So we have been dealing with trying to find out what really happen. Did the forestry department really burn down my land or was it wild fire that just got out of hand? Well the government agencies called me and told me the truth of what really happen.

Now that the state has cut a clean road through your property you should definitely gate it off and ensure it is 100% clear it's private property. They just opened up your property to hunters, etc.

Yeah, good idea. I went with my buddy to some land he has to look at timber - hadn't been out there for years, we found 3 or 4 tree stands running along the property line next to state land.

The big thing I think is if they had done a controlled burn and not let you know they should. I would want notification as well. It’s the right thing to do. And no excuse bc they didn’t know who the new owners were. If they do that sort of thing they have to look up the new owners. They have access to info just like we all have.

make sure it says No Trespassing Private Property NOT GOVERNMENT LAND... not that it will stop any of the clowns but when their being taken away in a vehicle with blinking lights of their choosing.. a police car or ambulance... at least you posted notice.

I work a hotshot crew for 7 years in my younger days. We NEVER cut down a fence and just left it lay. NEVER. Someone should have repaired both fences as soon as the equipment was cleared.

🔥🔥🔥We have had similar issues with our local DRN. get EVERYTHING IN WRITING. IF one of them promise to help pay for repairs….GET IT IN WRITING. What one person says is not necessarily what the higher authority will do. They ended up not fulfilling what was promised and we lost almost 10 acres of our land.
@nancyhowell7735

This happened to us over 20 years ago. There was a private company that had a contract with the local electric co-op. Their job was to drive through the area clearing trees, vines and brush from around the electric lines. We lived on a mile long gravel road with a total of 5 homes. We were at the end of the road and our driveway circled the house. One afternoon, one of their trucks drove around our house and ran over our 15 year old deaf sheltie. Apparently these 2 guys were looking at the lines and not the roadway. I ran outside when I heard the commotion. The dog was lying on his side, having difficulty breathing. The 2 clowns in the truck proceeded to tell me it was my fault because the dog was in the driveway and not tied up out of danger. We had over 20 acres and our dogs were never tied up. They lived there on our property, but these 2 decided I was in the wrong. They did help me get the dog into the back of our truck, where he unfortunately died. The outcome? Company did nothing. Said they had a contract that indemnified them from accidental damage. Since it wasn’t purposeful, we had no way to be reimbursed. The electric company and the tree trimming company said they were sorry. Neither of the entities were part if the government. Both were private companies. Our sheltie met an untimely end simply because he was taking a nap in the sun and 2 jacka__es weren’t watching where they were going. It could just have easily been a child.

@@davidheater I looked into that and it would have cost much more than I would have received. The dog is property. I could only get the value of the dog, but nothing for pain and suffering. The cost of a new sheltie puppy back then was about $200. The lawyer and court cost would have been about $5K. Nothing for the dog’s pain and suffering not ours. No punitive damages either. It would have been in small claims court and legal fees were usually on each party. We decided to use the money to buy a dog and not enrich some attorney.

I do think though when access has taken place whether emergency or not and property damage has occurred I think the land owner should be notified and someone should take responsibility for the fence coming down. I think a gate is a terrific idea! Perhaps if it’s a fire break on your land the land forestry department will pay for the gate as well! No harm in asking. 🥰❤️🙏🏻🇨🇦🍁

When we bought our property we had an easement through a farmers land to get to it using his current driveway for his ranch operations. Through that, there was an easement along the fence line of both our properties for the forestry service to be able to utilize their quick access to the Fire Tower which was two miles away from our corner access, we were responsible for upkeep. It had to be done like that before Reagan released National forests to state run or something like that, 70’s-80’s timeline. Then eventually there wasn’t a need when it was sold to private ownership.

Most probably don't read their utility co fine print or local ordinances or bylaws. There are many reasons someone can access property without permission or notification to the owner. Not saying this is a good thing but it's more prevalent than people would assume. One example is police serving a no knock warrant to the wrong address. Another is utility companies clearing branches near power lines.
@jamesmcmanus
@jamesmcmanus 2 месяца назад
Executing a warrant at the wrong address is almost always a 4th amendment violation, and no fine print or local ordinance can repeal the 4th amendment. On the other hand, causing damage during a legitimate emergency, as long as the damage isn't completely unreasonable (like going to the wrong address), the agency isn't liable but may choose to cover repairs as a courtesy.

We own a small property in the middle of a large Texas state park. Surrounded all the way around. We’ve given them our gate access code for emergencies. However, we asked for a fire break on one length of fence which it took a year to get permission from the park and ultimately from the state on their side of fence. it’s very over grown near our cabins and road. But they won’t clear it. Said we could. But can only clear it between August 15 and February 15. And then we can’t use machine equipment. Only equipment we can walk in with….. We are city folks and this is our inherited family property. We got bids and it’s much more than we can afford. We are stuck! 🤣

Sounds like you got some good responses for what happened on your property. The forestry dept might want you to join them as a local volunteer. 😊
