So if you are single at 33 and homeless an they refused to give you a temp accommodation but they given a duty to rehouse or prevent your homeless and your only entitled to shared accommodation LHA rates as a part of the PHP, what happens if you can’t find one During the 57 day prevention ?
If the Prevention duty ends after 56 days, it then kicks into a Relief duty for another 56 days but if a Homelessness duty hasn't been accepted after the Relief duty ends. It's likely you would be deemed Not in priority need if you don't meet the threshold for being owed a Homelessness duty. You'll need to find accommodation within the shared accommodation LHA rate. If you reside within a hostel for 3 months or more, you would then be eligible for the one bed LHA, regardless of your age.
Hi, I was in this position, they told me to move back in with parents but I was 19 when my mother and grandmother died who I was living with, I'm estranged from my father so this silly advice was useless. The council was pretty useless for 8 months, I was sofa surfing in 2018/2019 after I was made homeless at 28. Later in 2019, the council put me in a shared accommodation property which which is not very good because I have a range of health problems and some very dangerous people were living here, most are gone now. I have been on the councils waiting list so its been almost 5 years. I think it's very cruel not to be able to get the 1 bedroom rate just because you're under 35 especially if you have no choice and health problems.
Yes and no. If you have a low income, local council will assess risks to you and award LHA. Universal Credit however, will deduct your "low income" from the LHA. Commonly, say your income is £600pm, local rent average £500, the LHA rate £300. UC will list the LHA "award", but deduct all of it .
If you are a survivor of domestic abuse, as well as 3 months plus living in supported living, will the whole one bedroom lh rate apply? Or will there be deductions on this rate if you live alone with no children?
Living in supported accommodation for more than 3 months and being a survivor of abuse over the age of 16 both qualify for the exemption on their own, here's a video about it i've just done: ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-f06LY5hYyvM.html
sounds like you're a lodger. If you're over 35 you'll get up to whatever the LHA pays for single people over 35. If the rent is more than that then you'll be expected to pay the difference from other income
Hiya, unfortunately we don't have capacity to give advice out individually. We run a weekly livestream on our RU-vid channel for people to ask anonymised 'what if' questions about the law (Thursdays at 7.30pm).
Can you help me push an LHA petition I recently discovered? The LHA rates have been frozen since 2020 and not risen with inflation hence why the private sector has become a nightmare for local authorities to move homeless applicants into the private sector. RU-vid doesn't allow me to upload the petition link but google: LHA Petition This petition needs a major push! Please help 😉
