K. Asas, the issue of the tape is not a matter of different listening ears. It is a question of right reason and equitable judgement. The tape is a monologue. Jakpa is doing almost all the talking.. Nobody can put words in the mouth of AG, Dame, because Jakpa is inferring so. Though the application could not in any way influence the substantive case, the tape was admitted to show that it was not, by its own merit incriminating of AG. AG, in the tape, was not heard to be pronouncing the words attributed to him by Jakpa. The tape does not support the evidence of claim Jakpa intends to establish against AG.
