All of those homeowners featured in the segment should seriously consider running for a seat on the HOA board. That is what you do when you’re not happy with your HOA is you don’t throw your hands up and say the HOA’s are bad. This is a people problem if you don’t have the right people who know how to run things then you get them out of there and replace them with people who do. And that’s what elections are for. That’s the opportunity to do this. These people can very easily go walk to their neighbors and introduce themselves and announce their candidacy and give their reasons and concerns that are not being meant and why those homeowners are to vote for them. They’ll most likely get elected that way. Saying the HOA’s are bad because you have a people problem is the same as saying that government is evil because you have a people problem. You deal with people problems by getting better people not throwing the system out.
Need to be outlawed. No entity should have more power than the government, with none of the safeguards of checks and balances. Everything that HOAs purport to regulate is already governed by city code. Everything that HOAs are supposedly needed to fund are already fundable with a Public Improvement District. Zero reason for HOAs to continue to exist.

We're going through this now. The previous HOA association president used our bank account as her own personal entertainment fund. She opened a debit card and racked up thousands on food and other non related expenses. The management company was and is also helping cover the theft. The HOA lawyer made thousands by handling all member letters such as violation letters that were once the responsibility of the management company. The lawyer sent out hundreds at $350 each. Your grass is too long...$350. We took back the board, fired the management company and replaced the lawyer. Getting assistance from the government (Florida, DBPR) is fruitless as they refuse to assist with anything even though its their job to oversee HOA's and management companies. We're also near bankruptcy so paying for help isn't an option. They all need to be in jail.

Our HOA lawyer made a deal with the management company to off load all violation letters to the lawyer at $350 each. The management company in the past charged us a flat fee which equated to about $15 each letter. This went on for a few years before all reserves were depleted and the residents found out. We're now facing bankruptcy and will need thousands in assessments to pull out.
If they cannot maintain things at the same level that they expect owners to maintain, then every fine they issue is hypocritical. Most HOA's need to be disbanded, and audited, with criminal charges for any misdeed
Did you show up drunk? If you do something like that at the HOA meeting and make a fool of yourself and refuse to wait in your turn then the they can ask you to leave. It’s not a free-for-all. There is a specific way in which you can air your grievances otherwise if you do it properly, they have no right to do what you allege.
If I were a landlord or HOA president, there would be an itemized list of true expenses going out. Also, the tenants would get a copy of it each month after they pay their monthly dues. This would include seasonal tasks, such as dates when people shoveled snow, plowed snow, and cut the grass during the spring and summer.
*Conclusion: It’s easier to spend money when it’s not yours.* Lawyers on both sides don’t mind this case dragging out longer and are probably the best of friends behind the scenes by now. 😂

Yes my guess is because they were anticipating getting their *future* HOA dues. Which they wouldn’t get if they were renters. The whole thing is just ironic as hell. And stupid. Very stupid.
90% of HOA residents hate their HOA. they do nothing. and what are they worried that they are using, the parks? I'll go to other parks in other neighborhoods and kids don't stay in their neighborhood to play. have you noticed that the places that try harder to keep "others" out get the most trashed. the more relaxed HOAs get less property damage.
If they’re legally condos, then the condo developer is on the hook for the HOA fees. If the condo developer refused to pay the HOA fees, then that really would be a lawsuit.
@@jsch9173 Yeah this is what I was thinking. They're still condos but since they're being rented out, the developer would just be the one on the hook for HOA fees instead of the renters. Is there something written down that says the developer is exempted from paying HOA fees or something?

The HOA is correct. These were intended as condos but are now apartments. Apartment: residential building made up of individual units that are owned by and managed on behalf of one owner. Condominium: Residential building of individual units owned by distinctly separate owners. There may be a management company for the building overall and the common use areas, but a renter of a unit reports to the owner of the unit, not to the management company.
Why does a rental vs owner have anything to do with the HOA fees. Wouldn't the owner of the rental property still have to pay the HOA fee and pass that on to the renter?
My thoughts exactly. Whoever the true owner is, whether it's the condo owner or the landlord renting it out, wouldn't one of those people have to pay the HOA fee and thus pass it on to whoever the actual tenant is?

