to quit, so Trump backed off and launched the January 6th insurrection instead.

The problem is that no judge would allow a change of lawyers mid-trail. Once a trial is underway and a jury is impaneled, a change of lawyers would result in such a lengthy delay that the jury would need to be dismissed and the trial started over. Also, the new trial would have to be put off several months in order for the new lawyer to get up to speed! Given that this defendant has notoriously used delay as a legal weapon, the judge would be even more leery about allowing this!

If you have a client who insists on testifying and you know your client is going to lie, what you do is let the client testify in a narrative fashion, then not argue the client’s testimony to the jury. But you tell the client and the judge what you’re doing and why.

😇yes that was a prosecution slip - they could have decided not to put that conversation in evidence, there being other evidence that proves the trump knew and directed this whole affair. or they could have explained it in advance. the instinct would be to rehabilitate but as Ty Cobb says, that allows another go for the defense to after him. for trial lawyers, different strokes for different folks...blessings to all

Once he said he wanted to testify but couldn't because of the gag order he needs to be called out for being a coward if he doesn't testify. He tells his lawyers what to do, not the other way around. Indeed it would be incredibly stupid for him to take the stand, which is why he should have kept his mouth shut and not lied as a reason for not testifying. Someone needs to call his bluff through a very big microphone.
