“My job is not to get a conviction, my job is to put the evidence in front of the jury.” I wish more prosecutors actually understood and believed that. Their job is to seek justice, not ramp up their conviction rate so they can make their way to becoming a judge.

​@hannaht2068 No, because her lawyer was aware of this evidence and chose no to use it. Baldwin's lawyers were not aware of this because the prosecution didn't turn it in. They found out from Hannah's lawyers.

@@hannaht2068 She is going to get an appeal, at least. And its possible that this corruption could get her conviction tossed. This box that was delivered, did not appear until after that case ended. HOWEVER, there was a 3rd report from Haag that was withheld, and his testimony in that case may not have been consistent with his 3rd report. Which would be very bad for the prosecution.

@MrCrimenews Sorry, I think Erlinda Johnson is playing media to revive/elevate her reputation. In fairness to her, she did the right thing by quitting. On the other hand Alec Baldwin should never have been charged in the first place. Her position that he was playing around with the gun was reckless, was more than a reach. It was supposed to be a cold gun, live ammo is not supposed to be on a movie set. They have a specific person to ensure safety on the set and that is the Armour. She is correct that no gun should ever be pointed at someone, but on a movie set there is an exception, when the gun is supposed to be cold, it is routine that actors practice their movements before filming. The term is called Blocking, which is done on every movie set. Even if it was horseplay as she suggested, there is a lack of intent, even negligence because he wouldn't have known the gun was able to fire a live round. As for the gun going off by itself. People forget these were very old guns, when the FBI (Not sure if that is correct) took it apart they damaged it. This would weaken any claim of intent and/or recklessness. This case was brought to elevate people's positions, that is my theory. There was no reasonable basis to charge him in anyway. If she had stated this from the beginning, I would agree she had courage. Courage is when you have something lose by making taking action. I don't think she had anything to lose by quitting, the case was a dud, from the beginning.

Look, there was limited time, he was keeping her on track for what we all needed and wanted to hear. She kept going back to covering her ass and making sure everyone knew that she wasn't a part of the misconduct, which she had already said and had been established. Sometimes as an interviewer you have to guide the interview where it reveals the most. Ideally you don't want to interrupt someone, and had time not been an issue I'm sure he would have let her ramble on repeating what she had said. He's a great interviewer, its part of his job to get the most out of his guest and who he interviews. Its why he gets paid the big bucks!

Alec Baldwin’s actions on that day led to the accidental death of his coworker. I have no doubt about it. Whether his actions amounted to negligent manslaughter was a question I hoped a jury would decide. But the actions of the Special Prosecutor and her investigators (including the crime scene technician Poppel) are an attack on the principles of fairness, of impartial justice. The conduct of the Special Prosecutor was an attack on us all, and the only repair for that attack was a dismissal of the case. It is unfortunate that Baldwin’s guilt or innocence is unresolved, but the judge’s decision was just. It was necessary, or we don’t have a constitutional system of criminal justice.

Yup.. honestly hearing local talk about this.. a uber driver.. it did seem he would have been convicted because the problem was when he shot her.. a regular person would have been arrested.. guilty or innocent.. spend time in jail.. Alec did NO time in jail.. he cried and then went to New York.. a regular person would be sitting in a datinment center or jail.. and hten released So ya.. i think this actaully has soiled things for people there.. cause they said this isn’t fair justice.. everyone should get same treatment.. should have sat in jail for even a few hours like any other person. He didn’t’

I agree, her arrogance was her undoing. You don't get to assume and suppose defense gets evidence, you make sure cuz other wise every pros or LE would use it as an excuse. Even if she was never told about this evidence, she would be liable. But to hear she was actually contacted with Hancock so she for sure was told, def seems like some burying was happening. I wonder if because Seth Kinney was SOOO helpful to them the couldn't have anything pointing to live ammo coming from him, it had to be from Hannah cuz that was what Morrissey claimed, so they didn't want anything showing up to raise any questions or impeach Seth. I don't trust or believe him at all, but ultimately no matter how the ammo got there, Hannah as armorer should have found it and weeded it out or shut everything down.

All the prosecutor saw was herself getting the applause and credit for convicting Baldwin and she was going to hide evidence if that's what it took to get a conviction it's not about what the evidence says it's about her getting credit for convicting a celebrity and the chance of advancing her career at the cost of innocent people and now she should never be a lead prosecutor on any case and should never be anywhere near the evidence of any case as she's a corrupt prosecutor

Politicians won't take note; it's up to us voters _not_ to elect politicians who won't take note. In this system _We The People_ hold our _politicians_ accountable, not the other way around. It's We The People who haven't been doing our jobs -- partly because the press itself has been dishonorable in giving us a slanted narrative, but also because we're taking these reports and stories at face value and moving on with our lives until Election Day. She's a special prosecutor, so she's a private defense attorney in Albuquerque, but was chosen as a special prosecutor, like the other members of the prosecutorial team for this case, after the D.A.'s office in Santa Fe was disqualified.

