"have you identified everyone in the vehicle" all 50 states say they don't have to or have the right to since he's not in operation of the vehicle
@jasonmorin5894
@jasonmorin5894 3 месяца назад
He can ask. He can't extend the stop to identify. The passenger can say no as long as there's no reasonable articulable suspicion of a crime by the passenger. In this case, the woman yelled, "run Bryce!". When she took it upon herself to kick and assault the officer, I'm not sure that wouldn't then lead to ARS to identify. But before that assault and utterance, no.
@PotholedAxe9985
@PotholedAxe9985 3 месяца назад
They have the right to ask, you have the right to refuse identification. However, they do have the right in all 50 states to order you out of the car regardless of whether they are the driver or passenger. And you do have to comply with this or face obstruction/interference charge. Beyond the Miranda Rights you are told upon arrest when they have the intent to question you, police aren't obligated to inform you of your rights and what you are allowed to refuse to comply with. Also, prior to an arrest, a police officer can ask you anything they want. Whether you answer or not is up to you. Only common case where you are legally required to answer a question in any legal proceeding is where you are the driver of the vehicle and they ask for identification. But you don't have to answer verbally, your license, registration, proof of insurance, etc will suffice.
@grahamlowe314
@grahamlowe314 3 месяца назад
They can only order you out for certain reasons
@PotholedAxe9985
@PotholedAxe9985 3 месяца назад
@@grahamlowe314 Pennsylvania vs Mimms describes that an Officer can order anyone out of a vehicle during a legal traffic stop. (aka, had a valid reason to stop you, even if they aren't telling you the reason) The only requirement is that it must be for officer safety. Which is vague and includes the example of the traffic on the road being a valid reason to pull people out of the car, which is a very low requirement for justifying it, essentially making it defacto law that you must exit the vehicle when told to. Any dissenting opinions on that ruling wasn't in relation to the exiting of the vehicle, but rather a frisk that took place afterwards, but as the court ruled in favor of the officer here, a pat down after exiting the vehicle isn't considered an infringement upon your liberties due to case law. So no, not only for certain reasons, pretty much any reason that can be justified by "It was done for the safety of the officer" will be considered legal with the basis of case law for the defense of the agency. Which traffic passing by is good enough of a reason to justify it, per the supreme court. As for a passenger specifically, not just the driver, Maryland vs Wilson holds that even passengers are subject to the ruling of Pennsylvania vs Mimms.

There's a lot of people in this comment section that think asking for ID of the passenger is a rights violation..... asking for an ID is not a rights violation in any circumstance whatsoever. It is the forcing to identify that is the violation. Cops can ask you for whatever they want, you don't have to comply for things that would be a violation of rights.

The fellow in the car did not have to ID. He didn’t even have to speak to the Officer. Though the Cop didn’t have to let her off with warnings either.

are you saying crime happens in the low income neighbourhoods “yes sir yes i am” that question is so stupid cause why would it be more expensive to live on a private estate and high income neighbourhoods usually have less trouble and second statistically speaking yes it does and i’ve seen with my own eyes

The writers of this show do not know it's unlawful to ask for an ID without probable cause .

As the people of this show know, better than you, a cop can ask whatever the hell they want. It is unlawful to force you to show ID.

It’s unlawful to demand ID without probable cause. A police officer can request to see an ID really whenever they want to.

Police can ask for your ID whenever they want. But you're not required to give it to them. It's only unlawful to demand or forcefully take an ID under threat of arrest for no reason. I guess the creators of the show arent the ones in the wrong here bud.

Law enforcement do not have the authority to demand the ID of people who are not suspected of committing a crime. That specifically applies to her passenger as they were stopped because of her behavior, not his

I felt like I was going crazy. I keep seeing clips of this guy I couldn't identify. No clue who the actor is it wherever he appears, but the face looks slightly familiar with the voice being the main thing that FINAKLY ticked off the only thing I needed to figure out where I know this man: Buck.

It is unconstitutional to demand ID from everyone in the vehicle on a simple traffic stop. The passengers have no obligation to provide an ID.

"Are you saying crime only happens in low-income neighbourhood?" "Violent crimes, yes. When was last time there was a gang-related shootout in, say, the Hamptons? That's called seeing the truth, sarge. Get your head out, sometimes." Gosh, I so wanted to antagonize the sarge there.