As a former President of my coop board in NYC, boards are required to keep minutes of their meetings, which are available for inspection. They are also required to have an annual shareholders meeting and elections. The homeowners need to get busy going through the HOA rules and hiring their own attorney if the board doesn’t respond. They also need to put together a slate of candidates and vote the current board out.
Happened in our HOA. New builds had county approval and our HOA leadership sued the ppl for 3 years and LOST. We also found shady hiring of managers and sub contractors
The homeowners of Power Ranch can force a Special Meeting and remove all of the current Board members in one action. Then they will have to vote for a new Board. That new Board can immediately negotiate with the developer and reach a rapid settlement. So what about the huge legal fees that the current Board have authorized? They are all bonded and insured in case they make stupid decisions, like this one.
My HOA in Las Vegas has a yearly line by line item list as to where the money goes. I think that we have a good board and management company. No real complaints myself.
That’s how it’s supposed to work. HOAs are required by law to publish financial statements and distribute them to homeowners. By living in the community you’re responsible for keeping them accountable. If they’re not doing a good job, vote them out. If you don’t like HOAs don’t live in a community with one. Not sure I get all the weird frothy comments in videos like these.

Look up legal definition of a condo vs. apartment. If he is renting them out--they are apartments and not allowed. Condos are bought and sold individually.
I think there needs to be a limit on what a HOA can do. This is ridiculous because the HOA can't charge those tenants they are trying to halt the build.
My parents lost a lot of money on their home because of the hoa. The HOA in their community was suing so many people over fences and grass length and the color of their curtains etcetera. Lawyers and lawsuits there was never money to keep up the lawns and the pool and the community building and it started looking like a slum area. Then the HOA raised their rates to cover all the lawsuits and eventually my parents moved out and lost money on a house in Florida???
So an HOA is suing a developer over a community outside their jurisdiction? Did I understand that right? And they were not responsible and did not ask the homeowners if they wanted this suit brought?
Someone on the HOA board has some lawyer friends and is getting some kind of kickback for using their services over nad over. Id investigate the lawyers too.

Exactly how would having rental units near an HOA property affect the value of units in the HOA? It doesn’t and can’t. This is a giveaway for the attorneys. A scam. Especially since the HOA property is not being well-maintained.
Not mentioned - what is the LOSS of $125K per year to the HOA (homeowners)? Is the HOA (homeowners) responsible for the maintenance / landscaping of these new condos? When the new condos are rented will the renters be eligible to use the HOA's amenities? Amenities include pool, parks, playgrounds, tennis courts etc., etc.. If the HOA is LOSING $125K per year to the new condos that cost will be passed onto the homeowners in increased HOA dues. Why does this news segment not include the reason behind the $125K LOSS?
How the money is spent is information available to all HOA members, or at least it should be. That's why it is called an "association" and why there are "members". Were the homeowners who are complaining "we should know" blocked from getting the info? The info was hidden from them? Or are they just complaining because they didn't wipe the Dorito dust off their fingers, get up out of the recliner, and go get it and got surprised?

I am confused on why renters pay less in HOA fees. I am not sure about there, but here, the owners pay the HOA fees. This can be reflected in rent, but not directly paid by the renter. As the owner, the developer should be responsible for the HOA fees for each condo int he HOA. What am I missing?
I blame the Judge for milking the tax payers for all he can. He can pick up the phone and ask the county tax office, if they classify a rented condo as a condo or apartment. We have to start paying judges for what they accomplish, not for how long they can drag a dispute out.
Everybody is missing the point. The HOA states that renters dont pay as much HOA fees as Owners. This is a problem for the HOA of course. The question that the reporters completely failed to research is why the Developer isn’t the Owner as far as any HOA fees for each rental unit. Go ahead and rent away, but the HOA must get equal payment for these units. There must be some language somewhere protecting the Developer from the HOA fees if they rent. That may be what the lawsuit is about.
HOA and CCD money belongs to the developer. What they spend all or a portion of the money is up to you. It may be different according to the state. This is the reason why a developer builds home, make money.
