💌 Hi Friends!! Recently, a huge controversy was revealed regarding the treatment of the admins of the QSMP server. As a (French) legal practitioner whom does fancy Labour Law, you know I had to make a video to talk about this entire ordeal.
I speed ran through editing to make sure this video would be out as soon as possible and lost a few braincells in the process, but it was worth it.
I sincerely hope the conditions of the admins (and not just the French ones) improves in the future.
In the meantime, hope you enjoyed this video!
See you soon,
Nolwenn

EDIT 2: Hey, if you’re not a legal practitioner who studied French Law at a French Law college, please keep your audacity to yourself and do not tell me, A FRENCH LEGAL PRACTITIONER, that I’m wrong about the Law I both studied and currently practice, ESPECIALLY when you try to contradict me by affirming wrong information, showing you know absolutely nothing of French contract Law ❤ You’ll just look like a buffoon ☺️ EDIT : Subtitles in English are now available!! I corrected them myself lmao As someone rightfully pointed out on twitter, I have yet to add proper subtitles for this video!! It will be done this week! I just need a little break to let my brain rest because I spent four very intense days working on this video lmao

Such an informative video! Unfortunately in latam countries our labour laws are so broken and the work culture is so depressing that they see french labour laws as whinning but if the qsmp wants to keep itself as a serious project than quackity needs to work alot to gain the trust of his french admins again, i have alot of love for the project but as q said "if my funds are not enough to pay the admins then the qsmp will shut down", bc the server would be NOTHING without them.

Hi! Thx for the video. It was very informative! Im a brazilian viewer, and although im no expert, brasil also has pretty solid labor laws. Some of them could apply to the QSMP admins, so at least the ones based in brasil could have a pretty good chance if this matter is taken to court. @@nolwennlennegezh as an American please let me ask, from your video, I gathered that it is possible for the French government to still see the amount of work they did as employment regardless of what either party declares. is is possible for the government to still seek back tax (not really sure if you call it tax, I mean any wages taken out by the government for funding) from an employer that was not declaring a worker, even if none of the admins wants to take any legal action?

As a Brazilian Law Student, you slayed and I also think French Labour Law is sexy as fuck. And at least in Brazil, I THINK you can bring this case to court if we consider the Quackity Studios mess as ✨forced labour✨ (or as we formally call it, labour analogous to slavery) So the Voluntary Service law says: Art. 1 Sole Paragraph "Voluntary service does not generate an employment relationship, nor any obligation of a social security or related nature." HOWEVER according to art. 149 of the Brazilian Penal Code, labour analogous to slavery is characterized by the submission of someone to forced labour or exhaustive working hours, either subjecting them to degrading working conditions or restricting, by any means, their movement due to debt contracted, with the employer or agent" If theres a way to prove that there was some type of action that could happen if they fire themselves, they could go to court because it breaks the voluntaring law and checks one of the 3 points (forced labour + exhausting working hours) and get something from it (maybe not the sentence for labour analogous to slavery but still, maybe a recompensation). If the last point is about physically leaving like actual transportation it can check another point but I don't believe that's the case I'll check with my professor and give you guys an update. And also about the degrading working conditions, I believe it would count as their houses but psychological abuse may also apply (even that is not the case in here, if it's proved that something happened with ANY of the admins I think we can count this point) The Brazilian ones weren't paid a single cent, but if they did tho I think we can follow the same line as the French one but idk since informal labour its still very popular in Brazil (especially in the entretaiment/food/services industries). Also Brazilian Law isnt really the most imposed one since court cases can take years to happen and it can be distorced and looped as well. Just to note again, Im still a student. NOT A LAWYER I DIDNT DO THE OAB EXAM. So I'm not pretty sure, estudantes e trabalhadores do Direito Brasileiro por favor me respondam se isso está correto.

