Sir.The Civil trial court grants permission to accept a gift document that is not registered with the civil trial court. We then put the WRIT petition in the High Court, and then the High Court ruled that the Gift Deed registration was not required by the Muslim Mohammedan Act. This is OK....?

Difference b/w gift (Hiba) & will ... mulla : gift is a transfer of property ( moveable / immovable ) by one person to another without exchange ; & without consideration .. E2 - declaration (ijab)(donor) /real intention / -Acceptance (kubool) by competent person (donee) -Delivery of possession / transfer of property(ownership)/possession not necessary to be physical but must be legal (by donor to donee) Exception: donor donee(living together same house ) case ? =valid gift ... E.g husb-->wife Father/mother--> son Guardian --> ward When the donee is already in possession -without consideration -immediate transfer -gift =oral + written -registration= Indian registration Act? Hebanama form//? Case? J mujir ahmad v mohammad muja ? - oral gift + all e2 = valid gift /?? Kerala case : E2/3considerion+registered hiba =mere a proof /evidence of completion of heba (not compulsory) Voidable gift ??????????

Suleman Khan, a Khoja Muslim inherited a farm house from his father Salem Khan and started living in his newly constructed bunglow with his friend Suneel Kapur, who was working with him in a Tyme Cinema MNC at West Mumbai. Suleman was relocated to Italy, by his organization and decided to migrate there. In the farewell that was organized at that farm house for him where after consuming alcohol he declared before his friends that he was gifting the farm house he inherited from his father to Suneel Kapur, who smiled and gave him a hug with tears in his eyes. After that farewell party Suneel Kapur stayed back at the farm house with Suleman Khan till early morning and from there directly went to the airport for his shooting assignment scheduled in Switzerland. Giving instruction to a lawyer for mutation regarding farm house, Suleman boarded the flight to Italy but died in the air crash. His brother Raheel Khan sues for the possession of the farm house on the ground that the gift was not completed as per the provisions of Muslim law. Questions???? 1. Whether Suleman Khan was competent to Gift that property ? 2. Whether Gift was complete as per the provisions of Muslim Law ?

Dear Sir, Im muslim and in my case there is only two daughter no any son, As I know 2/3 (0.6666) of the property will goes to daughters right. So, my query is that remaining 1/3 (0.3333) rights goes to whom?. And father of those daughters do not want to give anyone except her daughters then in this case which action should be taken by his father to give also remaining 1/3 share own two daughters. Please give suggestion. I will be highly thankful to you.

3 Daughters and 2 sons Daughters claim the property to be divided equally as per parents wish, or as per wasiyya. This Wasiyya prepared by uncle (mother's brother) in death bed. Daughters were present and sons could not reach in hospital at that time. This Wasiyya was not signed by father, but daughters say they are witness. Pls clarify what is the right way

it is not clear that in case of hiba which is done orally , how the ownership of donee will be affirmed in future , when the person will in need to sale of his property.

Sir assalamualaikum. My grandfather(GF) was married in 1930. But he purchased the property in 1942. He make (R D D )Register Deed of Dower in 1979 his wife it men's my grandmother without consent of his majnor children's and one of them mental illness. GF died in 1986 living ligel hers. my grandmother was not signed (RDD). Because she is uneducated she can't read and write. My GF is signed RDD giver and receiver. It was valued. They have 3 female 2 male one of them is mental illness and one is govt school teacher he created a gift deed in his favour in 2001 mentioned in gift deed grandmother saying that your my loving son. So i am gifted you. She was 81 year old lady and his eye sight not visible and their no consent and not Singh for gift deed of remaining childern for that evidence medical report their. What is the solution.
