The federal government needs to pass very stringent laws against discrimination against disabled persons in this situation, to include imprisonment, and fines in amounts in excess of millions of dollars on those who violate these laws.

Actually I love these kinds of cases, because the first thing you need to do is find yourself both a Civil rights attorney and an A.D.A. attorney so you can inform your HOA that you are not removing the ramp but that i will be Suing the Entire HOA for 100 million dollars for Descrimination???????????.

Homeowners' associations (HOAs) cannot deny reasonable modifications to homes or common areas that are necessary for a resident's disability, such as handicap ramps. The Federal Housing Act makes it illegal to refuse reasonable modifications to a property that are necessary for a disabled person to enjoy it.

SOOOO, she was willing to live inside and under tyranny. wat was going to be her reaction if they banned disable individuals from using the public walkways, that is the next step, then require her to relocate to an assisted living center. Each domino opens to the next one. a reasonably good ADA lawyer would turn the board into broken pretzels, and could, in some cases, put them in jail for violating federal housing rules, the FHA can be as vicious as the IRS.. No one has enough money to fight THAT kind of problem

My HOA tried to play around with me. I contacted the HOA attorney and basted him. We have a no pickup truck after 5PM. a buddy of mine only has a pickup truck and he came for dinner with his gf. I never heard another word.

Most folks, when confronted with this kind of predicament, will take the easy way out and comply. In this case complying would have been an act of humiliation and extreme hardship; so they did the right thing in hiring an attorney. I hope that there was some room and resources to bring a lawsuit against both the HOA in general and its president who should have been on the side of the wheelchair family to begin with.

I don’t think this story is true. HOAs do not have the authority to demand a wheelchair ramp be removed. It is against the Americans With Disabilities Act. Liens are generally put on a house by a creditor. By law, the creditor must give a legal lien notice to the homeowner first, stating why the lien is being placed. Then the creditor has to file that notice with the county clerk’s office. Having a wheelchair ramp is not a reason to put a lien on a house.

Some HOA’s are good but many others are bad ones. What needs to happen is stronger laws in place to give the HOA less power but to protect the ones in a HOA to have more rights to protect themselves. HOA’S feel the power that takes people houses from them.