And even more important, ask for something written if you are accepting a job, because it seems crazy to me that people accept jobs where they tell you "we will pay you at some point" and just believe in their words 😭 please everyone, be more careful!! Hi! i'm a brazilian lawyer, and i particularly work within the work labour in brazil (CLT). The only one i can talk about is the egg Richarlyson and the brazilian admins, so, conecting that the work law in brazil is very "rule only" and the monetary cost will be required in the action: first off, the "contract" is international, and must be chosed by the parties, not choosing one the brazilian law will be used, OR the law where the place the worker used to work (i will pick brazil) The NDA would not work if it was a meaning to negate his human/fundamental rights, basically you cant sign a contract that will do you harm that violates some rights, there are rights you can sign to "give off" but the ones in discussion you cant like work and health (so, will assume that the nda would be desclassified bc of the degradation of the work) To classify as a worker you only need 5 things> be a person, the work must be done BY this person (not anyone else, bc i signed the work for this person especificaly), subordination of your boss telling you what to do (and what you cant do), habituality (you have to work there frequently, not once and never, like when you contract a painter to paint your house and done), and be paid by this job (but if you not, you could be qualified as worker and require the payment in court) The conditions of work shown by pomme (and i will assume by all other eggs and admins) shows evidence of work similar do slavery (is not slavery conceptually, bc in slavery you "own" the person, but the condition of work is the same in the end) and existential damage, this classification is set when the work is done in a way that the working day is so big, exausting, that you cant live your life (do your things, leisure, personal plans, or other things that normal humans need to do). This would cause moral damage to be paid. There are other rights that need to be paid, like extra hours (the journey of work in brazil is 44h in a week), the salary, 13º, intra-day break, warning of been shut down by your job, vacation +1/3, "FGTS" (its like a insurance in case you go unenplyed) and other rights could be granted, like 20% more than the normal salary bc of the function accumulation. I was joking with my sister saying "man, this would be a big ass action and payments", and i did a calculation of the action in the program that the brazilian court give to us on a joke, but it was so big, so big that i started to "remove rights" to not be so big, and even removed the penaltys (if you never paid some things, you have to pay a penalty of 50% of this value), but even so the final value was around R$ 68000,00, (EUR 12381,70/ 13438,74 USD), wich is really big for a contract of only 10 months and i considered the minimun wage in brazil (THAT IS REALLY LOW, like 279 USD and 257 EUR). Good luck quackityy

There is no QSMP without the admins. Even outside of France, it's unthinkable to not get paid for the amount of work they put, considering that they were doing it on a volunteer basis BUT with the explicit promise of a full-time paid job... which they never got, despite getting more and more responsibilities and hours demanded of them. Not requested, not "hey, if you have time." Demanded. So yeah... volunteering but under a false promise of a full-time job. Regardless of French laws, that's wrong and abusive. With French laws... it just gets really bad for Quackity Studio. And yeah, the leaked convo was about the server being DDOS'd. Now I'm from Quebec so I'm not too familiar with French, or American laws, but isn't there such a thing as a verbal contract? Or can a chat discussion about work conditions, salaries, etc. be considered as a legal contract? Is that a thing in France? I mean it's cool that France doesn't need a contract, but if the discussions about work can be brought in court and if it goes to court, that could be very helpful for the French admins. As for their NDA... yeah it's nothing but a cheap scare tactic with no legal weight, but it's certainly worth saying out loud. Great video and great english.

However, within negotiations, I strongly believe it would benefit Quackity to make the first move and show good faith by trying to fix the situation amicably. I deal with Personal Injury as I am a medical malpractice and personal injury specialist, and I know I tend to be kinder when the defendant shows good faith and tries their best to make amends. But I never wait for the defendant to make the first move, I always contact them first, and unless the rules are different for syndicates and within Labour Law, I personally would’ve reached out to Quackity without waiting anymore, but that’s just how I work within my field.

