True but If you are within the constitution zone and you want to be free that is a problem. Within the 100 mile zone is just an introduction, they are just prepping you for whats to come.

CJ wasn’t clear about them attempting to determining citizenship status. They can only detain you briefly in an effort to determine citizenship. They can’t detain you longer than briefly simply because they can’t make such determination. For example, if you have a rental car, then they won’t be able to make a determination but they must release you after only a brief detention.

The Supreme Court has screwed us with several cases, but what screws us even more are all the judges that allow cops to disobey the limits that the Supreme Court has clearly put in place. For example, almost all cops that rely on PA vs Mimms to pull you out of a car on their whim, will very like do a frisk level search despite the Supreme Court clearly saying that the cops must have a reasonable belief that you are both armed and dangerous. CJ mentions 2A number stickers giving cops a reason to believe that you are armed, but gives no examples of evidence that would provide cops a reason to believe that you are dangerous.

I used to be a pet bird buyer...lovebirds, finches, cockatiels, etc etc. One place I went was Quamedo Tx. Loooong road from there back to east. Had a load of 1000 cockatiels and got pulled over by border patrol. Guy came to my window and hollered are you a citizen and the birds went nuts! He shined his light in. He was stunned. I said, they're all citizens. He nearly fell over laughing! I laughed all the way back to Rockport 😆 🤣

These check points have nothing to do with anyone citizenship. Just pay attention and 90% percent there walking with a dog doing a pre sniff for drugs! This interaction is enough time for the dog a chance. Just my opinion. Keep up the great work C J. 👍

Meanwhile a ton of coke walked across the border elsewhere or 10 tons came in by narco sub or plane or semi. End the war on drugs and secure the border. Divert a few billion from political grift and funding proxy wars. There I fixed it.

If I ever come in contact with a border control checkpoint.. which I'm sure at some point I probably will because that line will wind up reaching across the entire United States at some point they'll wind up being checkpoints everywhere we already know that our country is being subjugated or legal system is a joke I pray that I never have to interact with any of these people but I praise everyone that does have to interact with these people You giving them information as to how to interact with these people is greatly commended appreciated and loved thank you for what you do please don't stop please don't ever stop..

How does a "vehicle" being "registered" or not determine if the "person" "driving" is a "U.S.citizen"? How does "registration" confirm the "driver" and "owner" are the same "person"? And what "information" exists that any "person" is "driving", if there is no "registration"? Since you're familiar with Texas, Transportation Code would apply.

Govt demanding me to Exit my vehicle (homestead) makes me think it will be easier to use qualified immunity when they become a derrick chauvin and treat me like I'm George Floyd & their safety was signed away when hired as govt slave / employee. Be a good servant as an expendable commodity.

I've lived in Texas for 40 years. I just retired to a clean beach here in Florida, where you can actually get in the water without worrying about fecal matter. I regress; I live between Houston and Corpus. But I've never entered border patrol. Plus, have you seen their patrol map it's a 100-mile radius all around the US. They can literally set up camp in all 50.

When CJ mentioned Terry V Ohio, it put me in mind of something I thought About on that subject. From watching numerous videos of police encounters, it seems quite clear that in the vast majority of law enforcement agencies save routinely pat down every person they pull out of a car regardless of the nature of the encounter. The Terry ruling says that they can only do the cursory pat down search if they have reason to believe that the person is armed and dangerous. If there are padding everybody down then they have to make the insane argument that they believe every member of the public is armed and dangerous or they are violating the law. All that said, I wonder if any attorneys have thought about doing a class action lawsuit on a city there are certain cities that have an abundance of video encounters, plus body cam footage you can get, that would prove in a Monell claim that the police are routinely doing Terry searches on everyone. If you could get a couple multimillion-dollar class action settlements from a couple of cities, I bet the other cities would start changing how they do business.

Now, when/if they ask me, I just ask them "How's Barbra"? or "Tell Melanie to stop calling me", or when it's hunting season here in my area, which is about 4 different hunts a year, I ask "Are you going out of town again this weekend? Tell her she can call me when she wants". They get pissed and they say "Have a good day", and point to the North.

Maryland v Wilson is the case that allows them to make passengers exit a vehicle. Mimms says they have to believe you are A&D in order to force you out. The CRL just discussed this in his most recent video. He says that cops often misuse the Mimms decision. Do you agree? 21:23

If you can't analyze that statement and say that this is not an illegal entry into our country you're inept in your duties... Not to mention why are you worried about it at all if you've got people at the border coming in illegally and you catch them and just say it's okay Just come on in free to come on in Willie nilly what the hell are we even talking about it at this point why are they even boosted up a hundred miles inland all the people that are posted up a hundred miles inland should be all down at the border stopping illegal entry it's all legal fallacy it's corruption going awry

Maryland v wilson is the case law for passengers. Basically he said penn v mimms only applied to driver and the courts said nope. All suckers in the car are detained and must comply with being ordered to get out (for officer safety). Hawaii has a nice ring on it in their state constitution. saying the officer must show the probable cause to think they are armed AND dangerous, i think massachutses has a similar thing in state law. We all know each cop is affraid of acorns so it should not be too hard to say why they think you are armed AND dangerous. For officer safety is the lazy pygs choice of articulation.

When asked if I am a US citizen, I say I don't know. I tell the BP agent to look in their computer system. I don't have access to their system, so how could I possibly give an accurate answer about my citizenship status? I could only speculate.

So if you eliminate and dispose of their suspicion buy your conversation on the onslaught of first interaction then they're moving you to secondary or asking or requiring or expecting that becomes unconstitutional if you're able to dispel their suspicion verbally and not answer the question if you ask them the questions it's all about wording apparently and recording and if you really want to go down the rabbit hole you dispelling their suspicion by their own words then it only becomes their ego and their lack of proper training that is the problem

§ 287.8 Standards for enforcement activities. The following standards for enforcement activities contained in this section must be adhered to by every immigration officer involved in enforcement activities. Any violation of this section shall be reported to the Office of the Inspector General or such other entity as may be provided for in 8 CFR 287.10. (b) Interrogation and detention not amounting to arrest. (1) Interrogation is questioning designed to elicit specific information. An immigration officer, like any other person, has the right to ask questions of anyone as long as the immigration officer does not restrain the freedom of an individual, not under arrest, to walk away. (2) If the immigration officer has a reasonable suspicion, based on specific articulable facts, that the person being questioned is, or is attempting to be, engaged in an offense against the United States or is an alien illegally in the United States, the immigration officer may briefly detain the person for questioning.

No, the Court said they could pull you into secondary for TWO reasons: the limited purpose of determining citizenship and if there is reasonable suspicion of another crime. If you refuse to go to secondary, you meet BOTH reasons.

I think you over stated what Pennsylvania v Mims actually said. That case was about officer safety. The cop always made them exit, for his safety. At least that was the claim. It was his standard practice. That's my recollection of the case. I'll look for the other case and reply

I would argue they've destroyed that as well judging by all the SWAT raids for nonviolent crimes. Cops are constantly in our homes either physically or by surveillance.

My question is how are these ESL agent able to know if your answer is truthful or a lie they can't do why even ask. Can they read minds do all an illegal has to do is answer yes and they get a free pass in to the country
