Ok, so what you are saying is that there was reasonable suspicion. I get that the smell of weed would justify a search. However, since there was never weed and thus no smell, they lied and made up an excuse to search his car. The smoke was not enough to justify an unwarranted search of his vehicle as it had no odor and was actually water vapor. Vaping has a smell of tobacco or other flavors, but flavored ones are illegal in California, but tobacco flavored vapes are legal. Also, him acting weird does not constitute an unwarranted search of his vehicle. In nost states being high or on drugs as long as you don't drive, is legal, just not the buying, possession, or selling. Having it in your system is usually ok. As he was sitting in his car and didn't show any sign of driving, that can also be ruled out of a DUI. His arrest was also unlawful. He could have ebeen detained until they figured the situation out and let him go.

He needs to get a lawyer, you can’t be arrested for a minor traffic violation(parking) And a Class C misdemeanor is only punishable by 500$ in fines, you can’t be arrested for it, so this seemed rather retaliatory and illegal.