Culpability for negligent discharge of a gun is not the point - the point is the prosecutor did not disclose exculpatory evidence to defense counsel. Unethical and dishonest. Cheating. This woman is spot-on correct.

Investigators and prosecutors are SUPPOSED to be on a “fact finding mission” - NOT a mission to collect only the evidence that they think might implicate someone. And do you know why? It’s because the person who they suspect of committing a crime may be completely innocent - and excluding potential evidence from a case file could result in the guilty party not being found out. Prosecutors can choose what evidence they present at trial - but they’re NOT allowed to hide evidence from the defense just because they feel like it. It’s NOT their job to decide what’s credible evidence and what isn’t - that privilege belongs to the jury. You sound extremely cynical if not downright unprincipled.

After watching how pathetic and unethical the prosecution was in the Karen Read trial, Erlinda Ocampo Johnson gave me some faith that there are good prosecutors who understands that their role is to pursue justice and not convictions. We need more of her ilk in the justice system. I wish her a great successful law career.

A the end of the day she agreed that Baldwin was guilt of reckless behavior and was guilty from that point. However the basic guilt of how the live rounds ended up on the set still has not been placed on "An" individual. That is the guilty person. I don't personally like Baldwin, he is an arrogant prick. If Alex Baldwin didn't have the resources to acquire the level of legal defense he had this case would never have been thrown out. Most poor defendants would have pleaded out never knowing all the exculpatory evidence available to them.

It is refreshing... Prosecutors all across America seek convictions and not actual justice! Kari really made me mad when she exposed her personal politics when referring to Baldwin. She didn't say those things to praise Baldwin, she said it so that the powers that be knows her political stance if she's ever let go. She kept going back to covering her ass and making sure everyone knew that she wasn't a part of the misconduct, which she had already said and had been established. Sometimes as an interviewer you have to guide the interview where it reveals the most. Ideally you don't want to interrupt someone, and had time not been an issue I'm sure he would have let her ramble on repeating what she had said. He's a great interviewer, its part of his job to get the most out of his guest and who he interviews. Its why he gets paid the big bucks!

Morrissey I think made it an easy decision for Johnson to withdraw. Johnson has her own career and reputation to consider, and she wasn't going to have that put into question on account of the malfeasance of her co-prosecutor without her knowledge. From the beginning there was something about Erlinda Johnson I liked; couldn't put my finger on it but I found out when she bailed on the case. This is the kind of lawyer you _want_ in the justice system, regardless of which side she's representing; you know you're getting a straight shooter. That's also one reason why you'll never find her in politics.

(Understand that I'm approx. 15 years older than Johnson is, so from my perspective she'll be quite attractive; but I'm also drawn to supremely intelligent women, looks are just an added bonus).

Chris, people keep missing the reason this is so important. This actually provides an answer of how the killing occurred in the first place.The key is regarding the silver vs brass primers. Remember, Seth-Kenny provided the training, guns AND ammo to Hanna. Seth-Kenny outsourced the ammo reloads (if you are not a gun guy, or country girl, you will think the only way you get a bullet is to buy one off the shelf, in a prepackaged box), this is not so. People who shoot a lot make their own bullets which are called reloads. RELOADS significantly reduce ammo costs as you reuse the most expensive part of the bullet..aka jacket. You then add either dummy content or LIVE content, place a primer around it and you get a new bullet. The bullets on the Rust set were reloads, facts already established. The reloads were outsourced from Joe (there is his name in evidence). Joe was known to use both BRASS OR SILVER primers and was not consistent in which he used for dummy and which he used for LIVE rounds.IF Hanna was taught that all silver primers were dummies, she would only be half right, half of the time. Remember this new evidence is key because it was said to be from the same BATCH of reloads sent to the Rust site. DOES NOT MATTER IF IT EVER ENTERED THE RUST SITE. This would prove the inconsistency in primer usage and perhaps point to the true failure in the safety process. Hanna could never have been able to tell simply by looking at the bullet to determine if it was a dummy or not since no consistency in the primers existed. She would have to pick it up and shake it. IF Hanna was taught that silver primers, for example, were always dummy rounds but that she should shake them as an “extra” assurance (whatever that means), then you can see that the safety failure on the Rust Site occurred way before filming and way up in the supply sourcing chain. It at least explains how someone died.

All firearms are always loaded. Whoever has the firearm is responsible for its handling. This is not a hypothetical, these rules are written in stone because "empty" firearms discharge injure and kill with alarming regularity. This rule is part of the Screen Actors Guild (SAG) training for actors, and mandated on every set.

