Hmmmm, no body cams to show that this raid was on the up and up. What happened to innocent until proven guilty? That is the only detail, other than missing video of the raid, that I need as an American citizen.

Is there audio of the ATF screaming like they are supposed to do, "ATF, ATF, POLICE" whatever to announce themselves? Ive seen countless videos where the Police fire on a person in their own home before they announce who they are. Its amazing Mr. Goldman doesn't ask that question. If they didnt announce themselves, then what is the expected behavior of a home owner getting there door kicked in? He didnt see 12 police cars out front and guys in all black with riot shields with ATF on their chest. He saw silhouettes of people and his door had just been kicked in. Our first instinct is to protect our family. I dont know this man but there is no way he intentionally shot at ATF/Police on that day.

Dan Goldman, turd, here’s the thing- this could have been a conversation between the deceased and the ATF in an office. They could have gone to his place of business or had him at their office. There was NO REASON to, out of the blue with zero warning to send a tactical team to a home in the early morning and break down his door, only inviting the chance of violence. Owning and selling firearms is constitutionally protected absent a felony conviction or adjudication of mental incapacity. All "laws" to the opposite are void as per Marbury v Madison. This is bullshit! They had a SEARCH WARRANT. Not an arrest warrant. They covered the camera at his door, then BROKE DOWN THE DOOR! Did not announce themselves. 10 law enforcement officers dressed in bullet proof clothing. They arrived a 6:00 am, after apparently killing power to his house. So he is awakened by the sound of his door being blown in and enters his dark living room armed to repel these unannounced intruders. This is Little Rock Arkansas, so his being shot in the head by these intruders will probably be deemed death by natural causes.

If your argument is “he shot an ATF agent, and they returned fire” you are seriously twisting the facts. The issue isn’t probable cause, or that the ATF obtained a warrant. The problem is, for weeks, the ATF had the opportunity to make contact with suspect and enforce the warrant. They could’ve searched his home when he wasn’t present, as the warrant permitted it. They could have reached out to him by pulling him over at his work or when he got groceries or whatever. They could’ve just waited until 5pm and knocked on his door, said “hey we got a warrant to search your home, you’re being detained.” No, they decided the most unreasonable method to execute. They waited until he was asleep and relaxed, at the wee hours of the morning, dressed in dark tactical attire, not to mention cutting the power to the home essentially making it pitch black inside so all he could see was silhouettes if that, which according to his wife even when inside the home never stated who they were or why they were there. He fired at what they believed to be home invaders. That’s not a dangerous criminal who intentionally shot an ATF agent. That’s just a husband trying to protect his home because the ATF is sleazy as fuck and did literally everything the wrong way. Not to mention nobody wore body cameras, which legally are required not to mention and not 1 of the 10’s of officers obeyed, and the only video of the event is a dude with a riot shield covertly placing tape on the doorbell camera. Take the Law Enforcement aspect out of this. You sneakily broke into someones home, without saying a word, had cut their power, and you’re surprised you got shot for doing that? This was an organised hit. Tf you mean? And not only that, in what world, does Law Enforcement anywhere, do everything in their power to give a supposed highly armed suspect the advantage? Most people who are suspected of firearms violations are either contacted during a reasonable time of day, or are scouted for hours and ripped out of their vehicle when it’s an opportune moment. Why would you ever give someone you suspect of this crime the ability to barricade himself in his home while you’re entire team flows into a fatal funnel? Anyone who knows anything about tactics knows this entire situation stinks. Not 1 of 20+ officers wore a body camera? Never even made an attempt at communication? All just sitting in a dangerous position with guns drawn completely silent after making entry? Every officer involved should be convicted of 1st Degree Murder. You cannot reasonably say this was justified.

As a retired senior Australian Policeman, Mr Goldman's attempts to justify the death of this poor man is making me physically sick. I would have authorised a search in daylight, NOT 0600. It is purely a knock-on-the-door search by say, three crews. This search (raid) does serve as a warning to all others who aren't doing as they are told. 1935 Germany comes to mind.

The reason Malinowski shot an agent, is because the agent busted down his door, and didn't announce that he was ATF. His power was cut, it was dark, and the agent was essentially an intruder. None of this would have happened if they had simply knocked on the door and allowed Malinowski to answer. The ATF did everything possible to create a hostile environment, and frankly got the result they asked for. Was the ATF afraid that the guns would be flushed down the toilet...or swallowed?

The warrant is s and was a low risk warrant, meaning they were to announce themselves and allow the subject to answer the door. That’s where this CLUSTER F&&K went bad quickly

its not accurate, it is not known who fired the 1st shot because there is only the ATF' account, no body cam and the other is dead. 140 guns over four years is not excessive for a collector, neither is selling nine guns over that period. It is not uncommon for someone to purchase a firearm and deciding after using it , that you don’t like it as much as you thought you would and sell it shortly after purchase. This is not or should not be a crime. The selling of personal property should not be illegal, it is just government over reach and control.
