This criminal procedure video topic addresses the constitutional protection of the defendant's right to silence at trial. Griffin v. California places severe limits on what a prosecutor can say to the jury about the defendant's failure to testify.

The defense in the closing arguments tells the jury the defendant claims his innocence and the attorney believes him. The attorney says he has nothing more to add and told he told the defendant not to testify. The real problem is in the jury instructions from the judge. The judge can influence the jury by his authority and by using certain words and phrases. I can't believe some judges don't allow the jury to take notes so if they happen to miss some part of the proceedings it is like it was never said. Very strange. This video should be called: Taking The Fifth.