This is also why I find it unseemly that District Attorneys and judges are _elected_ positions in most states and not appointments. Too many in those positions are there on the promise to "get a conviction," when that isn't their job, it's a _jury's._ James went as far as to run for AG on the promise to "get Donald Trump." That doesn't even pass the laugh test, and every time a prosecutor takes a similar political stance it sullies the reputation of the justice system that much more -- and it's the one institution we're supposed to have the most faith in.

@@SussexSandra Well in the case of the two Supreme Court justices we’re talking apples and oranges. Word of difference between trial judges and Constitutional judges. And the criticisms of Democrats about Alito and Thomas ring hollow when POLITICIANS are making judgements about a justice’s integrity. It’s an attempt by one party to intimidate justices into either making rulings they agree with, or forcing recusals in order to even the score with the liberal justices on the court - who, BTW, one can argue write decisions and dissents that are every bit as “ideological” as a conservative justice. At the end of the day SCOTUS and the judicial branch in general is an independent branch of govt that is supposed to be insulated from the other two branches trying to weaken it further than it already is. If there’s an ethics issue it’s theirs to deal with; neither Congress nor the Executive should be allowed to regulate the Court’s structure or behavior beyond what the Constitution already allows for.

In reality there has to be missing evidence, for or against the person charged, in every case. This doesn't change the fact that that he WAS reckless in handling a "real" weapon. The result was a woman died. Going after who made the live rounds appear on the set and who placed them into the gun is vital. Also responsible are the ones who were charged with inspecting the gun before it was used. Still, I think the heaviest burden has to on the one who pointed this gun at people and pulled the trigger. Americans do not take gun safety serious enough. Not in our laws for owning and possession of them Nor in our Courts involving gun violence.

Remember professional people have stats. If she thought a mistrial and if she resigned from the case before that was ruled by judge it won't be on her court case record. Judges HATE mistrials. Wasted entire courts and juries time, expensive, and makes a mockery of state justice system as it undermines public's trust in the courts. What other evidence was hidden or not given to defense. Most defendants are intimidated to take plea deal. It avoids expensive jury trials. They offered Alec Baldwin a plea deal, he refused.

So, the question wasn't really answered about what is the "standard" for allowing evidence in? So does this mean that on ANY case for ANY crime, ANY person can just drop off something to the police and say "this" was used in said crime and prosecutors HAVE to include it in their case? Even if that "evidence" had gone through FBI testing and proved not to be part of the evidence or related to the crime? Also, this "evidence" was seen but NOT used in Guiterrez-Reed's case (which for one thing, shows that all these people DID KNOW about this evidence before yesterday??) so why would they use it in Baldwin's case?

Baldwin's team did not know about it though, it is probably through their connection to the Guiterrez case that they eventually found out, but this was after the prosecution decided to file it under a different case number and never turned it in. That is gross misconduct, as a prosecutor you don't get to decide what is evidence and what the defence sees and doesn't see. Everything is to be logged. Correctly. And turned in. Their failure to do so caused the entire case to be dismissed with prejudice. They fucked up.

They have to provide anything that can potentially be used to mount a defense, not irrelevant things. But there is a presumption towards giving the defense anything they ask for. This clearly sits in that category that might have changed the trial and was wilfully concealed. The only way a case gets tossed is if that evidence could have effected the outcome.

​​​@@REDinitial, from the testimony, the evidence was offered directly to the Gutierrez team and they declined because it wasn't what they needed. After that, it was brought to the police station and handed over. To address a point by the OP, the FBI did not test it and declare it was irrelevant. The prosecutor made that decision unilaterally based on the fact that it had never left the state of Arizona. The issue wasn't where it came from but the claim it was from the same batch as found on set and that it was provided to the guy who allegedly provided the live rounds on set. This was no trivial matter. It could have been used by the defence to prove deliberate sabotage, or at least put reasonable doubt in the mind of the jurors.

However if you watch the police bodycam video of the guy who brought the ammo to Popple, nowhere during that encounter did she question how to enter the ammo into evidence. It's possible Popple asked later on but she did not provide the name of the person she claimed told her to use a different case number. IMHO, Popple is one the reasons the case was botched (as a prosecutor would not advise the technician how to enter evidence). Popple should be held to account for her flagrant mistakes and potentially, her lies under oath; she appeared incompetent, arrogant, unreliable, untruthful and self-protective (because of her selective amnesia).