I loved how informative this video is! I was left wondering about one thing tho. As long as those three conditions are fulfilled, that person would be considered an employee even if they were told they are doing volunteer work right? Sorry as an American this is certainly different from how they do things here. In France I would be an employee but in America I am a volunteer lol

Technically yes, as long as the three conditions are fulfilled you’re an employee! But it is very strict with the precedents that we have, while the Law is quite clear we refer to the existing precedents to see if a peculiar case has been studied or not, and if not, well we can go to court and see what happens lmao

Hi! Thank you for this great & informative video! I've been wondering how French labor unions & laws are different from the US, so this has been very helpful. Hopefully this situation can be resolved soon and the admins fairly compensated! I am curious if there are any laws/rules about how unions have to reach out to businesses. It seems like they've just made tweets and press releases, and people on twitter think they need to email/contact him directly but a worker for the union said Quackity needs to reach out to them
@nolwennlennegezh
@nolwennlennegezh 3 месяца назад
Thank you, glad to hear it was helpful!! From what I understood they tried to reach out to Quackity but to no avail, though I might be wrong. I do not know if there are any rules for this, but in my opinion, it would greatly favour Quackity and his team to make the first move for negotiations, and especially to show good faith. Should a lawsuit happen, judges can be “nicer” when the defendant has actually tried to fix the situation even if it failed, I know I personally tend to be kinder when the other party behaves well during negotiations, but if they are rude, gosh I do my best to tear them apart when we go to court lmao

Hi thank you for the video slightly off topic but as someone who lives in the U.S It’s actually impressive how much the French government protects its workers and well isn’t draining everything out of their workers in the U.S, people aren’t really protected form there employers if not at all only if you have enough money and or connections maybe you could win but for the regular person there’s not much protection as in work labors hopefully that can help explain a bit more of the U.S work system and how shitty it is it’s not an excuse but I’d help explain why some things are done differently than in France from protection in the U.S But I do agree that there should be changes and that they should be paid more as I’m writing this he made a stream in Spanish just saying that he’s working on it and how it’s a delicate problem and how I’ll take time for the project to return “back to normal” (as normal as they can be)but hopefully things will be fixed and that the old admin can get an apology at least for a accident

None of this applies is they've agreed to work on a volunteer basis without salary. This is pretty fundamental, and you never cover this. You just say that although they agreed to work without expectation of payment or contract, that this condition is fulfilled, even though it clearly isn't in this case based on your own statements. From Quackity's own videos it seems some may have had agreed pay, or expectations of future paid work, in which case French law might apply to them if they are working in France, but of course France can't impose any settlement on a foreign company or individual anyway (unless they travel to France or possibly the wider EU). QSMP is run at a loss, so the challenge to volunteer roles is very likely to be terminal, at least to their activities. One solution, might be for creators to pay the running costs (infrastructure/admin salaries/translation fees), out of their streaming revenues (the profit the server generates). This may be a model for a future content platform. The admins seemed to enjoy their work and the viewers certainly did, so it's a shame this situation has arisen. It sounds like admin relations have been managed very badly and self destructively, undermining the great steps the QSMP project has made to bring the world together. I hope they sort it out.
@nolwennlennegezh
@nolwennlennegezh 3 месяца назад
It does apply regardless of what they consented to… as long as the conditions are fulfilled, the law will take over and ignore what the parties consented to, especially if it is in favour of the “weakest” and most exposed to abuse party… I did not overlook that information, as it is wrong and not what applies in French Law…

Silly me I didn't read the second part of your comment. I would be surprised if there is no agreement between USA and France for such topics. If not it would be detrimental for France and the US imagine situations where bad employers do offshoring from US to foreign countries and abuse the employers it means less workers on your country, it means less taxes. It's not in the interest of USA to not enforce such decisions.

It's incredible how you can see all the problems but your suggestion is not to resolve them but to flee. Also, volunteer work is work. And at some point if you're working more as a volunteer than in a regular job it's not normal. I think QSMP should have had a larger team to divide all the work and not as a single person to do 4 jobs. Also, we should not forget it all started because someone talked to someone. It escaladed and this proves that there is an internal management problem. Everything could have been avoided if managed better, and the community and the streamers all agree about the problems and how to resolve them.

Bonjour ! I love money ! ☺

Dude you're forgetting that there is real people and it's not just a minecraft server. The video is not explaining why the laws are right, it explains what the laws are and how it is in France. Those laws could be informed upon the administration of the server. You seem to forget we live in a world that exists and overules your childish point of view that essentialize people. People could be in trouble whether you like it or not so accept it.
