he wasnt intending for you to be in the video, you just happened to be in it, hes not going to go around asking everybody for permission to be in his video.

it's a public game, as moongrace said he wasn't intending for you to be in the video, but it is a public game and he can't just find everyone in the server and ask for permission to record them. basically everytime you join the game you are allowing that permission (people to record you)