@@LenoreGuarino It was pointed at her. Two people were hit. It was not supposed to have a live round. Alec and the other actors all had rehearsed and were filmed over and over and over. Every other time the guns were cold. This was a horrific accident due to the armorist bringing live rounds on the set. My husband was the armorist on the set of "A Dry Patch". A western vignette our son did for his senior film a couple years ago. He never let the guns out of his sight. Scenes are filmed over and over to get the best ones. The director and cinema photographer are there right infront of the actor(s) watching both infront of them and a small screen. I know it's hard for people that aren't in this business to understand. I know because I've been on several sets. This is the western vignette I'm talking about. Just watch it. Right off the back of the Karen Read case, this has been a bad few weeks for the American justice system. Prosecutors in both cases seemingly manipulating evidence to get the result they want rather than following the facts. Both of them totally unapologetic and obstinate after being found out (Morrisey, in this case, not this lady, obviously).

I agree. Being a retired police officer I usually find myself on the States side, however this and the Karen Read trial which I watched from the beginning have pretty much soured my core beliefs. What has happened to law enforcement since I pulled the pin in 1993 is a sad state of affairs. It goes to show you what is left after all the professionals in Law Enforcement left following the attack on cops over the past 20 years. We need to get back to the basics in Law Enforcement. I always told my officers to follow the Golden Rule when dealing with the public, and were I still on the job today I would still be advocating for professionalism and fair treatment for all we deal with.

It is an eye opener. Also ask yourself why did Seth Kenny instruct Sarah Zachery to destroy all the ammo right after the shooting and she did. Prosecution knew this.

Fwiw, I've acted in film/TV for decades and in roles in which my character was required to use a gun: I'm not implying expertise, only experience on sets. In every project, whether feature or low budget, our armorer's protocols were always concise, rigorous and, frankly, reassuring. A live round on set is unheard of. Imo, Baldwin's liability should be civil and huge. HGR was a sloppy hire and she was criminal in her neglect of duty. (The safety of the entire production was below standard: I feel bad for those who tried to correct things and weren't heeded.) It's also chilling to know a child was one of the leads and in the presence of these weapons. Halyna's death broke a lot of hearts - everyone who knew her. In her memory, let's hope the rush to batten down hatches is more than that and becomes fixed protocol. Rest in peace, Halyna.

Brandon Lee was technically shot when a dummy lodged in the real gun was then projected by a blank that was loaded and fired. Safety measures are meant to avert freak occurrences.

Chris, you are wrong. On a proper film set, there are extremely high safety guidelines, and from the footage, AB absolutely was almost flippant in his welding of firearms. The court also should never have blocked evidence regarding his role as producer, because as such, he was yelling at people to hurry up when reloading, and no actor would be allowed that power. THAT was him as producer. The problem seems to be the court's lack of understanding of how film sets run. This seems like a non-union free for all, and someone died as a result. Speaking from 40+ years as a union filmmaker.

I don’t care how long you worked in movies. I worked with the stage hands union. There are so many idiots on film crews it’s astonishing. Hollywood is all about money, not professionalism. 1. Licensed certified paid armorer. Weapons expert. 2. Layman actor handed a gun by paid licensed certified weapons expert…only this time it was the assistant director and he cried out “cold gun” as he handed it to Baldwin. This was a set up. Hundreds of thousands of rounds have been fired on movie sets, many in haphazard fashion for 120 years. Certified licensed expert paid to be on set checking and loading the weapons. Actor (non expert) fiddling with a prop. Dream on.

You have to wonder why the original DA wanted someone else to prosecute? Did they know that there was an evidentiary screw-up? I think they did and that's why the case took so long to come to court. Baldwin's defense took advantage of the forensic mistakes and convinced the Judge that the evidence was exculpatory when it was not. I think someone will criticize the Judge for making this a Brady violation when it was not. The prosecution did not disclose all the evidence and they should be punished for this, but what is more important is that the Judge did not determine that the evidence was NOT exculpatory - it did not prove that Baldwin did not check the real gun, or that he pointed it at Halyna, or that he pulled the trigger. The evidence that was not handed to the defense had NO RELEVANCE to Baldwin's guilt.

You're always going to have that. These institutions are run by human beings. People with flaws and agendas. People like Morrissey. There is no perfect political system -- as long as it's run by people who won't honor their oath of office. In our system it's ultimately up to _voters_ to hold those people accountable, to the extent that they are elected positions; but for that to work we need to check our own flaws and agendas at the door -- because our politicians ultimately come from the community -- the same community you and I belong to. We The People need to take the franchise more seriously.

I actually had that idea while watching the trial. In a great murder novel, this would be a terrific ending. To think ahead, withhold evidence, make sure it gets leaked to the defense at the right moment, and then boom, Mistrial! The prosecutor walks away with millions in her foreign bank account, arranged and paid by the defendents before trial, and everybody is happy. Not true. But I had the thought.
